Catawba NC 28609 Nationwide permit 14 verification request Corps Action ID: 2020-00886 / DWR Project#: 20210183 Jennifer and Stephanie: Atlas Environmental is submitting the enclosed package on behalf of Prestige Corporate Develop, for approval of a Nationwide Permit 14 verification request for unavoidable impacts to potential Waters of the United States. This submittal is for additional necessary impacts that were previously permitted and mitigated for under SAW-2020-00886 on August 15, 2022. Atlas Environmental staff was onsite for twelve days between November 18, 2019, and December 26, 2019 to delineate potential waters of the United States. The Corps approved the preliminary jurisdictional determination request on July 27, 2020. The PJD and previous permit 14/58 was issued by Krysta Stygar. The project purpose is for the construction of a residential development. This permit request is for additional impacts at three stream crossings for site access. Due to a change of the project engineer it was determined that additional impacts were necessary at three permanent road crossings for long term stability. The crossings at S1 and S3 were slightly lengthened while the impact at S2 was lengthened more to reduce the angle the stream entered the culvert. Impact S1, CH W, has been lengthened by 7 feet (0.001 Ac) from 160 LF to 167 LF. Impact S2, CH A, has been lengthened by 111 feet (0.015 Ac)from 195 LF to 306 LF. Impact S3, CH I, has been lengthened by 23 feet (0.006 Ac)from 132 LF to 155 LF. Please note that the previous respective impact numerations for these were S5, S13, and S9. The total additional impact for the plan revisions is 141 linear feet and 0.022 acre. Mitigation is proposed to be purchased from NC Division of Mitigation Services In-Lieu Fee program and the acceptance letter is attached to this request. Previous impacts were mitigated at a rate of 1.5:1 with 487 liner feet of impact requiring 730 credits. The same mitigation rate is proposed for the additional required impacts. The site has been designed and engineered to avoid and minimize impacts to the greatest extent possible while allowing for long term stability at the crossings. A change in engineers lead to an updated site plan for this project and the necessary revisions. It was determined by the engineer that revisions were necessary for long term stability at the three road crossings resulting in the necessary additional linear footage. These three road crossings are the only required permanent road crossings to access the entire 873 acre property for the proposed development. Side slopes at the road crossings are 2:1 grades to prevent and minimize erosion. Wing walls are being used for slope stability and to shorten the side slopes. Rip rap is proposed along the banks for added stability. No rip-rap is proposed below the OHWM. Enclosed are the necessary permit application documents and additional information. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended(16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the proposed project would entail the construction of a residential development on approximately 873 acres near Sherrills Ford,North Carolina. Site evaluations indicate that approximately 43,000 linear feet of stream(Terrapin Creek and its unnamed tributaries) and 3 acres of wetland occur onsite. The site lies adjacent to Lake Norman. Onsite habitats are diverse and consist of Piedmont alluvial forest, riparian forest, managed timber, recently logged areas, maintained powerline easements,unpaved roadways, cleared open space, lake shoreline, and a variety of transitional habitats. No development plans or proposed impacts to jurisdictional features have been developed at this time,but the proposed project may require authorization from the USACE and other federal agencies. Federally Listed Endangered and Threatened Species According to Service records, suitable summer roosting habitat may be present in the project area for the federally threatened northern long-eared bat(Myotis septentrionalis). However, the final 4(d)rule (effective as of February 16, 2016), exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season(June 1 —July 31). Based on the information provided, the project(which may or may not require tree clearing) would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d)rule. Although not required,we encourage the Applicant to avoid any associated tree clearing activities during the maternity roosting season from May 15—August 15. According to the information provided, suitable habitat also occurs onsite for the federally threatened dwarf-flowered heartleaf(Hexastylis naniflora) and the federally endangered Schweinitz's sunflower(Helianthus schweinitzii). To ensure that these species are not inadvertently lost, targeted surveys during the optimal survey window should be conducted where the proposed work would alter its suitable habitats. Surveys are not required where suitable habitats for this species do not occur. We appreciate the Applicant's proposal to re-survey the site for the presence of the federally threatened dwarf-flowered heartleaf(Hexastylis naniflora). Members of the genus Hexastylis may be identified by characteristic evergreen leaves present throughout the year,but flowers are required to diagnose H. naniflora. The flowering window for this protected species is typically March—May. The optimal survey window for Schweinitz's sunflower is late August to October. Population abundance (as represented from stem counts) can vary widely from year to year and animal browse (deer, rodents, etc.) may further reduce detection probability. These factors make identifying small populations particularly problematic. The southern population of bog turtle (Glyptemys muhlenbergii) is federal threatened due to similarity of appearance and is not subject to section 7 consultation. Still, we encourage the Applicant to avoid direct and indirect impacts to its habitats. This species is known to occur in open,unpolluted emergent and scrub/shrub wetlands including fens, sphagnum bogs, marshy meadows, and wet pastures. Detecting and conserving novel populations of bog turtle may prevent the need for additional regulatory protections for this animal. We encourage the Applicant to survey for this animal where its habitat occurs onsite. The Service may be available to assist in this effort if requested. Although the Service has no record of known occurrences in the immediate vicinity, the project area lies within the range of the bald eagle (Haliaeetus leucocephalus) and suitable nesting habitat may be present onsite near Lake Norman. The bald eagle has been removed from the federal list of endangered and threatened species due to its recovery. However, this species is afforded legal protection by the Bald and Golden Eagle Protection Act(16 U.S.C. 668-668d) and the Migratory Bird Treaty Act(16 U.S.C. 703-712). The Bald and Golden Eagle Protection Act, enacted in 1940, and amended several times, prohibits anyone without a permit issued by the Secretary of the Interior from"taking"bald eagles, including their parts, nests, or eggs. "Take" includes pursue, shoot, shoot at,poison, wound, kill, capture, trap, collect, molest or disturb (16 U.S.C. 668c; 50 CFR 22.3). "Disturb"means "To agitate or bother a bald or golden eagle to the degree that interferes with or interrupts normal breeding,feeding, or sheltering habits, causing injury, death, or nest abandonment." In addition to immediate impacts, these definitions also cover impacts that result from human-induced alterations around a previously used nest site during a time when eagles are not present if, upon an eagle's return, such alterations agitate or bother the eagle to a degree that interferes with or interrupts normal breeding, feeding, or sheltering habits and causes injury, death, or nest abandonment. 2 If any active nests are located within a half mile of the project site, we request that work at the site be restricted from mid-January through July in order to prevent adverse impacts to the bald eagle. This will prevent disturbance of the eagles from the egg-laying period until the young fledge, which encompasses their most vulnerable times. According to the information provided, suitable habitat does not occur onsite for any other federally protected species. Please be aware that in accordance with the Act, it is the responsibility of the appropriate federal agency or its designated representative to review its activities or programs and to identify any such activities or programs that may affect endangered or threatened species or their habitats.
