In accordance with your request for permit renewal received by the Division on May 5, 1997, we
are forwarding herewith the subject permit to discharge under the subject state - NPDES permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated
December 6, 1983 and as subsequently amended.
If any parts, measurement frequencies or sampling require�nents contained in this permit are
unacceptable to you, you'have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made,
this decision shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of Water
Quality. Part II, EA. addresses the requirements to be followed in case of change in ownership or control
of this discharge. The Division of Water Quality may require modification or revocation and reissuance
of the permit.
This permit does not affect the legal requirements to obtain -other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required. If you have

Per 10/91 WLA, the facility should have been requested to install dechlor facilities at the
last renewal. Compliance inspection indicates that dechlor facilities are installed. Added dechlor

Removed Temperature monitoring - This is not a thermal discharge and there is no
upstream and downstream temp differences in submitted data.
Recommend renewal of NPDES permit with the above changes.

that 18 out of 42 campsites are hooked to septic tank, the bathhouse and balance of
campsites are hooked to discharge line. He will send a letter requesting old frequencies
due to hardship.
12/22 Received letter from facility requesting existing monitoring frequencies.
Sent copy to ARO to get comments.
1/13 Left a message with Bill Anderson, ARO, requesting his comments.
OK with Bill to leave the limits the same, says that he sent a memo to this effect.

Compliance data and DMR's: 10/96 chlorine values went from @2000 µg/1 to @2 µg/1.
Nothing in CF to explain why.
Instream monitoring: Cond, Temp, Fecal and DO instream is not affected by discharge.
12/2 Drafted Permit:
Removed instream conductivity monitoring.

1/6/98 Bill Anderson and Forrest Westall have no objections to leaving the monitoring the same.
Changed the monitoring frequencies back to what the facility had in the last permit.
3/3 Called Horn Lean to check on DEH concurrence. He told me to call Harold Sailor, (704)
251-6786, about status. Left a voicemail with Harold.
4/30 Left another voicemail with Harold. Called Horn Lean, DEH, to check on concurrence. He
hasn't received it from Harold yet.
511 Jerry Freeman called from DEH/PWS/ARO. Sent him the draft permit again to do a report
on DEH concurrence.
5/12 Received DEH comments
5/18 Prepared permit for issue. To DAG for signature 5/29.
Called the permittee to let them know the permit is on the way; their last one expired
11/97.

at Singing Waters Camping Resort.
Sir,
Our permit renewal was to have been effective November 30, 1997. As we had received no notification of action as of the middle of
November, I called the Asheville office to inquire the status. I was told that our application had fallen through a crack, but I should
not be concerned as it would resurface and I should receive something on it shortly. I was told that I would be able to continue to
operate the facility under parameters of the expiring permit and we would receive information on the renewal permit in the near
future.
We received a copy of notice of intent to issue a State NPDES permit on December 10, 1997 and after review of the parameters,
called the management office on the 16'h and left a voice mail with Charles at extension 511. Ms. Mary Cabe in your office
returned my call on the 18t'.
As mentioned in my discussion with Ms. Cabe, during my review of the information supplied, I was distressed to note the
monitoring requirements were more than doubled for our facility (from 2 times per month to weekly samplings).
She stated this was done to comply with regulation 2 B 0500. I am not familiar with this regulation and asked that she enlighten
me. She was kind enough to elaborate, but the change seems to be an arbitrary ruling for the mass without consideration for the
individual. I feel this will place an undue hardship on our facility and after Ms. Cabe reviewed the history of our treatment facility,
she suggested I write you and ask you to review the monitoring requirements with the possibility of a waiver of the increased
requirements.
Our limits are and have been 1) a discharge flow maximum of .0075MGD and our actual flow rarely exceeds .0030 MGD. Our
facility is located in a Campground and treats effluent from a bathhouse comprising six (6) showers, eight (8) toilets, seven (7)
lavatories, one (1) double sink in the Tenter's kitchen and two (2) washing machines for use by our campers. The plant also receives
wastes from an average of twelve (12) sewer connections for recreational vehicles on sites located along the stream. At maximum
occupancy, which occurs during three (3) major holiday weekends, there are eight (8) additional sites utilized which drop into the
treatment plant. All other full hook-up recreational vehicle sites are connected to septic tanks and field lines.
Our camping season is May 1 through October 31 of each year with the treatment facility fully operational during this period. The
facility is closed and has no treatment or discharge during the balance of the year.
Ms. Cabe's review of our reports show Bacteria, BOD and TSS counts to be well below the discharge limitations and daily maximum
limitations.

The proposed increased monitoring requirements in the permit renewal will more than double the laboratory costs and will cause an
undue financial burden on the operation of the campground which will cause an increase in the cost of using the facility by the
public and a continuing upward spiral in inflation which affects everyone. All in the name of generalizing rules to cover the mass
and not considering the individual.
With the history of our facility, I ask that you consider the individual and appeal to you to grant a waiver of the increased monitoring
frequencies and continue the monitoring requirements as listed in our current permit.

