Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit. includes no major changes from the draft permit sent to you on May 23, 2007.
This pennit includes a limit for Enterococci that will take effect on Februam 1, 2008 and a TRC limit that will
take effect on February 1.2009. If you wish to install dechlorination equipment, the Division has promulgated
a simplified approval process for such projects. Guidance for approval of decblorination projects may be
viewed online at http://www.nccgl.net/news/ATCoverview.html.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory heating upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final
and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local

All previous NPDES permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this
number is no longer effective. Therefore, the exclusive authority to operate and discharge
from this facility arises under the permit conditions, requirements, terms, and provisions
included herein.

A. (3.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the effective date of this permit, the Permittee shall submit to the Division a
wastewater management plan. The plan shall include, at a minimum, the following elements:
• Alternatives analysis. Conduct a technical and economic evaluation of connection to the
nearest municipal wastewater collection system. The analysis and report should be
consistent with the EAA guidance document provided by the Division.
• Facilities assessment. Describe deficiencies and operational difficulties in the existing
collection and treatment systems that inhibit performance and/or permit compliance.
Identify potential improvements to correct those deficiencies. At a minimum, evaluate the
following considerations:
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris

• Optimization plan. Develop a plan for optimization, rehabilitation and/or replacement
of any system components necessary to achieve optimum performance. Identify specific
measures and key tasks, including those in the above facilities assessment, and provide an
estimated schedule for completion of each.
• Biosolids management plan. Develop an operations plan to be used (and describe the
procedures currently used for managing septage / biomass in the treatment system,
including associated solids wasting and disposal, to promote optimum treatment system
performance. Identify operating parameters to be used and target values or ranges of
values where appropriate.

A. (4.) OIL/WATER SEPARATOR CONDITION
The oil/water separator shall be properly maintained and operated at all times. Maintenance records shall
be retained on -site documenting and dates where free product was removed and any operation or
maintenance repair dates.

The Division may, upon written notification to the permittee, re -open this permit in order to incorporate
or modify effluent limitations, monitoring and reporting requirements, and other permit conditions when

Worsley Companies, Inc. is requesting renewal of permit NCO065307 for the Dixie Boy
#6 WWTP in New Hanover County. TRC monitoring and limits were added to the
permit in accordance with the TRC policy. Since the facility is in Class SC waters,
Enterococci limits and monitoring were added to the permit, per EPA's promulgation of
the criteria in November 2004. No limits or monitoring for any other parameters in the
permit were changed. This facility has a package plant and a separate oil/water separator.
In past permit renewals, it was thought the effluent from these two units combined into
one outfall, but through the investigation of regional office staff, it has been determined
they do not combine into one outfall. Therefore, a separate outfall for the oil/water
separator has been added to the permit with monitoring for flow, TSS, Oil and Grease,
DO, Temperature, and pH. In accordance with the September 2006 Cape Fear Permitting
Strategy, the permit re -opener language was added to the permit.

Dear Ms. Rust:
Please accept this letter on behalf of our client, Worsley Companies, Inc. (WCI) to provide intortnation
regarding the oil/water separator at the site referenced above.
Although visual inspections of the oitlw-atcr separator were performed at the site, Environmental Services &
Solutions, PLLC (ESS) personnel were unable to properly identify the now path of water through the oil/water
separator or the. eventual outfall of the stnicture. On March 27, 2007 personnel with ESS and Southeast
Response and Remediation, Inc. performed additional activities to ascertain this information. All stormwaler
structures in the immediate area were pumped dry of liquids and smoke tests were perforned.
The results of these activities positively identified that surface water enters drop inlets around the perimeter of
the diesel dispensers and flows into the oil/water separator. Liquid enters the separator at the southern end,
closest to US Highway 117, and flows to the north. Liquid flows out the oil/water separator and into a
stormwater catch basin along US Highway 421. The attached diagram depicts these structures. Please note that
tests indicated that liquid is not entering or exiting the former pump tank identified on the attached drawing.

the paved area around the truckstop is routed through an oil/water separator and ties
into the WWTP effluent line.

