PROJECT DESCRIPTION Bald Head Island is part of an island group known as Smith Island, located east of the mouth of the Cape Fear River, between Fort Fisher to the north and the Atlantic Ocean to the south with Oak Island/Caswell Beach to the west. The island is accessed by private boat or private ferry service from Southport. The project site is located on Palmetto Cove Court, within the Village of Bald Head Island, in Brunswick County. To find the site from the ferry landing, follow N. Bald Head Wynd Road, which turns into Federal Road a total distance of approximately 1.7 miles to Palmetto Cove Court. Turn left on Palmetto Cove Court and the bridge will be located directly ahead. The project area consists of an existing roadway with an elevated wooden bridge over wetlands which serves as one of two access points to the homes along the horseshoe shaped Palmetto Cove Court connecting to Federal Road. The existing bridge spans an area of 404 wetlands and coastal wetland vegetation that is only occasionally inundated on higher than average tides. Therefore, the bridge currently falls within the Coastal Wetland Area of Environmental Concern (AEC), but not the Estuarine Waters/Public Trust or Coastal Shoreline AECs. Wetland vegetation under and adjacent to the bridge consists primarily of Salt Meadow Hay (Spartina patens), Groundelbush (Baccharis halimifolia), Spikegrass (Distichlis spicata), Marsh -elder (Iva frutescens) and Glasswort (Salicornia_,spp ). Vegetation under the bridge is sparse due to the bridge's low elevation and existing shading impacts. The road is currently maintained by the Association, but the Village of Bald Head Island will be taking over control of the roadway after the completion of the project. The waters of Bald Head Creek are classified SA by the North Carolina Division of Water Resources. The area is designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to replace the existing wooden bridge with a causeway /road and three culverts within the existing right -of -way. The roadway would measure 16' wide and would be stabilized with retaining walls, each measuring 105' in length. The two retaining walls would measure 5' above existing grade and would extend approximately 12' below grade. Three 16' long culverts, each with a 30" diameter are proposed to connect the wetland areas -on either side of the bridge. The bottom of the culverts would be buried 6" below grade. A proposed 5' temporary impact area is proposed on both sides the causeway and a 4" sewer line would also be trenched in on the south side of the causeway within the temporary impact buffer area. The application states the current bridge is unable to support fire and EMS vehicles and the causeway is needed to support emergency vehicle access. ANTICIPA'T'ED IMPACTS: The project would result in the filling of approximately 307 square feet of coastal wetlands and 152 square feet of §404 wetlands. The proposed culverts will allow for continued flooding of the wetlands on the upland side of the bridge. It is therefore not anticipated that the project would result in significant adverse impacts to these wetlands outside of the project area, although hydrology to the area may be impacted to some extent. Construction would also result in temporary impacts to an additional 203 square feet of coastal wetlands and 107 square feet of §404 wetlands as a result of construction. (SEGi) has been retained by Village of Bald Head Island Stage Two Association (herein referred to as the "Applicant "), in conjunction with The Village of Bald Head Island ( "Co- Applicant "), to submit the attached permit application (Attachment 1) for a Coastal Area Management Act Major Permit, which is necessary to perform work located within The Village of Bald Head Island, Brunswick County, North Carolina. The site does not have a physical address. Site Information and )History: Bald Head Island was developed in the 1990's as a private, secluded residential subdivision. The NC Division of Water Quality Stormwater Unit (now under the Division of Energy, _Minerals, and Land Resources) issued low density stormwater permit SW950216, which serves the Palmetto Cove area of The Village of Bald Head Island. On July 29, 2014, SEGi along with Coastal Land Design met with the agencies to evaluate the site. At that time, the DCM flagged the coastal wetland line, which was surveyed and included on the site plan. SEGi later delineated the Section 404 wetlands and submitted the Rapanos forms to Tyler Crumbley, at the US Army Corps of Engineers. In speaking with Mr. Crumbley, it was suggested that SEGi submit the CAMA Major Application without a final Jurisdictional Determination being issued. This site is located within the AE flood zone and the Coastal Wetland Area of Environmental Concern (AEC). Normal high water is located approximately 739 linear feet northwest of the project site. Based on the fact that the proposed work will not disturb more than 1 acre, a Sediment and Erosion Control permit is not required. Proposed Work: The proposed work is necessary to facilitate the replacement of a timber bridge with an earthen causeway that will support fire and EMS vehicle loads. This is requirement of the Village of Bald Head Island, as the municipality will be taking ownership of Palmetto Cove Court. Currently, access across the wetland is provided by a timber bridge. This structure is not sufficient to support fire and EMS vehicle loads. In order to complete the construction of the causeway, approximately 152 square feet (0.003 acre) of Section 404 wetlands and 307 square feet (0.007 acre) of coastal wetlands will need to be permanently filled. The temporary impact areas are being proposed as a construction buffer, as well as where the existing sewer line will be relocated. Relocating the sewer line will consist of excavating a trench approximately 12" wide and 12" to 16" below existing grade, installing the utility, and returning the area to its original grade and contour. Silt fence will be installed, along the temporary limits of disturbance /construction buffer, to ensure crews do not work outside the permitted area. Work will be performed in the dry. Details of the proposed work are illustrated within Appendix I, of the CAMA Major Permit Application. In an effort to minimize impacts to the wetlands, the Applicant has chosen to incorporate retaining walls into the development plan. The proposed retaining walls are approximately 105' long, including wing walls, 5' high, measured from existing existing grade, and will extend approximately 12" below existing grade. While the Applicant has not determined the type of wall to be installed (i.e. sheet pile, concrete, wood, etc.), some excavation will be necessary but will be performed within the 5' construction buffer. In conjunction with the Applicant's willingness to expend additional funds to reduce impacts to the greatest extent possible, that the impact to wetlands is minimal (i.e. less than 1 /10ffi acre), as well as the fact that the impact area is shaded by the existing bridge, thus the loss of chemical, physical, and biological processes is anticipated to be insignificant. With that being said, the Applicant is not proposing mitigation for the impacts. SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative. CAMA Major Permit Process: As part of the CAMA Major Permit process, the Applicant has notified the adjacent riparian property owners, by US Postal Service certified mail. This information has been included as part of the permit application and accompanying appendices. Also, a $400.00 filing fee is required, which has been included with this correspondence as Attachment 2. It SEGi's hope that the information found within and attached to this letter will be sufficient for the DCM to consider the application complete and the permit will be processed without delay.
