The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the subject
facility. We issue this permit pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated October 15, 2007, or as subsequently amended.
Per your request, the Division has modified the draft Supplement to Cover Sheet. We have corrected
the word "Plan" to read "System" under #1, and included a subbasin number (03-08-34) under #2, in
keeping with similar permits statewide. We have also added a footnote to the effluent limitations table
clarifying that BTEX shall be sampled concurrently with annual Acute Toxicity.
The Division acknowledges your second request of December 20, 2010, to remove the permit limit for
manganese. However, as explained during the draft review, your discharge data shows reasonable
potential for manganese to significantly exceed its surface water -quality standard for receiving streams
classified as water supply (WS) [max predicted = 2008 µg/L; max allowable = 200 µg/L]. We have
attached the data analysis summary and dataset for your records, as requested. The EPA requires this
reasonable potential analysis (RPA) of all point -source discharges governed by the NPDES Program.
While we feel stormwater may or may not concentrate manganese, we recognize as a likely source the
relatively high concentrations you report in local groundwater. However, regardless of its source, please
understand that you remain responsible to protect the receiving -stream environment from any and all
pollutants present in your point -source discharge, and to comply with each parameter's respective
water -quality standard for receiving -waters classified WS-IV [§I5A NCAC 02B.0216 (3)(h)]. If you
need assistance to treat this wastewater prior to discharge, please contact a qualified North Carolina -
certified Engineer and apprise the Division of any recommendations.
If any parts, measurement frequencies, or sampling requirements contained in this permit are -
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearink this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.

Footnotes:
1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report
(DMR) indicating "No discharge." Flow must be monitored with each discharge and may be
monitored in one of four ways:
a) measure flow continuously;
b) calculate flow based on total rainfall per area draining to the outfall; exclude built -upon
area (best method for facilities with large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent (calm water) zone.
3. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream
background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase.
4. This sample to be collected concurrently with annual Acute Toxicity.
5. See MTBE Special Condition [see section A. (3.)].
6. 'Acute Toxicity (Fathead Minnow, 24-hour), Annual [see section A. (2.)].
There shall be no discharge of floating solids or foam visible in other than trace amounts.
There shall be no direct discharge of tank solids, tank bottom water, or the rag layer.
Following hydrostatic tank or pipe testing, the Permittee shall not discharge wastes containing
benzene concentrations greater than 1.19 µg/L, or toluene concentrations greater than 11 µg/l.

A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test.
Effluent samples for self -monitoring purposes must be obtained below all waste. treatment. The permittee will
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date
of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by
June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next
discharge, event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition
will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the
appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

'Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent -
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
follow-up testing to be completed no later than the last day of the month following the month of the initial
monitoring.
A. (3.) MTBE MONITORING - SPECIAL CONDITION
For the protection of public health, oil terminals that discharge to waters classified as water supply (WS) will
adhere to the following action plan: As stated in Part A. (1), the Permittee shall monitor MTBE monthly for
the duration of this permit. If, after one year of monthly monitoring, MTBE is not detected (or after twelve
data points have been collected over a six-month period), the Permittee may request the Division to reduce
the MTBE monitoring frequency. Such a reduction shall be considered a minor permit modification.

Dear Mr. Corporon:
Motiva Enterprises LLC is in receipt of the Draft NPDES Permit issued by DWQ for our Motiva
Charlotte North Terminal. The purpose of this submittal is to provide comments on the draft permit
prior to the December 24, 2010 deadline. As you know, Motiva Enterprises LLC (Motiva) owns and
operates the Charlotte North Terminal. This terminal is covered under NPDES Permit No.
NC0022187, which expired on June 30, 2010. A permit renewal package was submitted to the
Division of Water Quality in December 2010 (within 180 days prior to permit expiration).
Administrative Comments
Motiva offers the following administrative comments to the draft permit: 4Supplement to Permit Cover Sheet

Under Item #1, the permit states that Motiva is authorized to "cony Ito operate a Surface -Water
Prevention Plan for stormwater...." Based on the draft permi 'ssued for the South Terminal, we
believe this is an error and should state that Motiva is autho 'zed to "continue to operate a Surface -
Water Pollution Control System for stormwater.y_' M - iva respectfully requests that this condition
be changed to reflect that the facility operates ErControl S. stem with the units listed in the permit
(secondary containment, oil/water separator, waste holding tank, and detention pond.)
and
Footnote 4 appears to be incorrectly referenced. It appears that a different description needs to be
added for Footnote 4 and the current description be labeled as Footnote 5 (Acute Toxicity Testing.)
Missing Pages
The draft permit received by the facility goes from Part I.A(3.) MTBE Monitoring — Special
Condition to Part II of the permit Page 3 of 18. It is assumed that the missing two pages are from
standard language for Part II. However, the facility requests a copy of these pages for their records,

