Sharon Amity Road #411, Charlotte, North Carolina 28211 Summary of Findings Atlas Environmental Inc. staff conducted a pedestrian survey of the project review area for two Mecklenburg County parcels and three Union County parcels totaling approximately 3.49 acres. The project is generally located Southeast of Independence Commerce Drive and Northeast of E Independence Blvd and Stallings Commerce Drive in Mathews, NC 28105. During the field evaluations on March 14, 2023 Atlas staff did not observe any Waters of the U.S. in the review area. Atlas staff did not observe any state isolated features. Stream and Wetland Delineation Introduction At the request of Nick Dillon-Stout of The Plant Guys, on March 14, 2023 staff from Atlas Environmental, Inc. (Atlas) performed a detailed pedestrian survey of the review area to complete a stream, wetland, and open water delineation. During the delineation, Atlas staff identified no features subject to Federal and State regulation and approximated the location of the features using professional-grade GPS units. Streams are generally classified by duration of flow in a typical year as perennial, intermittent, or ephemeral. Typically, perennial streams are characterized by flow all year while intermittent streams flow at least three consecutive months of the year. Ephemeral streams only flow as a response to storm events and may be regulated by the United States Army Corps of Engineers (USACE). Typically, ephemeral features are not regulated by the North Carolina Division of Water Resources (NC DWR). Wetlands are identified based on a variety of physical, chemical, and biological indicators. To meet the definition of a wetland the area must satisfy specific criteria relating to hydrology, soils, and vegetation. Aquatic resources such as streams, impoundments of streams, and abutting wetlands are subject to regulation by Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899 as Waters of the United States (WOTUS) and are under jurisdiction of the USACE. Isolated and non-USACE jurisdictional features such as non-abutting wetlands and streams which do not provide surface flow to navigable waters may be subject to regulation under Section 401 of the Clean Water Act. These State Waters are under the jurisdiction of the NC DWR wetlands and waters rules. Surface Waters (Streams and Rivers) The field delineation of assessed jurisdictional stream features was conducted utilizing current methodologies which are consistent with those outlined in the 1987 US Army Corps Wetland Delineation Manual, the Regional Supplement of the Corps of Engineers Wetland Delineation Manual: Eastern Mountains and Piedmont Region (Version 2.0), April 2012, post Rapanos Supreme Court decision guidance (2007), and other Regulatory Guidance Letters provided by the USACE. The latest NC DWR Methodology for Identification of Intermittent and Perennial Streams and NC DWR Isolated Wetlands and Waters Rules was used to classify stream types based on flow regime. Evaluations and assessments regarding jurisdictional limits, permitting requirements and allowances, mitigation ratios and plans, Section 7 consultation (protected species), and Section 106 consultation (historic and archaeological resources) made by consultants are subject to verification by the USACE, NC DWR, and other appropriate state and local regulatory authorities. Potential jurisdictional streams on site were evaluated based upon criteria outlined in the resources mentioned above. This includes assessment with regards to the geomorphology, hydrology, and aquatic biology of each feature. Typical indicators are presence of an “ordinary highwater mark” including sediment sorting, evidence of flow, absence of vegetation; presence of macro benthos; aquatic wildlife; and other physical indicators. Sharon Amity Road #411, Charlotte, North Carolina 28211 Upon review of the existing site conditions, Atlas has assessed that there are no USACE or State jurisdictional streams within the review area. Wetlands and Isolated Wetlands Potential wetland areas on the site were evaluated for the presence of hydric soils, evidence of wetland hydrology, and hydrophytic vegetation. Evidence of hydric soils may include reduced matrix, redoximorphic features, and/or other indicators. Evidence of hydrology may include water borne deposits, drift lines, scour marks, the presence of crayfish borrows, redoximorphic concretions, or regional indicators of soil saturation. Hydrophytic vegetation can range from facultative, including species which grow in uplands and wetlands, to obligate plant species which almost always grow in wetlands. Upon review of the existing site conditions, Atlas has assessed that there are no USACE or State jurisdictional wetlands within the review area. Open Waters (Lakes, Ponds, and Coastal Waters) Impoundments of jurisdictional waters are also jurisdictional under the Clean Water Act regulations. Open waters that have been excavated entirely in high ground are not USACE jurisdictional. Open waters that are not USACE jurisdictional may be captured by NC DWR’s Waters of the State rules. Upon review of the existing site conditions, Atlas has assessed that there are no USACE or State jurisdictional impoundments observed within the review area during the site evaluations. Public Sourced Natural Resource Mapping The resource maps are included in the figures section of this report. These maps were generated from publicly sourced GIS layers. Delineation Findings Summary In summary, Atlas assessed that there are no USACE/State jurisdictional streams within the review area. Atlas assessed that there are no wetlands, no open waters, and no isolated aquatic resources within the review area. Atlas can obtain written concurrence of the findings from the USACE/State. Permitting Summary No USACE or State Water Quality permit will be necessary for the development of this project. Recommendations No further Clean Water Act related environmental services are necessary. Conclusion This concludes our project review and report of findings for the stream and wetland delineation.
