Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This permit includes no major changes from the draft permit sent to you on February 27, 2008.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150E of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division of
Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may

This permit shall become effective June 1, 2008.
This permit and authorization to discharge shall expire, at midnight on January 31,
2011.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
Robert Briggs is hereby authorized to:
1. Continue to operate an existing 0.020 MGD wastewater treatment facility with
the following components:
• Extended Aeration type package plant
• Effluent Chlorination and Dechlorination and

This facility is located at Dogwood Trails Subdivision, off NCSR 1306, 0.95 miles
N of US Hwy 19 in Maggie Valley, Haywood County.

Hi All --Don had a call on 8/24/07 from someone who lived nearby and complained of an odor.
Don talked with Mark Teague/ORC who said it wasn't discharging.. As far as I know it's still not
being used. --Janet

concerning the Walling Residence. Re: Dogwood Trails, De-Chlor has been installed according
to a letter (dated July 27, 2005) from the operator. I'll look at the the flow situation with

of the SOC - but then they had to add in that paper flow ...... let me know what you think and

Well .... your 95th percentile values make sense - at least there is some logic to that - not that i
like it. We'll use that value and see how the model looks.

Haywood County
In response to the telephone request of this date, find attached a
portion of the Dellwood Quadrangle. The relative locations of Dogwood
Trails Subdivision and the Town of Maggie Valley's sewer collection line
have been marked; the distance between the two is about one mile.
On Haywood County's GIS system, I counted approximately 14 individual
parcels of property between the subdivision and the sewer line. The
probability of Mr. Briggs securing sewer easements across that many
parcels is exceedingly remote.
If additional information is required, please advise.

Dear Mr. Briggs:
The draft permit for Dogwood Trails Wastewater Treatment Plant was submitted for public notice on
August 30, 2006. The Division has received numerous comments from concerned citizens and is now
considering whether a public hearing on the permit should be recommended (and/or whether the
permit should be modified).
From documentation in your permit application and conversations with staff of our Asheville Regional
Office, it is the Division's understanding that the facility has been upgraded and certain parts replaced
to be able to operate and maintain the existing, but previously unused, treatment plant. The Division's
records indicate that an Authorization to Construct permit was issued May 29, 1987 for a 0.01 MGD
(10,000 gpd) treatment facility. A copy of this permit is attached. Our records do not indicate that an
Authorization to Construct permit was issued for the full permitted flow of 0.02 MGD [we.request that
you provide us a copy of the ATC if you believe this in error].
Before proceeding forward with this renewal permit, the Division must have the following information:
• Documentation of all parts that have been replaced or refurbished (and a specific description of
any updates to the plant).
• Documentation that the installed facility complies with the originally approved Authorization to
Construct permit.
• Documentation of the existence of dechlorination components at the plant. Dechlorination must
be provided in order to comply with the total residual chlorine limit of 28 ug/1. If no
Authorization to Construct permit has been received for dechlorination — please refer to our
Construction Grants and Loans Section website:

• Documentation of the exact number of homes proposed to be connected to the plant.
Should the existing plant have a design flow of 0.01 MGD, the permitted flow will be modified to
reflect the actual design flow of the facility. Additionally, at an estimated 360 gallons per day per
home, a 0.01 MGD wastewater treatment plant could accommodate a maximum of 27 homes.

A letter.of request for an Authorization to Construct was received March 23,
1987, by the Division and final plans and specifications for the -subject project
have been reviewed and found to be satisfactory. Authorization is hereby granted
for the construction"of a 0.01 MGD wastewater treatment facility consisting of a bar
screen, a'1O,.000 gallon aeration tank, a 2025 gallon secondary clarifier, a 1000
gallon sludge holding tank;63 'cfin dual blowers, a -210 gallon chlorine 'contact'
tank equipped with tablet feed type chlorinator, an effluent flow measuring device,
55 linear feet of 6-inch effluent discharge piping and all related valves and
appurtenances to serve Dogwood Trails -located in Haywood County.
This Authorization to Construct is issued in accordance with Part III,
Paragraph "C" of the NPDES Permit No. NCO065986 issued November 25, 1986, and
shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit
No. NCO065986.
The Permittee must employ a .certified wastewater operator in accordance with
Part III, Paragraph "D" of the reference permit.
The sludge generated from these treatment facilities must be disposed of in
accordta.nce with G.S. 143-215.1 and in a manner approvable by the North Carolina
Division- of Env irorimefita-l'.�ff6filfit
The.Asheville.Regional Office, Telephone Number 703-253-3341, shall. be notified
at least twenty-four (24) hours in advance of the operation of the installed system
so that an in -place inspection can be made of said system prior to operation.
Such notification to the Regional Supervisor shall be made during the normal office
Hours from 8:00 a.m.' until 5:00 p.m. on Monday through Friday, excluding State
Holidays.