STATE NPDES PERMIT
On the basis of thorough staff review anc
application of Article 21 of Chapter 143,
General Statutes of North Carolina, Public
Law 92-500 and other lawful standards and
regulations, the North Carolina Environ-
mental Management Commission proposes
to issue a permit to discharge to the per-
sons listed below effective 1/19/98 and sub-
ject to special conditions.
Persons wishing to comment upon or
object to the proposed determinations are
invited to submit same in writing to the
above address no later than 1/2198. All com-
ments received prior to that date will be
considered in the formulation of final deter-
minations regarding the proposed permit. A
public meeting may be held where the
Director of the Division of Environmental
Management finds a significant degree of
public interest in a proposed permit.

1. NPDES No NC0032808. Ms. Cindy M.
Ensley, Rt. 1, 505 Racking Cove Road, Sylva,
NC 28779, has applied for a permit renewal
for a facility located at Ensley Rest Home on
Racking Cove Road, south of Addle,
Jackson County. The facility discharges
0.0085 MGD of treated domestic wastewater
from one outfall into Blanton Branch, a
Class C stream in the Little Tennessee River
Basin which has a 7010 flow of 0.6 cfs. No
parameters are water quality limited, but
this discharge may affect future allocations.
2. NPDES No NC0038687. Curtis P. and
Christine A. Cooper, 1005Trout Creek Road,
Tuckasegee, NC 28783, have applied for a
permit renewal for a facility located at
Singing Waters Camping Resort, on NCSR
1131, northwest of Cashiers in Jackson
County. The facility discharges 0.0075 MGD
of treated domestic wastewater from one
outfall into Trout Creek, a Class WS-111 Trout
stream in the Little Tennessee River Basin
which has a 7Q10 flow of 3.10 cfs. Chlorine
is water quality limited and dechlorination
is required. For some parameters, the avail-
able Ioad capacity of the immediate receiv.
Ing water will be consumed. This may affect
future water quality based. effluent limita-
tions for additional dischargers within this
portion of the watershed.
3. NPDES No NC0075736. Whiteside
Estates, P.O. Box 849 Highlands, NC 28741
has applied for a permit renewal for a pro-
posed facility to be located at Whiteside
Estates Wastewater Treatment Plant, SR
1143, west of Cashiers, Jackson County.
The facility, when built, will discharge 0.10
MGD of treated domestic wastewater from
one outfall into Grassy Camp Creek, a Class
WS-111 stream in the Little Tennessee River
Basin which has a 7Q10 flow of 0.43 cfs and
a 30Q2 flow of 0.8 cfs. BOD5,TSS, ammonia,
and dissolved oxygen are water quality lim-
ited. For some parameters, the available
load capacity of the immediate receiving
water will be consumed. This may affect
water quality based effluent limitations for
additional dischargers within this portion of
the watershed.

LITTLE TENNESSEE RIVER BASIN

The Lower Little Tennessee River subbasin is located in the northern portion of the basin.
Fontana Lake, operated by the Tennessee Valley Authority, is the largest impoundment in this
region. Much of the catchment to the north of the Little Tennessee River is within either the
Great Smoky Mountains national park or the Cherokee Indian Reservation. Most streams on the
north side of Fontana Lake are in a roadless wilderness region, and can be reached only by boat
or by hiking. This portion of the basin contains some of the most famous trout streams in North
Carolina including Hazel Creek, Forney Creek, Deep Creek, and Noland Creek. Most of the rest
of this subbasin is included -in the Nantahala National Forest, although this does not preclude
some other land uses. This subbasin includes the Towns of Bryson City, Cherokee, and Sylva.
Principal tributaries to Lower Little Tennessee River are the Oconaluftee and Tuckasegee Rivers,
Hazel Creek and Deep Creek.

RECOMMENDED MANAGEMENT STRATEGIES
Two Support -Threatened streams include Scott Creek and Beech Flats Prong. Scott Creek, near
the town of Sylva, is a tributary to the Tuckasegee River impacted largely by nonpoint source
pollution. Potential pollutants must be identified. Local governments, agencies, and nonpoint
source team members, may be good resources for identifying problems and solutions. Headwaters
of Beech Flats Prong was impacted by US441 construction in Great Smoky Mountains National
Park exposing Nankeesta rock formations resulting in low pH values and heavy metal
concentrate nsrINltional Park Service does not have funds to remedy this situation.

The Bear Creek Reservoir watershed has HQW classifications throughout most of its headwaters.
Greenland Creek is ORW. Much of southeast corner of this subbasin in the headwaters of
Tuckasegee River is also designated as a water supply. Cedar Cliff, Bear Creek, and Thorpe
reservoirs are classified water supply. Thorpe Reservoir is also proposed for an individual
management strategy (15A NCAC 2B .0303) which would be similar to HQW classification.
Many waters within Cherokee Indian Reservation have HQW classifications. There is need for
increased communication and cooperation with Cherokee Indian Reservation officials. Continued
pressure to build and urbanize these areas will require attention to best management practices for
construction and long term planning of urban areas.
Fontana Lake has both WS and HQW classifications in various areas around lake. Development
around lake will need to be monitored closely to insure that sedimentation and nutrient enrichment
of reservoir does not occur.
