Secretary Subject: Issuance of NPDES Permit NCO065307 Renewal Scotchman #3303 New Hanover County Facility Class II Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit.- This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The following items are changes made to the draft permit sent -to you on April 9; 2014. • Since there is no longer an influent pump station and the wastewaters flow via gravity to the primary tank, the influent pump station was removed from the components list. • The effluent discharge sampling point was renamed Outfall 001 and the internal sampling point following the domestic wastewater treatment plant is referred to as Internal Outfall 01-A. Two separate Effluent Limitations and Monitoring pages, Section A.(L) for Internal Outfall 01-A and Section A.(2.) for Outfall 001 were created to make Discharge Monitoring Reporting (DMR) clearer. • Two changes were made to the Limitations and Monitoring -requirements listed in the draft permit: 1) the Total Flow monitoring frequency for Outfall 001 was increased to once per week to match other parameters, and 2) the internal Oil & Grease limitations and monitoring requirements were moved to the effluent Outfall — 001 page in section'A.(2.). GPM Southeast is responsible for making sure the oil and grease interceptor is properly maintained and functioning so the WWTP is not overloaded. • Please note that the Division understands that the current facility has an internal monitoring device for the WWTP that records daily flow and is calibrated annually. Flow monitoring data from this recording and sampling device, located prior to the MBBR tank, will be accepted on the DMRs until modifications can be made to sample actual WWTP influent or effluent flow. This was necessary since a permit cannot be issued for more than five years. The Division recognizes that this expiration date does not coincide with other permit renewals in the Cape Fear River Basin. In addition, the final permit contains the following significant changes from your current permit: The requirement to begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your NPDES permit. [See Special Condition A. For information on EPA's proposed NPDES Electronic Reporting Rule, please visit the following website: http://www2.epa. ov/compliance/proposed-npdes-electronic-reporting-rule. • The Limitations and Monitoring Requirements for Outfall 001 (domestic wastewater treatment plant effluent) in your current permit are now listed as Internal Outfall 01-A in Section A.(L). Sampling for this internal monitoring point should represent treated domestic wastewater effluent prior to mixing with wastewaters from the water treatment plant in the .wet well. • The Limitations and Monitoring Requirements for Outfall 003 in your current permit have been combined with other water quality limited parameters on the wastewater treatment plant and are regulated under Section A.(2.) as the facility's effluent or Outfall 001. Sampling for this outfall shall occur after UV treatment and represent the combined wastewaters from treated domestic wastes and the water treatment system. • Total Suspended Solids (TSS) shall be sampled at the Internal Outfall 01-A and the effluent discharge Outfall 001. Both outfalls have TSS design limitations of 30 mg/L as a monthly average and 45 mg/L as a daily maximum. • Total Fluoride, Total Iron, and Total Manganese monitoring have been removed from the permit since additives containing these parameters are not used in the process and there are no NC saltwater Water Quality Standards for these parameters. • Outfall 002 was eliminated from the permit since the stormwater discharge is covered under Permit SW8900421. • Note that testing for Total Copper and Total Zinc shall be performed in conjunction with Acute Toxicity Testing. Please see footnote #5 in Section A.(2.). • Some of the wording has changed in Section A. (3.), Acute Toxicity Monitoring, please review each paragraph carefully. Addressing impaired waters is a high priority with the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. ACUTE TOXICITY (QUARTERLY) -- MONITORING ONLY The Permittee shall conduct acute toxicity tests on a quarter lX basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -December 2010 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Piniephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). The tests will be performed during the months of January, April, July, and October. These months signify the first month of each three month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final.. effluent discharge below all treatment processes. The parameter code for Pimephales promelas is TGE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Additionally, DWR Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during any month, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation -in late 2013. NOTE: This -special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)1 Beginning no later than April 21, 2015, the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit ATTENTION: Central Files / eDMR . 