The Division acknowledges your request (June 5, 2001) for additional time to comply with monitoring (see Effluent TRC Monitoring below). Ashe Plantation Wastewater Treatment Plant (WWTP) discharges into Duck Creek, a Class C stream tributary to Goose Creek within the Yadkin -Pee Dee River Basin. Please note that Goose Creek has been formally designated as an "impaired stream," listed in the Division's 2000 303(d) list as "a biologically impaired waterbody" based on documented adverse impact to stream organisms. General and specific factors causing impairment include: • Treated wastewater discharged to the watershed • Runoff from agricultural activities • Suburban development • Excessive instream fecal coliform concentrations. • Slow flow and poor dilution due to water extracted for irrigation • Low dissolved oxygen Moreover, this drainage is considered environmentally sensitive due to the presence of a federally endangered, and therefore protected, freshwater mussel, the Carolina heelsplitter (Lasmigona decorata). The Division is charged by state and federal law to restore Goose Creek to its intended uses and has, therefore, implemented stricter limits and monitoring requirements. The Goose Creek NPDES Permitting Strategy applies to all dischargers within this watershed including those on Duck Creek and Stevens Creek. The long-range goal of the strategy is to remove all small dischargers in the Goose Creek watershed by connecting these wastewaters to a proposed regional treatment facility, in the higher interest of restoring and preserving the environment and surface water quality. The permittee shall begin monitoring the receiving stream weekly for NH3 as N and for TRC during the summer season (April 1 through October 31). However, the permittee is no longer required to measure or report instream conductivity. Effluent TRC Monitoring. Total Residual Chlorine (TRC) monitoring shall continue, but will now be limited to 17 µg/L, Daily Maximum. Considering your request (June 5, 2001) for additional time and the need for an Authorization to Construct new facilities, compliance with this limit shall begin coincident with summer sampling on April 1, 2002. Although the other parameters and monitoring requirements remain unchanged, please notice that the Division has resorted the table under Effluent Limitations and Monitoring Requirements by "Sample Location" to facilitate operator use. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please notice that this permit is not transferable except after notifying the Division of Water Quality. The Division may require modification, or revocation and re -issuance of this permit. (Heater) in Mecklenburg County that discharge into tributaries of Goose Creek. Both permits require a new chlorine limit effective January 1, 2002, with summertime weekly stream monitoring for ammonia nitrogen and chlorine. Heater appreciates the environmental sensitivity of the stream and the endangered Carolina heelsplitter as well as the desire for a chlorine limit on Heater's discharge. It is likely that in order to comply Heater will install UV lights for disinfection rather than dechlorination. In either event, this will involve a significant expenditure, which will need to be budgeted for the calendar year 2002. Considering this budgeting requirement, the engineering, authorization to construct and actual construction time, Heater will need at least until October 2002 to complete the constructign and place the improvements into service. The stream testing parameters and frequencies will cause significant added expense to these wastewater operations and appear to be excessive given the level of effluent testing. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat, 401, as amended; 16 U.S.C. 661-667d), mid North Carolina General Statutes (G.S. 113-131 et seq.). Heater Utilities, Inc has submitted a request for a permit renewal for the Ashe Plantation Wastewater Treatment Plant (WWTP) to discharge treated wastewater into Duck Creek a tributary of Goose Creek in the Yadkin -Pee Dee River Basin, We appreciate the efforts to improve water quality in Goose Creek. The implementation of effluent limit reductions and monitoring requirements to renewal permits and disallowing now or expanding wastewater discharges should go along way in protecting this important resource. However, we are concerned with the chlorine effluent, averaging over 1000 µg/L after July 1999. Chlorine is acutely toxic to aquatic organisms and forms secondary compounds that are also detrimental to aquatic life. We recommend that the following conditions be incorporated into the permit to reduce impacts to tish and wildlife resources and in particular to listed species. (herein referred to as Heater or the permittee) requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose treated wastewater to the surface waters of the state. The permittee has applied to the Division of Water Quality (the Division) for an NPDES permit for the existing Ashe Plantation Wastewater Treatment Plant (WWTP). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and conditions. This document also contains references to information sources relevant to this permit renewal (superscripted numbers in order of appearance, See References). FACILITY RECORDS REVIEW Facility Description. Heater acquired the Ashe Plantation WWTP (Table 1) from Mid -South Water Systems, Inc. (Change of Ownership received June 22, 1999). This facility services a residential subdivision, therefore the waste stream is wholly domestic.