Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This permit contains
no significant changes from the draft permit sent to you on June 7, 2006.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division of
Land Resources, the Coastal Area Management Act or any other Federal cr Local governmental permit that may

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge
are hereby revoked. As of this permit issuance, any previously issued permit bearing
this number is no longer effective. Therefore, the exclusive authority to operate and
discharge from this facility arises under the permit conditions, requirements, terms,
and provisions included herein.
Motiva Enterprises, LLC - is hereby authorized:
1. to continue operating an existing stormwater treatment Water Pollution Control
System consisting of:
• truck loading -rack drains,
• groundwater remediation discharge (treated),
• waste holding tank (with optional pump -out for offsite disposal,
• secondary containment (bermed area) for surface storage tanks and,
piping (with discharge to onsite pond), and
• retention pond with manual control valve (discharging to dry ditch).
The facility is located at the Motiva Enterprises, LLC - Greensboro Terminal, 101
South Chimney Rock Road, Greensboro, Guilford County, and
2. To discharge from said treatment facility through Outfall 001 at a specified
location (see attached map) into an unnamed tributary of Long Branch Creek, a
waterbody classified as WS-IV waters within the Cape Fear River Basin.

L. Flow- During periods of no flow, the Permittee shall submit a monthly
Discharge Monitoring Report (DMR) indicating "No discharge". Flow shall be
monitored with each discharge. event and may be monitored in one of four
ways:
a) measure flow continuously;
b) calculate flow (see Attachment A. (4.) Rational Equation) based on total
rainfall per unit area draining to the outfall; exclude built -upon. areas
(best method for facilities with large runoff -collection ponds);
c) estimate flow at 26-minute intervals during the entire discharge event;
or
d) report flow based on discharge pump logs.
2. Oil and Grease - Where possible, the grab sample for oil and grease should be
skimmed from the surface of a quiescent (calm water) zone.
3. MTBE - See Part A. (2.) 'for other requirements relating to MTBE
4. Acute Toxicity (Fathead Minnow, 24-hour), Annually [see Special Condition A. (3.)]:
Units: mg/L = milligrams per liter
µg/L = micrograms per liter.
MTBE = methyl tertiary butyl ether
There shall be no discharge of floating solids or foam visible in other than trace amounts.
The permittee shall not discharge tank solids, tank bottom water, or the rag layer.
The permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L.
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent. samples for self -monitoring purposes must. be obtained below all waste
treatment. The permittee will' conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by.June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required,. as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1). for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AI'-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made. - -
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North. Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

Introduction
Motiva Enterprises LLC, Greensboro Terminal (herein referred to as Motiva or the
Permittee) requires a National Pollutant Discharge Elimination System (NPDES) permit to
dispose treated wastewater to the surface waters of the state. The Permittee's 5-year NPDES
permit expires August 31, 2006 and they have requested renewal from the Division of
Water Quality (the Division). This Fact Sheet summarizes background information and
rationale used by the Division's NPDES Unit to determine permit limits and conditions.
Facility Records Review
Facility Description. Motivloperates the Greensboro Terminal, bulk -petroleum fuel storage and
distribution center in Guilford County. Discharge from the facility consists of hydrostatic tank -testing
and maintenance wastes, and stormwater runoff controlled by a Water Pollution Control System
consisting of: loading rack drains; oil/water separator; waste holding tank with optional offsite
disposal; pumps to empty dike containment areas through the oil -water separator; and discharge
control valves. Discharge travels to an unnamed tributary (UT) to Long Branch Creek.