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary waiver by the Division. (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. No public comments received Bac round: This is a minor permit renewal for a truck stop facility that treats domestic wastewaters that are combined with softener backwash and RO reject wastewaters prior to discharge. The facility was in non-compliance and was issued a Special Order by Consent (SOC) on May 31, 2012. A new ORC was hired in Sept. 2012 and the new domestic wastewater treatment system was installed in Oct. -Dec. 2012 and certified complete on 2-19-2013. The permitted flow of 0.004 MGD did not change. A change of ownership occurred in August 2013 and the new owners, GPM Southeast, LLC, acquired a change of ownership for the NPDES permit in Feb 2014. GPM Southeast submitted a revised permit renewal application on Feb 28, 2014 which documented the new treatment system. This is a commercial facility with 25 to 30 employees. The new domestic treatment system consists of a grease interceptor, 2 primary tanks, 2 equalization tanks, a Moving Bed Biofilm Reactor (MBBR) tank with media followed by a trickling filter. The treated domestic wastewaters flow to a wet well where they are mixed with softener backwash and RO reject wastewaters. The combined wastewaters are than pumped through bag filters to remove additional particulates and disinfected with an Enaqua UN system. The MBBR domestic treatment system is designed to handle 0.004 MGD and the wastewaters from the water purification system (2 softeners and RO reject) are estimated to be 0.003 MGD. The SOC and previous permit divided the testing into three Outfalls to distinguish between sanitary wastewaters-Outfall 001, stormwater-Outfall 002, and water purification backwash and RO reject-Outfall 003. The stormwater has been removed from this system and is permitted under a separate stormwater permit — SW8900421. Internal sampling will remain in the permit at the domestic wastewater treatment system effluent (prior to the wet well) to confirm that the treatment system is meeting State and Federal secondary standards for BOD5 and TSS. This sanitary wastewater sampling point was renamed Internal Outfall- 01-A in the permit renewal. WWTP flow will be monitored internally as well to verify that it is not exceeding the plant design Page 1 of 4 PERMIT # NCO065307 capacity. All other sampling has been modified in this permit to occur at the effluent discharge, at a point after UV treatment where all wastewaters have been combined and treated. The effluent discharge sampling point is referred to as Outfall 001 in the permit renewal. This facility discharges to the Northeast Cape Fear River, a waterbody classified SC; Swamp waters within the Cape Fear River Basin. The Division estimated stream flow characteristics in 1990 to define the waste load allocation for the domestic wastewaters. As part of that evaluation, BIMS lists the summer 7Q10 at 26.3 cfs, the winter 7Q10 at 94.6 cfs, and the 30Q2 at 157.7 cfs. Using the summer 7Q10, an IWC of 0.035% was calculated for this facility which demonstrates the significant amount of dilution available in the receiving stream. This section of the Cape Fear is on the 2012 303(d) list for being impaired for copper in 2008. This impairment is not listed on the draft 2014 303(d) list. Compliance: This facility has numerous monitoring and permit limitation violations for BOD5, TSS, enterococci, pH, TRC, and DO. The new treatment system has improved treatment; however, it has required some modifications and adjustments and has not consistently achieved limitations as designed. Bag filters were added to achieve BOD5 and TSS limits and the ORC has eliminated the use of different disinfectants that have caused upsets in the MBBR system. A new ORC was hired in Sept. 2012 and the new owners, GPM Southeast, stated that they are committdd to complying with NPDES permit limitations. Over 7 NOVs have been issued during the past year. All of these failures occurred in 2012. Page 2 of 4 PERMIT # NCO065307 RPA: A RPA was not performed on the effluent from this facility because there have been so many changes to the treatment system, there is a limited data, and there are no saltwater Water Quality Standards (WQS) for Fluoride, Iron (Fe) and Manganese (Mn). Copper, Zinc, Arsenic, and Chloride sampling will remain in the permit and an RPA can be performed at permit renewal when several years of data are collected under the new treatment system conditions. PERMIT DEVELOPMENT: Monitoring at Internal Outfall 01-A will be maintained in the permit for Flow, BODS, and TSS. This