The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215:1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994, or as subsequently amended.
RENEWAL SUMMARY
The Division's renewal evaluation includes a reasonable potential analysis (RPA), in
accordance with permitting guidance provided by the EPA. The Division has made the
following decisions based on current information and your discharge Monitoring Reports
(DMRs) submitted over the last permit cycle:
• Deleted lead from permit (no RP).
• Deleted 1;2 DCA from permit (no RP).
• Turbidity — (RP = yes); added permit limit.
• Benzene — (RP = yes) retained permit limit and monthly monitoring.
• Iron — (RP = yes) continue monitoring.
• Manganese — added permit limit; continue monitoring.
• Naphthalene — added monthly monitoring per Bulk Storage SOP 2005 (not included in
previous permit; diesel stored onsite).

If any parts, monitoring frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing, upon written request, within
thirty (30) days following receipt of this letter. You must submit this request in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and file it
with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina
27699-6714. Unless such a demand is made, this permit shall be final and binding.
Please notice that this permit is not transferable except after notifying the Division of Water
Quality. The Division of Water Quality may modify, or revoke and reissue this permit. This
permit does not affect your legal requirements to obtain other permits required by the Division of
Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other
federal or local governments.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.

• an oil/water separator and waste holding tank (servicing the truck -loading rack)
• a groundwater remediation system (intermittent)

2. to discharge from said treatment facility through Outfall 001 at a specified location (see attached

1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report
(DMR) indicating "No discharge." Flow must be monitored with each discharge and may be
monitored in one of four ways:
a) measure flow continuously;
b) calculate flow based on total rainfall per area draining to the outfall; exclude built -upon
area (best method for facilities with large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent (calm water) zone.
3. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream
background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase.
4. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(2.)].
There shall be no discharge of floating solids or foam visible in other than trace amounts.
There shall be no direct discharge of tank solids, tank bottom water, or the rag layer.
Following hydrostatic tank or pipe testing, the Permittee shall not discharge wastes containing
benzene concentrations greater than 1.19 µg/L, or toluene concentrations greater than 11 µg/l.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS.
A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit.' The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the .Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

A. (3.) MTBE MONITORING - SPECIAL CONDITION
For the protection of public health, oil terminals that discharge to waters classified as water supply
(WS waters) will adhere to the following action plan: As stated in Part A. (1), the Permittee shall
monitor MTBE monthly for the duration of this permit. If, after one year of monthly monitoring,
MTBE is not detected (or after twelve data points have been collected over a six-month period), the
Permittee may request the Division to reduce the MTBE monitoring frequency. Such a reduction
shall be considered a minor permit modification.

BACKGROUND
Waste Load Allocation (WLA) and Bulk -Storage SOP. A Waste Load Allocation was last conducted in
April 1994, when the receiving stream, Gum Branch, was classified C waters. The Division subsequently re-
classified Gum Branch as WS-IV waters prior to last renewal. This WLA recommended monitoring for
benzene, toluene, ethylbenzene, lead, and MTBE with permit limits for TSS and oil and grease. The Division
established new effluent limits and monitoring requirements for the previous permit according to
Requirements for Discharges from Oil and Petroleum Storage Facilities (SOP 2001, version 30Jul0l).
PERMITTING STRATEGY
New SOP for Oil Terminals: The Division establish renewal criteria for this permit according to the
NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version September 9,
2005 (2005 SOP). This document established 12 criteria for renewal including reasonable potential analyses
(see Renewal Summary). Database for this RPA is attached to this document.
Reasonable Potential Analysis (RPA): The Division conducted a reasonable potential analysis according to
EPA guidelines in order to establish potential for a given parameter to exceed its water quality stream
standard. The Division established a list of parameters of concern (POCs) based on the previous permit. These
parameters include benzene, toluene, turbidity, iron, lead, manganese, and 1,2 Dichloroethane (DCA). In
addition, the Division calculated phenol limits appropriate for a discharge to water supply (WS-IV) waters
considering a total of eight discharges to this water shed (see 2005 SOP, item 11).

Phenol Calculation. The phenol limits calculation considers phenol loading for all terminals discharging to
WS waters in the Paw Creek area. For this permit:

BACKGROUND
Waste Load Allocation (WLA) and Bulk -Storage SOP. A Waste Load Allocation was last conducted in
April 1994, when the receiving stream, Gum Branch, was classified C waters. The Division subsequently re-
classified Gum Branch as WS-1V waters prior to last renewal. This WLA recommended monitoring for
benzene, toluene, ethylbenzene, lead, and MTBE with permit limits for TSS and oil and grease. The Division
established new effluent limits and monitoring requirements for the previous permit according to
Requirements for Discharges from Oil and Petroleum Storage Facilities (SOP 2001, version 30ul01).
PERMITTING STRATEGY
New SOP for Oil Terminals: The Division establish renewal criteria for this permit according to the
NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version September 9,
2005 (2005 SOP). This document established 12 criteria for renewal including reasonable potential analyses
(see Renewal Summary). Database for this RPA is attached to this document.
Reasonable Potential Analysis (RPA): The Division conducted a reasonable potential analysis according to
EPA guidelines in order to establish potential for a given parameter to exceed its water quality stream
standard. The Division established a list of parameters of concern (POCs) based on the previous permit. These
parameters include benzene, toluene, turbidity, iron, lead, manganese, and 1,2 Dichloroethane (DCA). In
addition, the Division calculated phenol limits appropriate for a discharge to water supply (WS-IV) waters
considering a total of eight discharges to this water shed (see 2005 SOP, item 11).

Revised Guidance to Permit Writers — Allowable Phenol Loads for Bulk
Oil Terminals in the Paw Creek Area, Catawba River Basin.
As part of the newly revised Standard Operating Procedures — Permit Requirements for
Discharges from Oil and Petroleum Storage Facilities (SOP-2001), the Division has
recalculated the allowable load for phenol. New numbers are appropriate for bulk oil
distribution terminals discharging to an unnamed tributary of Gum Branch (WS-IV) and an
unnamed tributary of Long Creek (WS-IV CA), both within subbasin 030834. This document
affects eight (8) permitted facilities discharging to WS waters (see Table 1).
I have made these calculations considering the following background and assumptions:
1. The water quality stream standard comes from the EPA Document Ambient Water
Quality Criteria for Chlorinated Phenols. This standard has been included in the North
Carolina 2B .0200 Rules and has been applied to Water Supply (WS) waters since 1990.
2. The standard for chlorinated phenolic compounds is 1.0 µg/L. Although it is unlikely
that petroleum bulk storage facilities would discharge chlorinated phenolic compounds,
they may discharge phenol. Therefore, the Division is concerned that phenol (at levels of
1 µg/L or greater) has potential to create "daughter compounds" at downstream water
intakes where water is drawn from the river and chlorinated. It is therefore appropriate to
calculate allowable phenol load near the closest water intake downstream of these bulk
storage facilities.

concerns (taste and odor associated with chlorinated phenols in fish and drinking water).
I have applied the standard (1.0 µg/L) near the confluence of Long Creek and the
Catawba River (approximately 1,000 feet upstream) where the Division calculated 30Q2
flow at 716 cfs (based on Clariant Corporation's 1996 WLA, NC0004375). Therefore,
the allowable wasteload for each of nine (9) dischargers is calculated:
716 cfs x 0.001 mg/L x 8.34 = 3.85 lbs./day total phenol

regular unleaded and premium unleaded), high sulfur diesel, and low sulfur diesel.
