On behalf of Davidson Homes, LLC (c/o Kim Mulder) (applicant), please find attached a complete application
and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE)
that the activities associated with the proposed development of the Martin Property(Project)may proceed under
Nationwide Permit(NWP)29.The proposed Project meets the criteria set forth in General Certification 4256(GC
4256) and is below the thresholds required for an Individual Water Quality Certification. There are no proposed
state-regulated riparian buffer impacts; therefore, a Neuse River Riparian Buffer Authorization is not requested.
A copy of this application is being furnished to NCDWR for the record only.
Project Purpose and Location
The purpose of the Project is to construct a residential subdivision with associated roads, utilities, and other
infrastructure.The+/-47-acre Project is located west of the intersection of Eagle Rock Road and Lake Glad Road,
in Wendell, Wake County, NC. The coordinates of 35.7540°N, 78.3951°W generally correspond to the center of
the Site. The Site drains to Marks Creek (Lake Myra) [C;NSW] and is in the Neuse River Basin (HUC
030202011102).
Project Detail
The proposed Project involves construction of a residential development with attendant infrastructure. Impacts
to jurisdictional wetlands and streams is proposed to reach upland portions of the Site for development. Access
to the Site will be provided by a road connection to existing Eagle Rock Road to the east. The Project proposes
to tie into existing utilities adjacent to the Site.
The Project proposes a permanent loss of 0.06 acre of Wetland WC-02 (Impact A) for construction of a road
crossing and 0.009 acre of Wetland WD (Impact B)for construction of a greenway crossing.A temporary impact
of 0.005 acre of Wetland WC-02(Impact A)is proposed to install the culvert.An additional 0.0008 acre of Wetland
WD will be temporarily impacted to construct the greenway crossing. The Project also proposes to permanently
impact 35 LF (280 SF, 0.006 acre)of intermittent stream SD (Impact B)to construct a greenway crossing.
The culverts at both Impact A and B have been designed to provide hydraulic connectivity across the proposed
impacted portions of the wetlands and are set at grade.
An existing farm road and culvert is located between Wetlands WC-01 and WC-02. The existing culvert and fill
material will be removed, and the proposed culvert will be placed upgradient of the existing crossing. The
proposed culvert location was designed to align with the connection to Eagle Rock Road and which must meet
the required setbacks, sight distance, and neighborhood road requirements for developments. Due to these
requirements, designing the culvert at the existing location would still result in permanent wetland impacts and
grading impacts to the riparian buffers. A riprap dissipator pad is proposed at the outlet of the culvert to prevent
erosional forces between the wetland areas.

Stormwater detention ponds are proposed to treat stormwater on the Site.Typical equipment used in construction
and utility projects (i.e., backhoes, excavators, dump trucks)will be utilized.
The Site is undeveloped and exhibits evidence of past logging activities. Mature pines and hardwoods are present
within the drainages. Land use in the vicinity includes residential,agricultural and forested land,and undeveloped
land.
According to the US Fish and Wildlife Service (USFWS) Information for Planning and Consultation (IPaC)
database, six threatened and endangered species, one Proposed Endangered species, one Candidate species,
and the bald eagle are potentially present on the Site. Project waters do not provide suitable habitat for Carolina
madtom, Atlantic pigtoe, Neuse River waterdog, and dwarf wedgemussel as they are small first order streams
with slow velocity and are dominated by silt and sand substrates. Soils on the site range from slightly acidic to
very strongly acidic which are not preferred by Michaux's sumac. Habitat for red-cockaded woodpecker(RCW)
is not present as a result of past timber practices. Mature forests within the drainages contain dense understories
which are not preferred foraging habitat for RCW. Per the USFWS, the nearest dwarf wedgemussel identified
stream reach is +/-5.5 river miles downstream of the Site. The nearest identified stream reach for Carolina
madtom, Atlantic pigtoe, and dwarf wedgemussel is over 20 river miles from the Site. Potential habitat for tri-
colored bat(Proposed Endangered)and monarch butterfly(Candidate)is present on the Site. There are several
ponds of sufficient size to support foraging habitat nearby the Site; however, no visible signs of bald eagles or
nests are present on the Site. The NC Natural Heritage Program (NCNHP)database report indicates no known
occurrences of threatened or endangered species on or within 1.0 mile of the Site (see attached report dated
May 1, 2023).
The Site is not listed as a historic property or within a historic district. No historic structures were found on the
Site. Eleven historic properties were identified within one mile of the Site per the NC State Historic Preservation
Office (NCSHPO)database. Eight properties are designated as "Surveyed Only (SO)", and three properties are
designated as "SO-Gone."Two SO properties are located directly east of the Site along Eagle Rock Road. The
G.L. Martin House (WA2012) and the Johnsons Grocery (WA2011) properties both contain buildings which
appear to be associated with their historical status. No impacts to these historic properties are proposed as a
part of this Project. Figure 4 provides a graphical representation and description of these properties.
Protect History
A Site delineation was completed by Mr. David Gainey of Sage Ecological Services, Inc. (Sage) in September
2021. A PJD has not been issued as of the date of this application. A riparian buffer site meeting was held with
Mr. Josh Brigham of NCDWR on December 6, 2021. The buffer determination letter is attached.
Avoidance and Minimization
A wetland, stream, and riparian buffer delineation were performed to identify environmentally sensitive areas on
the Site prior to site design.The Project was designed to avoid &minimize impacts to jurisdictional features while
meeting the goals of the residential development plan. Streams are not crossed multiple times by roads and all
stream crossings are as perpendicular as possible. Lots were positioned to avoid impacts to wetlands, streams,
and riparian buffers. Early iterations of the site plan included additional impacts to wetlands and riparian buffers.
After consultation between the client,engineer, and Sage,the design was revised to eliminate impacts to riparian
buffers.
General techniques include the use of construction fencing to define the construction corridor and prevent any
accidental additional impacts. Equipment will be parked and cleaned in uplands away from jurisdictional areas.
Work within jurisdictional areas will be conducted during periods when dry weather is predicted, and large bare
areas of soil will be reseeded and protected as soon as practicable. Silt fencing and sediment basins will also be
used to prevent sediment runoff into the stream and wetland areas.
Project Impacts
Total permanent wetland impacts due to culverted crossings for a road and a greenway are 0.069 acre (3,050
SF). Total temporary wetland impacts due to construction to install the greenway culvert are 0.0058 acre (256
SF). Total permanent stream impacts due to a culverted crossing and riprap for a greenway are 35 LF (280 SF/
0.006 acre). No impacts to state-regulated riparian buffers are proposed.

