The subject property is located at 3851 Hope Valley Road, Durham NC. Figure 1 and Figure 2 show the location of the site on a USGS topographic quadrangle and Durham County Soil Survey, respectively. EXECUTIVE SUMMARY Based on the field evaluation of the streams depicted on the most recent version of the US Geological survey's 7.5 Minute Quadrangle, NRCS Durham County soil survey or located in the field S&EC believes that two streams onsite are subject to the Durham Stream Buffers. The attached sketch map depicts the approximate location of the streams identified during our evaluation. Please refer to the sketch map and the results and recommendations section below for more detailed information. SCOPE OF WORK S&EC's Durham Stream Buffer Evaluation consisted of examining all features within the evaluated area that are shown on the most recent version of the US Geological survey's 7.5 Minute Quadrangle or NRCS Durham County soil survey, for applicability to the Durham Development Ordinance riparian buffer rule using NC-DWQ stream evaluation techniques. Features found in the field but not located on the Soil Survey or USGS Map were also evaluated for potential buffers. Figure 2 shows the location of the site on the relevant Durham County Soil Survey map. RESULTS&RECOMMENDATIONS The result of the Durham Stream Buffer Evaluation is discussed below. Stream Features: Surface waters on this site flow into the Third Fork Creek in the Cape Fear River Basin, which has been classified in NC-DWQ's "Classification and Water Quality Standards Applicable to Surface Waters and Wetlands of North Carolina" as WS-V:NSW. County/City of Durham Buffers: The surface waters potentially subject to the Durham Buffers includes Feature A, B, C, and D. No other surface waters onsite are believed to be considered intermittent or perennial. The project is located within the F/J-B Durham Watershed Overlay. July 29,2022 S&EC Project#: 15300.W1 Page 2 of 3 Feature A (Third Fork Creek) is depicted on the Durham County Soil Survey and USGS. Based on the field evaluation, feature A is perennial stream along the eastern property boundary. This feature was not scored as it was located off property. It's buffer does however encroach the eastern property boundary. S&EC believes that Feature A should be considered a buffered stream. Feature B is depicted on the soil survey and USGS. Feature B begins off property and is considered an intermittent stream until flag SO At SF 1,just above flag SO I, the feature scored 20.5. Because the DWQ's Stream Identification Form, Version 4.11 used in this evaluation requires a 19 or greater to be considered intermittent(buffered), S&EC believes that Feature B will likely be subject at this point. Below flag SO I, at S172, the feature scored 14.5. Feature C is located on the soil survey. This feature appears to just a small swale in the landscape, therefore it was not considered a scorable feature. Because the DWQ's Stream Identification Form, Version 4.11 used in this evaluation requires a 19 or greater to be considered intermittent, S&EC believes that Feature C should not be considered a buffered stream. Feature D is not located on either the soil survey or USGS. This feature scores 30 at SF 3. Because the DWQ's Stream Identification Form, Version 4.11 used in this evaluation requires a 19 or greater to be considered intermittent, S&EC believes that Feature D should be considered a buffered stream. Please note that NCDWQ Stream Evaluation form Version 4.11 was used to describe the features onsite. Refer to the attached sketch map for locations of photos, stream forms and flag numbers. The City of Durham will need to conduct a site visit and confirm the above findings for them to be valid. Please have the property owner or contracting buyer complete the attached agent authorization form if you would like S&EC to act on their behalf for requesting approval of the wetland delineation. This form will also be used in preparing a permit application for impacts to wetlands or surface waters when we are provided with a plan showing the proposed impacts. S&EC cannot conduct correspondence with the USACE unless we have agent authorization (see attached Agent Authorization). This authorization form must be filled out in its entirety and returned to S&EC (a faxed copy is acceptable). July 29,2022 S&EC Project#: 15300.W1 Page 3 of 3 Regulations A summary of the Durham Stream Buffer regulations is below. Please be aware that other local, state, and federal regulations also apply to this site but are not outlined in this report. S&EC personnel are available to discuss these regulations as they apply to your project. Durham Stream Buffer Rules Durham's stream buffer protection standards include the establishment of a minimum of a 50- foot riparian buffer on intermittent streams, perennial streams, and naturally occurring ponds and lakes. Intermittent and perennial streams are defined as those shown on the most recent versions of the 7.5-minute USGS topographic quadrangle or the US Department of Agriculture Soil Survey maps. Relief from the buffer requirements in the Cape Fear River Basin may be allowed by the City Public Works Director, County Engineer, or designees, as appropriate pursuant to the applicable City or County standards. Relief from the buffer requirements in the Neuse River Basin may be allowed when surface waters are not present in accordance with the provisions of the Neuse Buffer Rules (15A NCACO2B.0233(3)(a) as administered by the NC Division of Water Quality. CONCLUSION The Hope Valley Road Property evaluated by S&EC on July 7, 2022 contains features that are believed to be either intermittent or perennial and are therefore potentially subject to the Durham Stream Buffers. Based on a field evaluation of these features, S&EC believes that Features A, B, and D are subject to the Durham Buffer rules at their respective start points. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding, and citizen science datasets and is queried and filtered to return a list of those birds reported as occurring in the 10km grid cell(s)which your project intersects, and that have been identified as warranting special attention because they are a BCC species in that area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to offshore activities or development. Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds that may occur in your project area. How do I know if a bird is breeding,wintering or migrating in my area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the profiles provided for each bird in your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA(including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 05/22/2023 6 2. 'BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non-BCC -Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or(for non-eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s)that overlap your project; not your exact project footprint.
