SUBJECT: Proposed Secondary Road Paving on State Road 1449 (Davis Road) in Gaston County,
DWQ No. 07-1635
Dear Mr. !older:
The Division of Water Quality has reviewed your submittal fora 401 Water Quality Certification for the aforementioned
project. Review of your application revealed it is lacking the necessary information required for making an informed
permit decision. The permit application was deficient in the following areas:
The application proposes to temporarily impact 0.29 acres of wetlands for the installation of various erosion
control measures. A site visit was coriducted on October 16, 2007, to discuss avoidance and minimization of
wetland impacts and the North Carolina Department of Transportation's (NCDOT) responsibilities regarding
restoration of temporarily impacted wetland areas upon completion of the project. Based on this site visit,
NCDOT representatives will investigate reducing or eliminating the temporary impacts associated with the
installation of erosion control measures. If the impacts can be reduced or eliminated, NCDOT must provide a
revised Pre-Construction Notification (PCN) application which accurately reflects the revised amount of temporary
wetland impacts, narrative regarding wetland restoration (if required) and revised erosion control plans. If the
impacts cannot be eliminated, NCDOT must provide a narrative regarding appropriate restoration for impacted
wetland areas.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are
supplied the necessary information. You have 21 days to respond in writing with the requested information or notification
to this office that the information is forthcoming. If; at the end of the 21 days, this office has not received this information
in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information
is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers
place the permit application on hold.
