Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the
attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007
(or as subsequently amended).
The only change from the draft permit of July 20, 2011 is a notation that your facility has the capability to store ethanol on site.
This ethanol storage capability is noted in the SUPPLEMENT TO PERMIT COVER SHEET.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to
an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation
and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other

All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this number
is no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included herein.
Motiva Enterprises, LLC - is hereby authorized:
1. To continue operating an existing Surface -Water Pollution Control System for stormwater
in proximity to above -ground storage tanks (ASTs) in excess of one million gallons, surface
bulk -storage of petroleum hydrocarbon fuels and Ethanol and utilizing;
• diked areas (secondary containment of ASTs and piping)
• truck loading -rack drains
groundwater remediation treatment and discharge
• waste -holding tank (with optional pump -out for offsite disposal)

• discharge control valve, manually operated (normally closed)
The facility is located at the Motiva Enterprises, LLC - Greensboro Terminal, 101 South
Chimney Rock Road, Greensboro, Guilford County, and
2. Discharge from said treatment facility through Outfall 001 at a specified location (see
.attached map) into an unnamed tributary of Long Branch [stream segment 17-2-1-(1)],
a waterbody classified as WS-IV* waters within Subbasin 03-06-08 the Cape Fear River
Basin.

1. Flow— During periods of no flow, the Permittee shall submit a monthly Discharge
Monitoring Report (DMR) indicating "No discharge". Flow shall be monitored with each
discharge event and may be monitored in one of four ways:
a) measure flow continuously,
b) calculate flow (see Attachment A. (4.) Flow Measurement),
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be
skimmed from the surface of a quiescent (calm water) zone.
3. . MTBE= methyl tertiary butyl ether. See Part A. (3.) for other requirements
4. Acute Toxicity (Fathead Minnow, 24-hour), Annually [see Special Condition A. (2.)].
Conditions:
The permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 pg/L and toluene concentration is less than 11 pg/L.
There shall be no discharge of floating solids or foam visible in other than trace amounts.
The permittee shall not discharge tank solids, tank bottom water, or the rag layer.

A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA
Document EPA/600/4=90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents
to Freshwater and Marine Organisms." The monitoring shall be performed .as a Fathead
Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -monitoring
purposes must be obtained below all waste treatment. The permittee will conduct one test
annually, with the annual period beginning in January of the calendar year of the effective date
of the permit. The annual test requirement must be performed and reported by June 30. If no
discharge occurs by June 30, notification will be made to the Division by this date. Toxicity
testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required, as part of this
permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which
it was performed, using the appropriate parameter code. Additionally, DWQ Form AT-1
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch
no later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response
data. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the
North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in: the cited document; such as
minimum control organism survival and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last
day of the month following the month of the initial monitoring.

A. (3.) MTBE MONITORING - SPECIAL CONDITION
For the protection of public health, oil terminals discharging to waters classified as water
supply (WS) waters shall monitor.Methyl Tertiary Butyl Ether (MTBE) for the duration of this
permit.
Outfall 001 If MTBE is detected at Outfall 001, the Permittee shall immediately resume
Monthly monitoring for MTBE, and the Permittee shall submit to the Division an MTBE Action
Plan to identify the sources of MTBE contamination. This Action Plan is due to the Division
within 180 days of the first detection of MTBE.
A. (4.) FLOW MEASUREMENT
To determine the flow measurement, and calculate the runoff from a region, please utilize the
reference and information at http://portal.ncdenr.org/web/wq/ws/su/bmp-manual , given:
• the runoff coefficient which accounts for infiltration and other
potential losses in the region,
• the rainfall intensity to the region,
• the time it takes for runoff to travel from the regions upper
reaches to its outlet, and the region's drainage area.

Thanks for your time this morning. Motiva has received the Draft NPDES Permit for the Greensboro Terminal dated July
20, 2011 (NPDES No. NC00022209). Upon review of the draft permit, we realized that DWQ was not notified that the
facility has the capability to store ethanol on site. Therefore, with this email we would like to amend the permit application
to notify the department that the facility has this capability.

On May 28, 2008, the facility submitted a permit application to the NC Department of Air Quality (DAQ) requesting that six
tanks on site be able to store ethanol or a gasoline/ethanol blend in addition to gasoline and distillate. Currently only one
tank stores ethanol on site (Tank 25614). It should be noted that this application was approved, however, the actual air
permit has not been updated with this language. The six tanks that now have the capability to store these four products
are:

Motiva Enterprises LLC (Motiva) owns and operates the Greensboro Terminal. This facility is
covered under NPDES Permit No. NCO022209 which will expire on August 31, 2011. A permit
renewal package is due to the Division of Water Quality within 180 days prior to permit expiration
(March 4, 2011). Attached is a copy of the Application Form — Short Form C, a table of discharge
results since January 2010, a map of the facility and surrounding area, and a diagram of the
wastewater system. Please note the following:
• There have been no changes at the facility since the issuance of the last permit.
• The facility does not generate sludge and therefore not required to submit sludge
management plan.

Stormwater from the loading rack area gravity flows to an 11,500-gallon in -ground SPCC Tank
(oil/water separator). The water leg of the separator gravity flows to the retention pond and
comingles with the stormwater collected within the diked area, which is then discharged under
operator supervision via Outfall 001. Recovered product from the SPCC Tank is routed to the
Flush Tank, the contents of which are periodically shipped offsite for product recovery.

truck through the terminal's loading rack.

Pursuant to my authorities as President and CEO of Motiva Enterprises LLC ("Company"), you are hereby
authorized and empowered each acting individually, in the name and on behalf of the Company, to the extent
permitted by law, to act on behalf of the Company as duly authorized representative concerning certain
specific environmental matters necessary to the operation of the Company's business. This delegation shall
include the matters set out below. These authorities shall always be exercised consistent with the Limited
Liability Company Agreement of the Company and policies in the best interest of the Company and its
owners as dictated by prudent business judgment and in strict accordance with the letter and spirit of the
Company's Code of Conduct and all current Company policies and procedures.
You are hereby authorized with respect to the following matters:
Permit, Applications, Amendments, Modifications, Transfers, Report and Other Information
To the extent permitted by law, pursuant to the United States Environmental Protection Agency's permit
regulations under federal statutes and regulations under state environmental statutes, you are hereby
delegated authority to sign environmental permit applications, requests for permit amendments,
modifications or transfers, reports, and other information provided to governmental agencies in connection
with environmental permits.
Delegation to Supervisor
In the absence of the Complex Manager, Terminal Manager, or Superintendent, the Supervisor may perform
the same duties as stated above with respect to reports and other information.
Scope and subdelegation
You shall sign for those facilities or activities, which are within your overall operational responsibility and
which are appropriate for your title and position. You may further delegate authority to sign reports and
submit information to the extent permitted by applicable law. Please keep these delegations in your files
and in accordance with the company's recordkeeping policy.