to understand if there have been any changes in these requirements, and if there are any missing site -
specific conditions from Part I of the permit.
Manganese Permit Limit
In the permit renewal application, Motiva requested that DWQ remove the permit limit for
manganese. In the cover letter to the draft permit, the Division acknowledges this request but denies
removal based on analytical data that shows "a reasonable potential for manganese to exceed its
surface water -quality standard [max predicted = 2008 ug/L; max allowable = 200 ug/L]." Motiva
has the following comments/requests based on this response.
Motiva submitted a letter on August 17, 2006 to your attention outlining why Motiva believes that
manganese is naturally occurring in the environment and not a result of activities at the Motiva
terminal. Specifically:
• Analytical results of soil and groundwater samples document a relatively high background
concentration of manganese (as compared to the permit limit of 200 ug/L). Soil data published
by the United States Geological Survey (USGS) in 1981 indicate manganese soil concentrations
of 300 ppm in a sample collected within a couple of miles of the Charlotte North Terminal.
Analytical results of soil samples collected in the receiving bed upstream of the facility's
discharge confirm the USGS data. Manganese soil concentrations ranged from 258 ppm to 740
ppm in the three samples collected. Groundwater monitoring data also indicate elevated
concentrations of manganese (ranging from 71 ug/L to 1840 ug/L), which appear to be due to
contact with local soils. These results are attached to these comments as Attachments A and B.
The Motiva Charlotte North Terminal does not manufacture, store or use products containing
manganese compounds, nor are we aware of past activities that could have involved such
compounds. Therefore, the likely source of the manganese detections in previous stormwater
samples was its contact with local soils, which is beyond Motiva's control, including the
implementation of corrective actions to affect the results.
For these reasons, Motiva respectfully request further discussion of this issue with your office to
understand how the reasonable potential was estimated and the Division's approach to this permit
limit. Motiva is committed to protecting our environment and understands the responsibility we
have to our community and citizens. We are committed to complying with local, state and federal
regulations and understand that it is our "responsibility to protect the receiving -stream environment
from any and all point -source discharges from our facility." However, as manganese is not a
constituent of the industrial activities of the site, it is unknown what type of best management
practices (BMPs) can be implemented at the Terminal to change the results. In conclusion, Motiva
respectfully request your consideration for the removal of this parameter in the final permit.
Motiva would like to request a conference call with the appropriate parties to discuss this issue. Our
Environmental Support Person will contact your office to discuss the possibility of scheduling a
meeting.

sufficiently close to any existing or known proposed public water supply intake so as to create an
adverse effect on water quality. The DEH concurs with the issuance of this permit provided the
Permittee properly operates and maintains the facility; the Permittee meets the stated effluent limits
prior to discharge; and the discharge does not contravene the designated water quality standards.

PART IV - EVALUATION AND RECOMMENDATIONS
The Permittee, Motiva Enterprises LLC, is requesting NPDES Permit renewal for the
discharge of treated stormwater from the subject facility. According to Ms. Denise Priesmeyer,
Environmental Coordinator for the facility, the terminal does not manufacture, store or use
NPDES Permit Staff Report
products containing manganese compounds, nor is there any knowledge of past activities that
could have involved such compounds and that the Manganese is a naturally occurring element
and the likely source is contact with local soil. Therefore, Motiva is requesting that Manganese
limit be removed from the permit. It should be mentioned that the pond at the facility was very
cloudy during the investigation. Also, during the last 2 renewals, the pond at the facility was
very cloudy from suspended sediment. The facility manager was encouraged during the past two
renewals to provide good groundcover at the facility in order to reduce the transport of sediment
to the pond. Also, a good groundcover will help reduce TSS, Turbidity and Manganese limit. A
review of DMRs for the past two years revealed only two Manganese violations during July and
August of 2009. Also, it was learned during the site review that the facility was not discharging
at this time since they failed Manganese limit in of December 2009.
On the other hand, Motiva believe that their terminal is the only gasoline terminal that
discharges to Gum Branch that has a Manganese permit limit.
It is recommended that the NPDES permit be renewed after addressing the above concern
by the Western NPDES Program Unit and pending review by the UST Section.

As a followup to my telephone message that I left for Rob Krebs this morning, I.am notifying you that the interim
stormwater treatment approved in February 2010 for the subject facility has been completed. The interim treatment
system was stopped arroou, nal trend May 28th but remained in place until sampling from our regular stormwater management
system verified that the a i ioatment was no longer needed. We have verified that the interim system is no longer
needed and the equipment has been dismantled. Discharge analytical data was reported in the monthly Discharge
Monitoring Reports ( Rs).