testing will verify that Secondary standards are being met and that the flow design capacity is not exceeded. Oil & Grease limitations and monitoring have been moved to the effluent page, Outfall 001. The facility is responsible for making sure the oil and grease interceptor is properly maintained and functioning so the WWTP is not overloaded. Water Quality based limitations and Water Treatment Plant (WTP) Permitting Strategy limitations and monitoring requirements are to be monitored at the effluent discharge, renamed Outfall 001 located after both wastestreams (sanitary and water treatment plant softener backwash and RO reject ) have been mixed and treated in the UV system. Monitoring for Fluoride, Iron, and Manganese have been removed since there are no saltwater standards for these parameters. Acute Toxicity testing will remain in the permit at 90% effluent, as required for complex wastewater discharges (WTPs) to tidal waters that have not been modeled. Stream sampling was not added to this permit since the WTP discharge is small and the receiving stream provides significant dilution. Monitoring for DO, Enterococci, Temperature, pH, ammonia -nitrogen and TRC is required for Class II facilities treating 100% domestic wastewaters in accordance with 15A NCAC 2B .0500 Administrative Code. Monitoring for Flow, Temperature, pH, Salinity, Ammonia -nitrogen, TDS, TSS, Conductivity, Turbidity, Total Chloride, TRC, Total Arsenic, Total Copper, and Total Zinc is required for RODE wastewaters per the NPDES Water Treatment Plant Permitting Strategy. To reduce the amount of sampling required by the Permittee most of the sampling for water quality limited parameters will now be performed at the effluent discharge point or Outfall 001. Monitoring frequencies were based either on NC Administrative Code or the WTP Permitting Strategy. The WTP Permitting Strategy has a TSS treatment limitation so the permittee is required to demonstrate compliance with TSS at both sampling points — Internal Outfall 01-A and the effluent Outfall 001. The maximum amount that can be discharged from the water treatment system (combine softener backwash and RO concentrate) (gallons per day during hours of operation) is .0065 MGD. 7.) Please specify hours of operation. The system operates 24/7. 8.) Given that, what is the max that can be discharged from the wet well, or is the limiting factor the pumping capacity from the wet well, the wet well capacity, and/or the UV design capacity? The wet well (effluent lift station) pumps were designed to operate at a maximum of approximately 32.5 GPM @ 13-feet TDH. This was based on the length of the discharge pipeline found in the Worsley records. The operating flow rate is adjusted by the operator using the butterfly valve located near the UV unit. We set this at approximately 25 GPM following the start-up as this is the discharge flow rate noted on the approved plans. We noted that the flow at high tide was approximately 28 GPM with the valve fully opened. 9.) What is the UV design capacity? The UV unit is a model M3-U8 which has a total of eight lamps and a U-configuration. Four lamps are primary and the remaining four are redundant and used if one of the primary lamps fails. The unit is designed to process up to 35 GPM at 65% UV transmission with four lamps operating. If all eight lamps are operating, the unit can process up to 70 GPM at 65% UV transmission. As noted on the plans, the water should not exceed 5 NTU turbidity. 10.)What is the wet well capacity? The wet well capacity is approximately 735 gallons at the high level switch setting, with a total capacity of 1,225 gallons. 11.)What is the force main pump capacity? The effluent lift station, referenced in response to Question 8 above, includes the pumps that are used to discharge to the river and would, in this case, be the force main pumps. The maximum capacity for the force main is 32.5 GPM. However, as stated above, the pumps should not be set to more than 25 GPM. 12.)Also, please to be sure to address sludge disposal practices to be used at the facility in handling solids from the wastewater treatment system. No sludge is generated by the Bioclere wastewater system. Sludge and solids that slough off the Bioclere trickling filter are pumped/recycled to the primary settling tank on a timed interval; usually on an hourly basis. The primary holding tank is pumped every other month to remove solids that are introduced into the system from store patrons. 13.)Please list your residual management permit #. Have you applied for a change of ownership for this permit? There was, at one point, a residual management permit listed for this facility, but it expired. Due to the fact that the installed Bioclere system recycles all solids, and sludge is not produced or removed from the system, a renewed residual management permit is not required.