PART IV - EVALUATION AND RECOMMENDATIONS
This facility is a gasoline service station primarily engaged in selling diesel, gasoline and
lubricating oils. No repair shop is located at this facility. A restaurant is located in the store
and provides shower rooms. The restaurant has a grease trap to reduce the amount of grease
to the WWTP. This facility has had chronic pH violations dating back to December 2002.
Please see attached NPDES Permit Violation Summary. The facility has problems with good
settling characteristics. The clarifier is about 13 ft deep with a short width from influent to
overflow weir. The overflow weir is uneven causing short circuiting. The sludge holding
basin is infrequently aerated, resulting in a poor quality supernatant being introduced to the
aeration basin. One blower provides air to the aeration basin as well as the sludge holding
basin. The ORC does not leave the air line open to the sludge holding basin continuously
since it results in low DO in the aeration basin. The sludge holding basin should be aerated
every day. The RAS line is adjusted manually. The valve should be replaced to allow better
control for RAS flow. The valve operates as though either fully open (which returns too
much on a continual basis) or returns too little when tightened toward the closed position.
ORC operates the valve fully open. Replacement of the RAS line valve would provide better
flow control resulting in better operational control. This package plant, when operated
properly can produce a fair effluent. Proper operation has been a problem. The plant suffers
from a low BOD in the influent.
The classification of the facility has not changed. It is still a Class II facility. The permit
limitations and monitoring requirements in the NPDES Permit should remain the same for
the upcoming permit cycle. A correction should be made to the receiving water subbasin
number from 03-06-17 to 03-06-23. The Wilmington Regional Office recommends
reissuance of the permit provided no significant adverse public comment is received. Please
reissue in accordance with the Cape Fear River Basinwide permitting strategy.

in Wilmington, North Carolina. It should be noted no changes have occurred at the facility since the issuance of the
last permit.
The sludge management plan for the facility includes stabilization and disposal of sludge from the facility and daily
inspections by the ORC. S&B Maintenance, Inc. is retained to stabilize and dispose of the sludge, while operating
under the Sludge Disposal Permit Number WQ0000783. Their facility is located at 3579 Lewis Loop Road SE in
Bolivia, North Carolina. The ORC also performs daily inspections and occasionally. identifies need to waste
Bio-Mass. The ORC maintains proper levels in the tank by scheduling solids removal as needed.

B Review of Facility
1) Facility Description
a) Dixie Boy #3 is located at 1610 US 421 New Hanover County NC. Dixie Boy #3 is a
Convenience Store facility, providing retail merchandise, refueling facilities for
cars and trucks, and a diner facility.
b) Wastewater facilities for the Domestic wastes include an on -site treatment facility
permitted for 0.004 MGD. Reports of the facility indicate the plant itself has a
rated operating capacity of 0.010 MGD. The plant is a PCl/Pollution Control Inc.
Plant, fabricated by Davis Water & Waste Industries Inc. of Thomasville Georgia.
c) Discharge is permitted to the Northeast Cape Fear River, via discharge point
number 01. Discharge point number 01 is a combination point location, for the
treatment .facility discharge, and a permitted oil/Stormwater separator discharge.
This confluence of piping occurs after the treatment plant. A 4-inch discharge
line conveys the combined sources easterly several hundred feet, to discharge
point number 01.
d) The current measured discharge rates are approximately 3,000 gallons per day.
The facility is permitted for a discharge rate of 0.004 MGD (4,000 gallons) .
e) The waste facility was permitted first in 1991 / 1992. This same plant is still
permitted, and in operation at this time.
f) Wastewater Treatment Plant currently complying. with requirements stated in the
permit, "Effluent Limitations and Monitoring Requirements", see Appendix C.
g) The site area is 3 acres of size, and is square in shape. Approximately 2 acres are
built -upon and 1 acre is delineated wetlands. The built -upon area is inclusive of
all the building, refueling canopies, parking, a truck weigh scale, and waste
treatment areas. The site is bordered on the south by US 117 and the west by US
421, on the east by the Northeast Cape Fear River, on the north by open,
delineated, wetlands. See attached Location Map in Appendices B.
h) Dixie Boy #3 water supply is an on -site permitted drilled well.
