Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Pratection Agency dated October 15, 2007 (or as subsequently an n&d). Following public notice of the dralapeurtit, the Division received comments from the U.S. Fish and Wildlife Service (USFWS) and the North CarrAi na Wildlife Resources Commission (NCWRC) regarding the discharge and its potential effects on water quality ,+n .Duck Creek, especially as it pertains to the viability of habitat for the Carolina heelsplitter (I.as=4?ona decorata), federally designated as a endangered freshwater mussel, and other protected species tic are known to be present in the Goose Creek watershed. Additionally, during this same time period', the North Carolina Environmental Management Commission had taken unto its consideration rules establishing a water quality management plan for the Goose Creek watershed. The Division considered the USFWS and NCWRC comments and applied the terms of the Goose Creek rules (15A NCAC 02B .0601 - .0609) before finalizing the content of the permit to be reissued. While the final permit does differ from the original draft, it contains one significant change from the updated draft permit sent to you in a February 25, 2011 e-mail (from John Hennessy, supervisor of the Division's Compliance & Expedited Permitting Unit). In the final permit, language has been added to Section & (2), the Ammonia Toxicity Reopener condition, that states the permit may also be opened to address matters involving nutrient levels in the Goose Creek watershed. Stream sampling studies have indicated the watershed may experience elevated nutrient concentrations at times. Roberts NC0065749 Permit Renewal p2 Please be aware that this permit reduces the monthly average effluent limit for ammonia nitrogen to 0.5 mg/L throughout the year. The daily maximum effluent limit for ammonia nitrogen has been reduced to 2.90 mg/L during the summer months (April — October) and to 7.15 mg/L during the winter months (November — March). Please also note that Duck Creek is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. This means that the stream does not meet all water quality standards. Addressing impaired waters is a high priority for the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. PERMIT REOPENER: AMMONIA TOXICITY & NUTRIENTS This permit may be reopened to impose further controls or restrictions upon the discharge of ammonia and other nutrients to the receiving stream. Endangered species in the Goose Creek watershed exhibit a high degree of sensitivity to ammonia. Permit modification may be required in order to ensure viable aquatic habitat with regard to instream ammonia concentrations. Studies conducted within the Goose Creek watershed demonstrate episodic events of elevated concentrations of nutrients (nitrogen and phosphorous). High concentrations of nutrients have the potential create conditions detrimental to overall water quality and the health of aquatic life. Permit modification may be required to include monitoring that will help ascertain the impact of the discharge with respect to instream concentrations of nutrients and to require controls on effluent nutrient concentrations should the discharge be found to be a significant contributor to elevated nutrient levels within the receiving stream. . Sent: Thursday, March 17, 2011 3:08 PM To: Sledge, Bob Subject: NPDES Permits for Goose Creek Bob, Thank you for talking with me and answering my questions regarding the NPDES draft permits for Country Woods, Oxford Glen, and Ashe Plantation. Below are the couple of comments I indicated I would send to you. The Technical Support Document (TSD) for the Goose Creek Watershed Site -Specific Management Plan developed by the U.S. Fish and Wildlife Service, N.C. Wildlife Resources Commission, and N.C. Natural Heritage Program recommends an acute water quality standard of 1.75 mg/L total ammonia as N. The draft permits have daily maximum limits for ammonia of 2.9 mg/L (summer) and 7.15 mg/L (winter). 1 understand these daily maximums are derived from EPA's recent guidance on ammonia, but we are concerned these exceed those recommended in the TSD. I am not sure exactly how the 1.75 mg/L included in the TSD was derived and whether it is temperature dependent, but Tom Augspurger with USFWS probably could provide those details. We recognize there are no water quality standards for copper or nutrients as recommended in the TSD, or for endocrine disrupting compounds (EDC), and therefore will not be included in the permits. However, each of the permits includes a re -opener for ammonia, would it be possible to include a re -opener clause for copper, nutrients or EDC stating if water quality standards are implemented then the permit can be re -opened and the new standards applied rather than waiting until permit renewal? As I discussed on the phone, the DWQ is preparing to issue NPDES permit renewals for the referenced WWTPs below located in the Goose Creek watershed: NC0063584 Oxford Glen WWTP NC0065684 Country Woods WWTP NC0065749 Ashe Plantation WWTP I apologize if this email is outside the normal