Dear Mr. Briggs:
Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
At the time of issuance of this permit, the wastewater treatment facility has not been operated for a considerable period.
Prior to re -operation of the treatment system, the permittee [or, if the treatment plant is part of a sale of property, the new
pemutteel, shall submit to the Division a wastewater management plan. (Refer to A. (2).)
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the tight to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This
request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714).
Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require modification
or revocation and re -issuance of the permit. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be required.

A. (2.) WASTEWATER MANAGEMENT PLAN
At the time of issuance of this permit, the wastewater treatment facility has not been operated for a considerable
period. Prior to re -operation of the treatment system, the pemrittee for, if the treatment plant is part of a sale
of property, the new pernnttee], shall submit to the Division a wastewater management plan. The plan shall
include, at a minimum, the following elements:
• Alternatives analysis. Conduct a technical and economic evaluation of wastewater disposal
alternatives, specifically including at least the following alternatives:
• connection to a regional wastewater collection system
• conversion to a spray irrigation system
• implementation of a reuse program
• any combination of the above options
The analysis and report should be consistent with the Division of Water Quality's EAA
guidance document.
• Evaluation of functionality of treatment plant. The pernrittee shall provide certification
from a North Carolina Professional Engineer that the existing treatment plant may be
operational and will be able to comply with the limits in the existing permit. If the treatment
plant is not operational with the existing equipment, an engineer must provide a facilities
assessment and optimization plan as described below.
• Facilities assessment. Describe deficiencies and operational difficulties in the existing
treatment systems which affect performance or permit compliance. Identify potential
improvements to correct those deficiencies. At a minimum, evaluate the following
considerations:
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris
• Optimization plan. Develop a plan for optimization, rehabilitation, expansion and/or
replacement of the treatment systems to achieve optimum performance. Identify specific
measures and key tasks, including those in the above facilities assessment, and provide an
estimated schedule for completion of each.
• Biosolids management plan. Develop an operations plan to be used (and describe the
procedures currently used) for managing septage / biomass in the treatment system,
including associated solids wasting and disposal, to promote optimum treatment system
performance. Identify operating parameters to be used and target values or ranges of values
where appropriate.

I'm not sure who Mr. Haynes is , but I'll reply anyway. This plant is in
the ground and has been for maybe ten years. It is in such bad condition,
that a great deal of renovating would need to be done in order for it to
operate properly. I would like for the permit not to be reissued, but I
don't know if we can do that. If we have to renew it, there needs to be
some language about improving the current condition of the facility.

I'll have to research Dogwood. I know I talked to them last Permit
renewal and they wanted to keep the permit. If I remember correctly,
there was a big uproar when they got the permit and I suppose they wanted
to keep it because of that. I'll call them sometime!

Charles I offer the following comments:
Town of Clyde NCO021741 is scheduled to connect to the Town of
Waynesville by mid summer if not before. If we have to issue, we need
to have stipulation about connecting.
Autumn Care NCO032361 has ceased discharge. I don't think we should

renew the permit for them to hold.
Hemlock Villas NCO048143 should be connected to Maggie Valley soon.

Dogwood Trails NCO065986 has never been operated even though there is a

WWTP in the ground. What should we do?

Ammons Restaurant has been connected for about a year. No need to
renew. The permit should have been rescinded.
Woodland Village has connected to the Town of Maggie Valley and the

permit should have been rescinded.
Country Club Real Estate NCO074063 has recently requested Rescission as
the project was not built!

recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the Environmental
Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a fine not to exceed $10,000, or by
