Good aŌernoon, everyone,
The USACE had the following comments related to the Surfside Landing Subdivision project (SAW‐2022‐02298) located
in Onslow County. The revised impact maps are aƩached. Please let me know if you have other quesƟons or comments.
1. I know Impact A has an existing crossing. I assume this crossing will be improved/enlarged. Will they reset the
culvert? To meet the Regional Conditions the pipe needs to be buried 20% for aquatic movement. If there is a
reason the pipe is proposed to be installed as shown in the cross section let me know. If not please have Strong
Rock revise the cross sectional drawing to show compliance with this Condition.
RESPONSE: The culvert will be reset and is proposed to be buried 1’ below the existing bed elevation to
provide for aquatic life movement. The cross section has been revised.
2. There is the cemetery on the right side of the entry road that is outside the project area parcel but probably less
than 50’ from the road proposed for improvements to accommodate the proposed subdivision. Due to the
anticipated road improvements, our staff archeologist had a few comments/suggestions that I’ve included
below. Do you know if the developer has specific plans to address the road expansion in the vicinity of the
cemetery?
With this type of cemetery (family cemetery, age, size, lack of fence), I would typically recommend a
buffer of 15 meters (approx 50 feet) if no professional investigations are conducted to delineate the
cemetery or investigate for unmarked burials. However, given that this cemetery is only 20 feet or so

from the farm road, in this case my recommendation would be that no construction or ground
disturbance (including equipment staging, heavy machinery access, etc) occur on the north side of the
farm road. I would recommend that the tree immediately south of the cemetery be left in place and all
road improvements be within the existing road’s footprint and to the south.
RESPONSE: The following note was added to the overall impact map sheet: NO CONSTRUCTION
OR GROUND DISTURBANCE SHALL OCCUR ON THE NORTH SIDE OF THE EXISTING FARM ROAD.
TREES IMMEDIATELY SOUTH OF THECEMETERY SHALL BE LEFT IN PLACE AND ALL ROAD
IMPROVEMENTS SHALL BE LIMITED TO EXISTING FARM ROAD'S FOOTPRINT AND TO THE SOUTH.
AddiƟonally, if evidence of human remains is uncovered during construcƟon, immediate
noƟficaƟon and coordinaƟon with the applicable agency will be iniƟated as per the
requirements set forth in the naƟonwide permit general condiƟons.

Good morning Mr. MaƩhews,
DWR is requesƟng addiƟonal informaƟon regarding avoidance and minimizaƟon and compliance with the regional
condiƟons of the USACE NW 18. In accordance with 15 A NCAC 02H .0506 (b)(1) the Division shall evaluate if the
proposed acƟvity: has avoided and minimized impacts to surface waters and wetlands to ensure any remaining surface
waters or wetlands, and any surface waters or wetlands downstream, conƟnue to support exisƟng uses during and aŌer
project compleƟon. The DWR is placing your applicaƟon on hold unƟl such Ɵme as the following requested addiƟonal
informaƟon has been provided to complete the review:
1. The stream is reported as approximately 14 feet wide and the culvert width as 8 feet in total width. Culverts
should be designed and installed in such a manner that the original stream patterns and profiles are not altered
and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above
and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of
the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert
shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. If
the width of the culvert is wider than the stream channel, the culvert shall include multiple boxes/pipes, baffles,
benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are
used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such
that they receive only flows above bankfull.
Placement of culverts and other structures in streams shall be below the elevaƟon of the streambed by one foot
for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a
diameter less than or equal to 48 inches, to allow low flow passage of water and aquaƟc life. If the culvert outlet
is submerged within a pool or scour hole and designed to provide for aquaƟc passage, then culvert burial into
the streambed is not required.

Please provided addiƟonal informaƟon on how you will achieve proper burial while allowing aquaƟc life passage.
If you are unable to modify the culvert design to use mulƟple culverts to accommodate stormflows, then please
redesign the culvert to include structures such as baffles that will provide for normal baseflow widths at low flow
condiƟons.

JusƟficaƟon: Surface water quality standards require that condiƟons of waters be suitable for all best uses
provided for in state rule, and that acƟviƟes must not cause water polluƟon that precludes any best use on a
short‐term or long‐term basis. Ensuring that in‐stream structures are installed properly will ensure that surface
water quality standards are met and condiƟons of waters are suitable for all best uses.
2. Lots, road crossing, and storm water control measures located near locaƟons on the map idenƟfied as SF and
WA‐2 of the development appear to be in proximity to PotenƟal Waters of the US, DWR will conduct a site visit
to assess the features in these areas, if Stream DeterminaƟons have been conducted in these areas, please
forwarded them to DWR for review. If streams are determined to be present that are not idenƟfied on the
submiƩed documents, DWR will follow up with noƟficaƟon to you and the Storm Water Permiƫng to allow for
proper design of stormwater setbacks. If you would like to join DWR on the site visit, please let me know your
available dates in the upcoming weeks and I will do my best to coordinate with you.
Pursuant to Title 15A NCAC 02H .0502(c) the applicant shall furnish all the above requested informaƟon for the proper
consideraƟon of the applicaƟon. If all the requested informaƟon is not received in wriƟng within 30 calendar days of
receipt of this email, the DWR will be unable to approve the applicaƟon and DWR will move to deny your applicaƟon as
required by 15A NCAC 2H.0506. The denial of this project will necessitate reapplicaƟon to the DWR for approval,
including a complete applicaƟon package and the appropriate fee. I hope this informaƟon is helpful and feel free to call