process, but I had a couple of "do something even if it's wrong" parents. Seriously, I am new to my present position (Supervisor for the unit charged with processing these permits) and as part of getting up to speed I am trying to identify areas of workload backlog to process and complete. The permit renewals for these facilities fall into that category. At present, the attached permits have been reviewed, submitted for public comment, and the comments received and processed. Ordinarily, we would proceed to finalizing and completing a final permit. However, as you all also aware, Goose Creek is not an ordinary watershed and as such a number of issues have arisen over the past few years that potentially affect our final permit. I offer this up not as excuse as to why the issuance of these permits has been delayed, but rather as an explanation as to where we presently are in the process. It seemed to me that given the amount of time since these projects were last commented on, and trying to process them in the most efficient manner, sending an email with draft permit attached was best. For your convenience, I have attached copies of the draft permits for review. So you know what the Division's plan of action entails, it is our expectation that these permits will be approved by March 31s`. I apologize if that seems like a quick turnaround time. However, these permits have been sitting for a significant amount of time and we are trying to get them processed and approved. According to the subject public notice, the North Carolina Division of Water Quality (NCDWQ) and the North Carolina Environmental Management Commission are proposing to renew the subject permits. The Country Woods WWTP in Union County, North Carolina, discharges treated wastewater into Goose Creek (Pee Dee River basin); the Ashe Plantation WWTP in Mecklenburg County, North Carolina, discharges into Duck Creek, a tributary to Goose Creek; and the Oxford Glen WWTP in Mecklenburg County, North Carolina, discharges into Stevens Creek, another tributary to Goose Creek. As you aware, Goose Creek and Duck Creek (Goose Creek system) have been documented to support a population of the federally endangered Carolina heelsplitter (Lasmigona decorata), and portions of these streams have been designated as critical habitat for this species. In addition to the Carolina heelsplitter, nine other species of native freshwater mussels have been documented from the Goose Creek system, including the following: Atlantic pigtoe (Fusconaia masoni) and Carolina creekshell (Villosa vaughaniana), both of which are federal species of concern and are listed by the state as endangered; creeper (Strophitus undulatus), listed by the state as threatened; notched rainbow (Villosa constricta), listed by the state as being of special concern; eastern creekshell (Villosa delumbis), listed by the state as significantly rare; and Carolina lance (Elliptic angustata), eastern elliptio (Elliptio complanata), variable spike (Elliptio icterina), and Atlantic spike (Elliptio producta), all four of which are currently without federal or state status. Surveys by the U.S. Fish and Wildlife Service, North Carolina Wildlife Resources Commission (NCWRC), and others have documented a significant and continuing decline in the range and abundance of the Carolina heelsplitter and other native mussel species within Goose and Duck Creeks. The degradation of water quality in Goose and Duck Creeks is a major factor contributing to this decline. Because of the water and habitat degradation (aquatic habitat degradation) in the Goose Creek system, this population of the Carolina heelsplitter is likely to become extirpated in the next few years without the implementation of adequate measures to prevent further aquatic habitat degradation and to restore the species' habitat. Water -quality monitoring in Goose Creek (conducted by the NCDWQ, our staff, and a private consultant) has documented levels of several pollutants harmful to freshwater mussels (i.e., ammonia, chlorine, heavy metals, sediment, and nutrients) that exceed the state's water quality standards and action levels, and the NCDWQ has placed this stream on the § 303(d) List of the state's impaired waters (NCDWQ 2000, 2006, 2008). Point -source discharges have been implicated as major sources of elevated levels of many of these pollutants (NCDWQ 1998a, 1998b, 2002, 2003; Chen et Al. 2001; Allan 2005). Please reference the draft 2005 Technical Support Document for Consideration of Federally -listed Threatened and Endangered Aquatic Species in Water Quality Management Planning for the Goose Creek Watershed (TSD), prepared by an interagency team from the NCWRC, North Carolina Natural Heritage Program, and our staff, for additional details, toxicity information, and references. Further, changes in the hydrology within the Goose Creek system due to the loss of forest cover, an increase in impervious surface area, and recurring and continuing drought conditions have significantly lowered the base flows of Goose and Duck Creeks. Both of these streams have experienced repeated and