[ The existing treatment system consists of an influent lift station, bar screen, equalization basin, aeration basin, a rectangular clarifier, tertiary filter, chlorine contact chamber (with tablet chlorination), post aeration, continuous -recording flow measuring device, filter backwash tank, and an aerobic sludge digester. The previous permit became effective November 1, 1994 and expired on October 31, 1999.2 Permit renewal was delayed in part by impaired -stream data analyses and subsequent development of the Goose Creek NPDES Permitting Guidance document. Waste Load Allocation (WLA). The Division prepared a WLA in October 1991 and developed effluent limits and monitoring requirements.' The Division judges these limits and monitoring requirements to be appropriate for this renewal with the exception of the additions and deletions listed below (see PERMITTING APPROACH SUMMARY). Existing Stream Conditions. The Division verified that this facility discharges to Duck Creek, a Class C stream, tributary to Goose Creek within the Yadkin -Pee Dee River Basin. Impaired stream conditions have mandated subbasin-specific permitting guidance for Goose Creek and its tributaries.$ Although Duck Creek is currently listed as "not evaluated" (NE), Goose Creek is 303(d) listed as impaired or "not supporting" (NS) due to "biological impairment based on benthic macroinvertebrate data," and because of "excessive instream fecal coliform concentrations." Goose Creek is also acknowledged as environmentally sensitive due to the presence of a federally endangered freshwater mussel, the Carolina heelsplitter (Lasmigona decorata).6 COMPLIANCE REVIEW AND FACILITY INSPECTION Notices of Violation/Notices of Deficiency (NOVs/NODs). The Mooresville Regional Office (MRO) inspected the facility in August of 1999 and rated it "unsatisfactory" in the category of Effluent/Receiving Waters (bio-solids observed in the streambed below the outfall). In the category of Self -Monitoring Program, the permittee also recorded three permit violations of BOD limits in April 1999 — one Monthly Average and two Daily Maximums. There were no NOVs or NODS issued in year 2000. Whole Effluent Toxicity (WET) Test. This facility does not conduct Whole Effluent Toxicity (WET) testing. Discharge Monitoring Reports (DMR) -- Effluent Flow Data Review. The Division reviewed 24 months of DMRs (1999 through 2000). Reports appear generally thorough and complete. Actual discharge flow averaged 0.036 MGD (1999), and 0.034 MGD (2000) suggesting an average discharge at approximately 35% permitted capacity.9 Ammonia (NH3 as N), and BOD. BOD levels were generally reported <2.0 mg/L during years 1999 and 2000. Limits were exceeded only in April of 1999 when two Daily Maximums of 13.5 mg/L BOD and 32 mg/L BOD were reported, and the average, 10.4 mg/L, exceeded the Monthly Average of 7.5 mg/L (see NOVs above). The majority of effluent ammonia data are reported between <0.5 mg/L and 2 mg/L with the highest single week reported as 1.60 mg/L in November 1999. Effluent Total Residual Chlorine (TRC). Concerning TRC, this permit currently does not include a chlorine limit. Prior to July 1999 2/weekly TRC concentrations averaged about 240 µg/L. However, after July 1999, effluent concentrations averaged over 1000 µg/L9 suggesting that it is unlikely that this facility can comply with the draft TRC limit of 24 µg/L without de -chlorinating or employing other means of disinfection. A compliance schedule for an Authorization to Construct and construction of new facilities will be included in the permit. Fact Sheet Renewal -- NPDIS NC0065749 Pai=c Instream Monitoring. The Division reviewed dissolved oxygen (DO) and temperature data reported in DMRs. DO data appear seasonally appropriate and above minimum levels. The permittee reported fecal coliform bacteria counts averaging less than 200 colonies per 100 milliliters both upstream and downstream. Atypical instream maximums reported as >1,620 colonies per 100 milliliters (upstream) and >1,860 colonies per 100 milliliters (downstream) are roughly 100 times higher that levels reported in the effluent. This facility discharges into a stream having a 7Q10/30Q2 flow of "0" cfs. This facility should be required to cease discharge once an alternative becomes available. It should also be pointed out that operational noise from this facility has generated a significant amount of noise complaints from nearby residents. As a result, this Office requested Mid -South (prior to June 17, 1999) and now Heater Utilities to identify and address the problem. The facility was last inspected on October 21, 1998 by Mr. Steve Jadlocki of MCDEP. PERMIT: The current permit properly describes the facility and appears adequate for the waste stream being treated. Permit effluent limits appear adequate to protect the receiving stream and the stream's designated classification/uses. The Operator in Responsible Charge (ORC) visits the facility daily. The ORC maintains a North Carolina Operators Certification Grade III, which is acceptable for the class of the facility. RATING: Satisfactory FACILITY SITE REVIEW: The 0.100 MGD permitted facility consists of a package extended aeration wastewater treatment plant with an influent lift station, bar screen, equalization basin, aeration basin, rectangular clarifier, tertiary filter unit, effluent tablet chlorination, chlorine contact basin, post aeration, effluent continuous recording flow measurement, filter backwash holding tank, and aerobic sludge digester. The facility discharges to Duck Creek, which is a Class C water in the Yadkin -Pee Dee River Basin. All of the existing components of the facility were in service and appeared to be operating properly at the time of the inspection. The inspector was informed that the facility had been off-line for approximately ten (10) hours on August 1 and 2, 1999, due to a power failure which occurred during an electrical thunderstorm. The reports indicate that the facility was in compliance with permit effluent limits and monitoring frequency requirements during the review period, except for the following: 1. One (1) Ammonia Nitrogen (NH3 N) exceedance in violation of the monthly average permit effluent limit was noted. This occurred during the month of June 1998.