Mitigation
Proposed permanent wetland impacts are less than 0.1 acre and proposed permanent stream impacts are
less than 150 LF and 0.02 acre. Therefore, mitigation for impacts to Waters of the U.S. are not required nor
proposed. There are no impacts to state-regulated riparian buffers.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached 'Documented Occurrences' tables and map.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile
radius of the project area, if any, are also included in this report.
If a Federally-listed species is documented within the project area or indicated within a one-mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
(USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here:

point within the timeframe specified.If"Breeds elsewhere"is indicated,then the bird likely does not breed in your project area.
What are the levels of concern favigratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1."BCC Rangewide"birds are Birds of Conservation Concern(BCC)that are of concern throughout their range anywhere within the USA(including Hawaii,
the Pacific Islands,Puerto Rico,and the Virgin Islands);
2."BCC-BCR"birds are BCCs that are of concern only in particular Bird Conservation Regions(BCRs)in the continental USA;and
3."Non-BCC-Vulnerable"birds are not BCC species in your project area,but appear on your list either because of the Eagle Act requirements(for eagles)
or(for non-eagles)potential susceptibilities in offshore areas from certain types of development or activities(e.g.offshore energy development or

Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area,only a subset of birds of priority concern.To learn more about how your list is

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location,type and size of these
resources.The maps are prepared from the analysis of high altitude imagery.Wetlands are identified based on vegetation,visible hydrology and geography.
A margin of error is inherent in the use of imagery;thus,detailed on-the-ground inspection of any particular site may result in revision of the wetland
boundaries or classification established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery,the experience of the image analysts,the amount and quality of the collateral
data and the amount of ground truth verification work conducted.Metadata should be consulted to determine the date of the source imagery used and any
mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or field work.There may be occasional differences in polygon
boundaries or classifications between the information depicted on the map and the actual conditions on site.
Data exclusions
Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data source used to
detect wetlands.These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and

inventory.There is no attempt,in either the design or products of this inventory,to define the limits of proprietary jurisdiction of any Federal,state,or local

Each feature that is checked"Not Subject"has been determined to not be an intermittent stream,perennial stream,a
pond connected to a stream feature,or the feature is determined not to be present. Stream features that are checked
"Subject"have been located on the property and possess characteristics that qualify it to be subject to the buffer
rules. There may be other streams located on the property that do not show up on the maps referenced above and are
therefore not subject to the buffer rules. However, if the stream features are present on the tract they are subject to
all other applicable North Carolina stream standards and permitting requirements as outlined in 15A NCAC 02B and
may be considered jurisdictional according to the US Army Corps of Engineers.
This on-site determination shall expire five(5)years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty(60)days of date of this letter. A request for a determination by the