Hello Susan,
Most recently, ARO staff visited Dogwood Trails' (a residential development) WWTP (NC0065986)
on November 4, 2005 and August 10, 2006. As of August 10, 2006, the facility owner, to the
best of staff s knowledge, had never discharged - despite a package -type WWTP having been
installed for many years. On November 4, 2005, the plant was somewhat deteriorated.
Additionally, at least one house plus roadways, gate posts and other features of the development
were under construction.
On August 10, 2006 the plant had been rehabilitated plus enclosed with a structure
aesthetically compatible with the development. All openings of the structure had been covered
with screen to prevent operational interference from leaves on the heavily wooded site. At the
time of the August 10, 2006 site visit, at least one house in the Dogwood Trails Development had
been completed and sold. The house was to be a secondary residence and had never been
occupied nor produced influent to the WWTP. Fresh water had been pumped into the treatment
plant so that its functional components could be maintained in operational condition, but no
wastewater discharge had occurred from the facility. The level of fresh water was at least a foot or
two below the point of overflow from the plant.
Concerning Part A.2 ( Wastewater Management Plan) of NPDES Permit NC0065986, The Town of
Maggie Valley's sewer collection system appeared to be a mile or two away from Dogwood Trails'
WWTP, and there looked to be several property owners located between the WWTP and the public
sewer line. The probability of Dogwood Trails securing sewer easements from all the intermediate
property owners would be remote. The wooded nature of the property, its slope and site
conditions suggested that spray irrigation or other land application systems would not likely be
realistic solutions for treatment of wastewater. The nature of the waste stream from a residential
development renders reuse an unlikely option.
Mark Teague or his firm, Environmental Inc., is the ORC for the facility. Environmental Inc.
operates a number of package type facilities in the Western Part of the Region and has a
acceptable record. This office believes that the ORC has the skill and ability to sustain an
adequate level of operation and oversight of the facility.
Several recent callers to the regional office. have complained about Dogwood Trails Subdivision,
but the substance of the calls has been that erosion and stormwater are matters of concern rather
than issues related to wastewater treatment. Available information reveals that holding a public
hearing on re -issuance of the NPDES Permit would be an unproductive use of time and resources.

Jim went to Dogwood Trails recently to see if they had started operating. They had not started
operation at the time of his visit. They did submit a document that they called a WMP back in
November 2005. They basically just stated that they would have an operator there 5 days a week,
plus how they would handle solids.

Your NPDES permit expires on November 30, 2006. Federal (40 CFR 122.41) and North Carolina (15A NCAC
2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior to expiration of
the current permit. If you have already mailed your renewal application, you may disregard this notice.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than June
3, 2006. Failure to request renewal by this date may result in a civil assessment of at least $500.00. Larger penalties
may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after November 30, 2006, the current permit must be renewed.
Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-215.1; unpermitted
discharges of wastewater may be assessed civil penalties of up to $25,000 per day.

Waste ent Plan
Dogwood Trails is a 0.020 MGD wastewater treatment facility with the
following components: extended aeration type package unit, effluent
chlorination and dechlorination, and digester. The facility is located at
Dogwood Trails off NCSR 1306 near Maggie Valley, NC in Haywood
County.
The Dogwood Trails treatment plant will be operated daily Monday
through Friday by a licensed wastewater operator, for whom a licensed
backup will be available. Samples for said treatment plant will be sent
to a North Carolina certified laboratory for analysis.
All solids will be wasted into the digester and will be removed from the
site by a licensed septic truck. The truck will haul the waste to a
certified site in Maggie Valley or Waynesville, Haywood County.
