Dear Mrs. King:
We are in receipt of your letter dated May 3, 2023, indicating a Notice of Violation & Intent to issue
Civil Penalty for a Sanitary Sewer Overflow (SSO) as occurred on April 10, 2023. Please see our
response below:
The self -reported SSO that occurred on April 10, 2023, was the result of a 4" FM pipe failure,
internal to the Highway 211 Water Treatment plant sanitary sewer system. During excavation, staff
realized the 4" pipe had split at a bell & spigot joint where the piping had been joined during initial
construction. There was no indication prior to the failure of any issues with the integrity of the pipe.
If staff had any indication prior to the failure of the pipe, an assessment and repair would have been
initiated to avert a discharge of untreated waste. Staff responded quickly, isolated the damaged line,
and repaired the affected area utilizing new pipe and high-pressure fittings. Unfortunately, the
damaged pipe was adjacent to the site stormwater pond which discharges directly to Beaver Dam
creek. Staff utilized pumper trucks to remove as much of the wastewater discharge as possible and
lime stabilized the affected area. The recovered wastewater.'stormwater mixture was ultimately
disposed of at the West Brunswick Regional W WTP.
