Subject: Preconstruction Notification and request for Clean Water Act (CWA) §404 and 401
permits for a stream bank stabilization project. We are requesting that Nationwide
Permit 13 and General Certification 3885 be issued for this project on Junaluska Creek,
Andrews, North Carolina, Hiwassee River Basin — CU# 06020002, Cherokee County,,NC.
Dear Ms. Higgins:
Enclosed with this letter are four (4) copies of the Pre - Construction Notification, project site
maps, and other pertinent information that are being submitted for regulatory review. I have
also attached to the PCN a check for $240.00 to cover the application fee. We have also
submitted this information to the U.S. Army Corps of Engineers, U.S. Fish and Wildlife Service,
and N.C. Wildlife Resources Commission for their review. We are providing this information for
your department's consideration and comments relative to CWA §401 permitting.
This project involves stabilizing a short section of stream bank on Junaluska Creek. The bank is
eroding and threatens the developed area of a yard and residence at this property. The section
to be stabilized is less than 100 linear feet along the left bank, on the outside of a meander
bend. Junaluska Creek is designated as Class C, Tr waters by the Division of Water Quality and
we believe it supports wild trout, so the trout moratorium will be observed. The attached
stabilization detail indicates the methods that will be utilized to stabilize this bank with
boulders and vegetation. The work.area will be separated from flowing water using boulders
and plastic sheeting for the short time it will take to do this work. This package should provide
what is needed to evaluate this permit request and we are prepared to meet with you to
discuss the project further, if you so desire.
We believe that the proposed activities are necessary to address existing erosion problems and
should provide long -term stabilization to reduce sediment loss into Junaluska Creek and
damage to this property. In addition to making every effort to avoid impacting mature trees
on -site, we will be planting diverse native herbaceous and woody vegetation that should

provide further long -term bank stability. The results of this project will improve habitat at this
site for native aquatic species and will provide long -term water quality protection.

The Seay residence has a patio and the back of their house that are close to Junaluska Creek. This property is located along a bend in the stream.
According to this landowner the creek is eroding the stream bank and moving closer to their residence. This bank has some small shrubs and young
trees growing among scattered small rocks and a few boulders on the bank. The floodplain is a grassed yard.

Boulders are being used rather than smaller rock to provide for long -term stabilization and to provide better habitat. Boulders will only be placed along
that section of the bank where erosion is occurring.

An erosion control matting will be placed on the bank to control soil loss from beneath the boulders. Gaps will be left between boulders as shown on
the attached detail, so that trees can be planted to provide additional stabilization and shading of the creek. Boulders will only extend up to the
existing ground surface. Shrubbery (ex.: doghobble) will be planted at the top of the bank for the length of the boulders.

DWQ Water Quality Certifications - North Carolina requires fees for processing water quality certifications
and buffer permits.
Checks should be made out to the "NC Division of Water Quality ", with the specific name of the project or
applicant identified on the check. Please staple your check to the front of the application package.
The required fees are as follows:
Major water quality applications: Greater than or equal
to one acre of wetlands /waters AND /OR Greater than or
equal to 150 feet of streams (whether intermittent or $570.00
perennial)
Minor water quality applications: Less than one acre of
wetlands /waters AND Less than 150 feet of streams $240.00
(whether intermittent or perennial)

Note: If the project is sponsored by a federal agency, the DWQ requires the name of project printed on
the US Treasury check and the project application fee mailed to: NC DWQ, 401/ Wetlands Unit, 1650 Mail

Cores Permits - There is no fee for Nationwide or General Permits processed by the Corps of Engineers.
iv. WHERE TO SEND YOUR COMPLETED PCN FORM:
Copies of your completed PCN with all required attachments must be sent to the Corps of to DWQ, or
both agencies, depending on the approval sought. Additionally, review the specific reporting
requirements for your project as some conditions of approval require you to send a copy of your PCN to
coordinating agencies.