HISTORY AND DATA REVIEW
Facility Inspections. The Winston-Salem Regional Office has scheduled regular annual inspections
of this facility. '
Waste Load Allocation (WLA). The current permit expires on August 31, 2006 and the Division
received an application to renew on March 1, 2006. The Division reviewed this permit, the WLA in
January 1991 and the New Jordan Lake Strategy; 030602 to developA and review effluent limits
and monitoring requirements based on an in -stream waste concentration (IWC) of 100% (zero -flow
receiving -stream conditions). The Division judges these limits and monitoring requirements to be
appropriate for this renewal except as noted herein (see PERMITTING APPROACH SUMMARY).
Verifying Existing Stream Conditions. This facility discharges under "zero -flow" receiving -
stream conditions to an unnamed tributary (UT) to Long Branch [03-06-081, a Class WS-IV stream
within the Cape Fear River Basin. Long Branch Creek does not appear on the Division's "impaired"
waterbody list, i.e., is not 303(d) listed.
Discharge Monitoring Reports (DMRs) -- Effluent Data Review. DMRs were reviewed from
December 2003 through December 2005: Discharges from Outfall 001 occurred episodically, but
usually several times or more per month. The Permittee reported non -discharge months as "no flow" in
accordance with the permit. The Permittee reported a maximum discharge of 0.500 MGD (August
2005).
Notices of Violation (NOVs). DMRs were reviewed from December 2002 through December 2005,
which reflected no NOVs were'issued to this facility during this permit cycle. DMRs submitted
during this time frame noted Parameters Missing and Frequency Violations but did not receive NOVs
from the Regional Office.
Whole Effluent Toxicity (WET) Test. The facility has passed its annual acute toxicity test for the
past 4 years, from 2002 through 2005.
PERMITTING STRATEGIES
New SOP for OR Terminals. The Division established renewal criteria for this permit according to
the NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version
September 9, 2005 (2005 SOP), as amended (April 14, 2006).
Cape Fear Nutrient Strategy 2006. The Division renewed this permit in accordance with the
Supplement to NPDES Permitting Strategies for the Cape Fear River Basin, 2006 Permit Renewal
(May 10, 2006). The Motiva discharge location is governed by the Cape Fear River Basin permitting
strategy for Nutrients and oxygen demanding wastes (Subbasin 30608). Therefore, this facility is not
impacted by this new permitting strategy to monitor for Total Nitrogen and Total Phosphorus. (WO
Summary of Reasonable Potential Analysis WA). The 2005 SOP establishes 12 criteria for � ,sloe
renewal including those requiring a reasonable potential analysis (RPA). RPA parameters of concern
(POCs) with stream standards or criteria include benzene, toluene, MTBE and Phenols based on the
Division's review of effluent data submitted by the Permittee. The data reported by the facility in
BIMS reflected that no RPA exists for these (POCs). Resultantly, Monthly monitoring for these
pollutants will continue to be Monthly Monitoring with no limits.

MTBE, and Total Suspended Solids (TSS). Total Suspended Solids (TSS) did not exceed
permit limit of 45 mg/L during this permit cycle but must still be monitored monthly with a
45.0 mg/L limit per the 2005 SOP. This SOP rationale for continuing the TSS monitoring
and limit is that the daily maximum limit is recommended as a minimum stormwater
management practice. Similarly, MTBE was not detected and 1/Month monitoring was
reduced to 1/Quarter. Because phenol was not detected during this permit cycle, reasonable
potential will not be calculated, and no phenol limit will be included.— monitoring frequency
will remain at I/Month, per SOP 2005.
Permitting Approach Summary
Based on Discharge Monitoring Reports (DMRs) submitted over the last permit cycle, new permitting
strategies, and information currently available, the Division has made the following changes to the
previous permit:
• MTBE — (not detected) relaxed l/Month monitoring to 1/Quarter monitoring; no limit.
• EPA Test Method 625 — Deleted per 2005 SOP.
• Naphthalene — (not included in previous permit) added 1/Month monitoring; no limit.
• Phenol — (not detected) relaxed 1/Month monitoring to 1/Quarter monitoring; no limit.

Dear Ms. Bryant:
Motiva Enterprises LLC — Greensboro Terminal is hereby requesting renewal of NPDES Permit
NC0022209. The subject permit expires on August 31, 2006. No physical changes have been made
to the stormwater treatment components at the facility since the last permit.
The Greensboro Terminal does not generate sludge as part of stormwater discharge; therefore, no
sludge management plan is necessary for this facility.
As requested please find enclosed the following items
• Cover letter requesting renewal of permit and documenting any changes at the facility since
issuance of the last permit including a narrative description of the sludge management plan if
applicable. (One signed original and two copies);
• Completed NPDES Permit Application — Short Form C, included as Attachment A (One signed
original and two copies);
• Delegation of Authority documentation included as Attachment B;
