ANSEL Interim Diremr Mr. Jason Sullivan, Planning Director Chatham County PO Box 54 80-A East Street Pittsboro, NC 27312 NORTH CAROLINA. ,Envirorunenral Quality May 23, 2023 Subject: Chatham County Morgan Creek and Haw River/Jordan Lake water supply watershed protection boundary request Dear Mr. Sullivan: The Division of Energy, Mineral and Land Resources (DEMLR) reviewed and approved the proposed revisions to water supply watershed protection boundary between Morgan Creek (WS-II NSW) watershed and Haw River/Jordan Lake (WS-IV NSW) received by our office on March 7, 2023, May 1, 2023, and May 15, 2023. The survey and supporting documentation demonstrate that the actual water supply watershed protection boundary is several feet north of the existing boundary and about 1.94 acres on the project site drains to Haw River/Jordan Lake watershed and not Morgan Creek watershed. DEMLR approves these boundary changes in accordance with North Carolina General Statute 143-214.5 and North Carolina Administrative Code 15A NCAC .0100, .0200, .0620-.0624. Specifically, 15A NCAC 2B .0623 (4) requires that all revisions to the water supply watershed boundaries must be approved by the Environmental Management Commission (EMC) or its designee prior to adoption by the local government.
