TaTw SECRETARY SUBJECT: Bridge #79 Replacement on SR 1328 (Kirby Lackey Road), Alexander County Dear Mr. Kichefski: The North Cuolina Deparhnent of Transportation requests authorization to replace a deteriorating bridge on SR 1328 (Kirby Lackey Road) in Alexander County. NCDOT proposes to replace the existing bridge with a 130-foot long, 28 foot wide three span bridge. Riprap will be urilized under the bridge; however, none is proposed below average high water. No impacts to the main tributary of Grassy Creek aze anticipated. Due to the new bridge construction and new roadway fill, a total of 122 feet of an adjacent roadside jwisdictional ditch must be relocated approximately 15 feet east of the e�sting channel. NCDOT proposes to construct the new channel in the dry, mimicking the "dimension, pattern, and profile" of the euisting channel. The relocated channel length will be 130 feet and will be stabilized with coir fiber matting; therefore is considered on-site mitigation for the fill of the 122 feet of existing jurisdictional roadside ditch. There will be minor temporary impacts when reconnecting the upstream section of channel, to the newly constructed channel. The total scope of the project work will result in 130 feet of stream relocation impacts to an unnamed tributary to Grassy Creek, which is classified as Class C waters by the N.C. Division of Water Resources. The project is not located within'/� mile of any criticai watershed azea nor is SR 1328 a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project for historical sites and threatened/endangered specias sites. No sites listed on the Nafional Register of Aistoric Places are located in the vicinity of the project nor did thera appear to be any eligible structures The federally listed species for Iredell County (USFWS listed dated Apxil 2, 2015) include the Dwazf-flowered Heartleaf (Hexastylis nan�ora)- Threatened, Northern Long Eared Bat (Myotis septentrionadis)-Threatened, and the Bog Turtle (Clemmys muhlenbergie)- T/SA, Threatened due to Similazity of Appeazance. Natural Heritage Program records document the nearest Dwarf- flowered Heartleaf location appro�cimately 17.2 east of the proposed project azea. The heartleaf is usually found in acidic soils along bluffs and adjacent slopes, in boggy areas next to streams and creek heads, and along the slopes of neazby hillsides and ravines. The project azea is a roadway and powerline ROW and adjacent wooded and pasture areas. There is little potential habitat within the proposed project area and no species were obseroed during the site visit. No impact on this species is anticipated. SR 1328, Kirby Lackey Road Page 2 June 15, 2015 Natural Heritage Program records document the nearest Northern Long Eued Bat locafion appro�dmately 20 miles northwest of the proposed project area. During summer, northern long- eared bats roost singly ar in colonies underneath bazk, in cavifies, or in crevices of both live and dead trees. They may also roost in cooler places, like caves and mines. Tree species may be used based on suitability to retain bazk or provide cavities or crevices. It has also been found, rarely, roosting in siruchves like barns and sheds. Northem long-eared bats spend winter hibernating in humid caves and mines. Bridge #79 was assessed for suitable bat habitat and the assessment form was submitted to the U.S. Fish and Wildlife Service, Asheville Field Office. The bridge did not contain suitable habitat nor was any bat evidence found. No suitable roosting trees will be impacted by the proposed project and the closest known underground mine location — Dagenhart mine (per NHP database) is 6.5 miles southeast of the project area. Natural Heritage program records document the nearest bog turtle location approximately 7.4 miles east of the proposed project area. Bog turtles are Typically found in bogs, mazshes, and wet pastures. There is no suitable habitat located within the project footprint. T/SA species are not subject to Section 7 consultation; however, no impact on this species is anticipated. Describe the overall project in detail, including the type of equipment to be used: The North Carolina Department of Transportation proposes to replace a deteriorating 3-spa� bridge with a 130-foot long x 30-foot wide 3-span bridge on SR 1328 (Kirby Lackey Road) in Alexander County. Due to the increase in road fill for the new bridge and close vicinity of the small unnamed tributary to Grassy Creek in the SE quadrant, new construction will require a minor shift in alignment of an unnamed tributary to Grassy Creek (see attached cross-sections, Permit XPL file, of the minor alignment shift). There will be - 122-feet of fill and -130-feet of new channel will be constructed using natural stream design and be coir-f ber matted for stabiliza[ion. A temporary cofferdam pumping system will be used to diveA the stream around the construction site as needed. Area affected by temporary cofferdam system will be restored to pre-project conditions. All Best Management Practices will be utilized during the course of the project. The Project will be constructed using typical heavy equipment (trackhoe, backhoe, etc.) 4. SIGNIFICANT NEXUS DETERMINATION A signi�cant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity of a TNW.