This is to notify you that we plan to begin the discharge of treated stormwater on Friday February 12th,
pending testing results demonstating effective treatment. There was some storm water run through
the treatment system on a trial basis on Tuesday and Wednesday (Feb 9th and 10th) to determine
whether the treatment system is setup and working properly. The treated stormwater is being held in a
clean water tank until testing results are received. These results are expected today or tomorrow. If the
results indicate that the treatment system is working properly, then we would like to start discharging
treated water tomorrow, due to the stormwater holding area reaching capacity limits with the possibility of
more precipitation forecasted for Saturday. As requested in Tom Belnick's email below, we will sample
our initial discharge and include an acute toxicity test with the other parameters required by the facility

Per our telelphone conversation this morning, Motiva Enterprises is requesting
approval for a temporary portable stormwater treatment system to prevent permit
exceedances at our Charlotte North Terminal. Due to the need to discharge storm
water in the near future, a response is respectfully requested as soon as practical.
Background
In January our Charlotte North Tenninal storm water discharge under NPDES
Permit No. NCO022187 exceeded pen -nit limits for benzene and manganese. Our
investigation indicates that the cause of these exceedances was due to the
disturbed soils from an onsite construction project. Because of the recent
unusually high amounts of precipitation in the area, a large amount of additional
storm water has accumulated in the tank farm containment area where the
construction activity is located. We are therefore holding the water to prevent
further pen -nit limits exceedances.
Although some of the storm water has been transported offsite for treatment, we
would like to conduct temporary onsite treatment for more cost-effective
management of the impacted storm water. Our current discharge permit,
however, does not address the use of temporary treatment units hence this request
for approval.
Temporary Treatment System
The onsite temporary treatment units would be comprised of the following
equipment:
three 20,000 gallon fi-ac tanks to collect the impacted
storm water,
■ a sock filter to remove suspended solids,
■ a green sand filter to remove manganese,
■ carbon units to remove benzene and other organics, and
■ a 20,000 gallon clean water tank.
The first few batches of treated storm water would be analyzed prior to discharge,
to assure that the treatment units are functioning properly and that the pen -nit
limits are being met. Once this has been established, sampling and analysis would
be conducted in accordance with permit requirements at the permitted Outfall
001. Temporary treatment would continue until all construction activity has been
completed, soils are stabilized, and treatment is no longer necessary to meet
permit limits.

Motiva Enterprises LLC (Motiva) owns and operates the Charlotte North Terminal. This facility is
covered under NPDES Permit No. NCO022187 which will expire on June 30, 2010. A permit
renewal package is due to the Division of Water Quality within 180 days prior to permit expiration
(January 2, 2010). Attached is a copy of the Application Form — Short Form C, a table of discharge
results since January 2008, a map of the facility and surrounding area, and a diagram of the
wastewater system. Also, Motiva is requesting the removal of the manganese limit from the
NPDES permit as indicated below.
Removal of Manganese Permit Limit
The Charlotte North terminal is a distribution terminal for gasoline and petroleum distillates. It does
not produce, manufacture, or consume products or raw materials. Gasoline and distillates are
received via pipeline, which are then stored in above ground storage tanks. All products are loaded
via tanker truck through the terminal's loading rack.
The facility currently has a limit for manganese in its NPDES permit. The facility does not
manufacture, store or use products containing manganese compounds, nor is there any knowledge of
past activities that could have involved such compounds. Therefore, there are no Best Management
Practices (BMPs) the facility can implement to influence the concentration of manganese in the
stormwater. Manganese is a naturally occurring element and the likely source is contact with local
soils. In August 17, 2006, Motiva made a similar request and provided soil and groundwater
analytical data in support of the request. In addition, we believe our terminal is the only gasoline
terminal that discharges to Gum Branch that has a manganese permit limit. Therefore, Motiva
respectfully requests that manganese limit be removed from the permit.

Stormwater from the loading rack gravity flows to a 10,000 gallon in -ground SPCC Tank
(oil/water separator). The water leg of the separator gravity flows to the storage tanks dike
and commingles with storm water collected within the diked area, which is then discharged
under operator supervision to the retention pond and eventually discharged out through
Outfall 001, under supervision. Recovered product from the SPCC Tank is routed to the
Flush Tank, the contents of which are periodically pumped back into storage. The ground
water remediation system here is only an air sparge system with no recovery or process of
water. (See Figure No. 1)

The facility is a distribution terminal for gasoline and petroleum distillates. It does not produce,
manufacture, or consume products or raw materials. Gasoline and distillates are received via
pipeline, which are then stored in above ground storage tanks. All products are loaded out via tanker
truck through the terminal's loading rack.