prolonged periods (several months) of significantly reduced surface flows, no surface flow, and complete dewatering of long channel reaches since at least 2002. Consequently, for repeated prolonged periods there is no dilution of point -source discharge pollutants occurring, and we are extremely concerned about the effect pollutants in permitted discharges are likely having on the Carolina heelsplitter, its fish host (species of fish that serve as hosts for larval mussels and are necessary for reproduction), as well as the other aquatic fauna of Goose and Duck Creeks. In view of the above, we recommend that the subject NPDES permits be modified to include the following: 1. Site -specific standards for ammonia, copper, nitrate, nitrite, and phosphorus that are protective of the Carolina heelsplitter should be incorporated into the subject permits. All of these pollutants were listed as parameters of concern by several researchers who investigated the water -quality impairment in Goose Creek. 2 Because of the documented toxicity of ammonia to native freshwater mussels (Augspurger et al. 2003), in the NCDWQ's Proposed Rules to Implement the Site -Specific Water -Quality Management Plan for the Goose Creek Watershed (Yadkin/Pee Dee River Basin), Mecklenburg and Union Counties, North Carolina, the NCDWQ proposed reducing ammonia inputs to achieve 0.5 milligrams per liter or less of total ammonia on a chronic basis. We support this proposal and believe the subject NPDES permits, as well as any other permitted discharges into the Goose Creek system, should be required to meet this water -quality standard. Also, as discussed in the TSD (and Appendix B of the TSD) and as documented by March et al. (2007), in addition to ammonia, mussels are very sensitive to copper. Copper in excess of the state's action level is a concern in the Goose Creek system, indicating that mussels in the basin are exposed to concentrations that may be toxic. The TSD recommended an acute water -quality standard of 3.6 ug/1 copper and a chronic standard of 2.2 ug/l. We believe the subject NPDES permits, as well as any other permitted discharges into the Goose Creek system, should be required to meet this water -quality standard. 2. Compliance with permitted water -quality standards at the point of contact of the discharge effluent with surface waters should be required of all the subject permits. Recent droughts have revealed that portions of Goose Creek and Duck Creek do not have flow for significant periods (several months out of the year), and the dilution potential of the creeks at these times is nonexistent. Accordingly, compliance with permitted standards should be at "end -of -pipe." Consideration should also be given to requiring Aqua North Carolina, Inc., to evaluate options to a surface discharge for the wastewater treated at the three subject wastewater treatment plants. The NCDWQ included in the Proposed Rules to Implement the Site -Specific Water -Quality Management Plan for the Goose Creek Watershed (Yadkin/Pee Dee River Basin), Mecklenburg and Union Counties, North Carolina, optional language that would require existing permitted wastewater discharges in the Goose Creek system to connect to sanitary sewer service when available and feasible. While we believe it is necessary to remove existing surface wastewater discharges in the system to address existing water -quality impairment and assist in the protection and recovery of the Carolina heelsplitter in the Goose Creek system, we are concerned about the potential effects of removing this amount of water from a system that is already experiencing extremely low- to nonexistent -flow problems. Reduced base flows in the Goose and Duck Creeks are already having a significant adverse effect of the Carolina heelsplitter. Accordingly, we recommend that consideration be given to requiring the existing facilities to pursue an option such as land application to remove the surface -water discharges but retain the water in the Goose Creek system. 3 We appreciate the opportunity to provide these comments. The W WT facility appears to be located at or near the 100-year flood plain, however, the treatment components are elevated and protected from flooding. 9. Stream channel was well defined and no detrimental effects were observed as a result of the discharge. Downstream uses are generally agricultural in nature. Please provide a description of proposed wastewater treatment facilities: There are no additional WWT facilities proposed at this time. g. Possible toxic impacts to surface waters: Chlorine is available as a back up for disinfection purposes. 2. There have been no changes to the permit and/or the existing WWTP since the permit was last renewed. During the site investigation the wastewater treatment plant appeared to be in good operational condition. This facility discharges into a stream having a 7Q 10/30 Q2 flow of "0" cfs. However, this wastewater treatment plant has a consistent compliance history. Pending review and approval by the NPDES Unit it is recommended that the subject permit be renewed as requested.
