Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General 'Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit includes one significant change from the draft permit sent to you on August 3, 2011.
This addition was made after the Division received comments regarding the reissuance. of the permit
from the North Carolina Wildlife Resources Commission (NCWRC). The NCWRC expressed its
concern regarding both ammonia nitrogen limits for this facility and the ammonia nitrogen .
concentrations being discharged into the receiving stream as depicted on self -monitoring reports. Such
concentrations may be harmful to endangered and protected aquatic species known to populate this
portion of the Cape Fear River Basin. As a result, condition A. (4.) has been added to the final version
of the permit, a condition that states the permit maybe reopened to impose increased monitoring
frequencies and/or stricter effluent limitations for ammonia nitrogen in the event that the facility exhibits
consistent noncompliance with the established effluent limits.
You are reminded of the following changes in this permit from the terms and conditions found in the
previous permit, as were noted in the letter accompanying the draft permit:
• Parameter codes have been added to the list of characteristics to be monitored.
• The parameter Total Suspended Residue has been renamed Total Suspended Solids.
• A condition has been added regarding the monitoring, reporting and compliance determination of
Total Residual Chlorine values in the event that the ultraviolet disinfection system fails and chlorine
compounds are used for disinfection.

• A reopener condition has been added regarding the potential to require additional nutrient
monitoring to support water quality modeling efforts within the Cape Fear River basin.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

2. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/L.
3. Total Residual Chlorine monitoring requirements and limits are applicable only if chlorine
compounds are used for disinfection.See.Condition A. (2.) for instructions should the facility's
permitted UV system fail and an alternate means of disinfection is required.
4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2.) TEMPORARY MEANS OF DISINFECTION
In the. event that the wastewater treatment plant's ultraviolet (UV) disinfection system should fail,
underperform, or otherwise .be removed from effective service, the permittee or his agent. should
immediately inform the Surface Water Protection Section staff of the Raleigh Regional Office of this
development and discuss temporary, alternate means for disinfection of the effluent.
If chlorine compounds are used as temporary means of disinfection, the total residual chlorine (TRC)
concentration of the effluent must be monitored on a daily basis while this method of disinfection is in
use and values must be reported on the discharge monitoring report. TRC in the effluent may not
exceed 28 µg/L; therefore, dechlorination methods may also be necessary to ensure protection of water
quality in the receiving stream.
In the event that TRC monitoring should occur, the Division shall consider all effluent TRC values
reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to
record and submit all values reported by a North Carolina certified laboratory (including field
certified), even if these values fall below 50' µg/L. .
Use of a disinfection system other than the permitted UV system during circumstances not deemed as
emergency and/or temporary (replacement of lamps, lamp cleaning.or maintenance, etc.) will be
considered"a violation of the terms of this permit.
A. (3.) PERMIT RE -OPENER: NUTRIENT MONITORING
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North
CarolinaAdministrative Code at 15A NCAC 2H.0112 (b) (1) and 211.0114 (a) and Part lI sections B-
12 and B-13 of this permit, the Director may reopen this permit to require supplemental nutrient
monitoring of the discharge. The purpose of the additional monitoring will be to support water quality
modeling efforts within the Cape Fear River Basin and shall be consistent with a monitoring plan
developed jointly by the Division and affected stakeholders. In addition, the results of water quality
modeling may require that. limits for Total Nitrogen and Total Phosphorus be imposed in this permit
upon renewal.
A. (4.) PERMIT RE -OPENER: AMMONIA (NH3 as N) NONCOMPLIANCE '
To help ensure the viability of Habitat for endangered species and species of special concern known to
live within the portion of the Cape Fear River Basin where this discharge occurs, in the event that the
facility exhibits consistent noncompliance with permit effluent limits for ammonia nitrogen, the permit
may be reopened for the purpose of imposing increased monitoring frequencies and/or stricter effluent
limitations for this parameter. For the purposes of this section, consistent noncompliance shall be
defined as any noncompliance with effluent limitations (monthly average or daily maximum limits)
that occurs during three consecutive months or during any four of six consecutive months.

SUBJECT: Draft NPDES Permit for Chatham County Schools, Bonlee Elementary School WWTP,
Chatham County, NPDES Permit No. NCO039331
Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject
document. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as
amended), Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North
Carolina General Statutes (G.S. 113-131 et seq.), and North Carolina Administrative Code 15A NCAC
10I.0102.
Chatham County Schools has applied for a renewal of their NPDES permit to discharge treated
wastewater into Bear Creek. Bonlee Elementary School WWTP is a 0.007 MGD facility that uses
ultraviolet light for disinfection. The monthly average ammonia -nitrogen (NH3 as N) limit is 2.0 mg/L
for April 1-October 31, and 4.0 mg/L for November 1-March 31. The daily maximum ammonia -nitrogen
limit is 10 mg/L for April 1-October 31 and 20 mg/L for November 1-March 31.
Bear Creek is a tributary to Deep River in the Cape Fear River basin. There are records for the
federal and state endangered Cape Fear shiner (Notropis mekistocholas); the federal species of concern
and state endangered Carolina creekshell (Villosa vaughaniana) and brook floater (Alasmidonta
varicosa); the federal species of concern and state special concern Carolina darter (Etheostoma collis); the
state threatened creeper (Strophitus undulatus); the state special concern notched rainbow (Villosa
constricta); and the state significantly rare Eastern creekshell (Villosa delumbis) in Bear Creek.
We are pleased to see the facility uses ultraviolet disinfection and the provisions regarding the use
of chlorine for temporary disinfection included in Section A. (2.). However, we are concerned about
ammonia -nitrogen in the effluent and its impact on aquatic resources. A review of reported ammonia -
nitrogen in the effluent showed that between April 2008 and May 2010 the facility exceeded its monthly
average limit on 8 occasions and its daily maximum limit on 2 occasions. It appears the facility is capable
of removing ammonia -nitrogen from the effluent. For example, in April 2010, the reported minimum was
0 mg/L, the maximum was 0.44 mg/L and the average 0.22 mg/L.

Fish and mussel species are very sensitive to ammonia. Dwyer et al. (2005) found that Cape Fear
shiners had an IC25 of 8.8 mg/L for ammonia. An IC25 is the level at which an organism exhibited a 25
percent reduction in a biological measurement such as reproduction or growth after a 7-day exposure.
Also, freshwater mussels are one of the most sensitive aquatic organisms tested for impacts from
ammonia. Augspurger et al. (2003) found that ammonia concentrations which may be protective of
freshwater mussels range from 0.3 to 1.0 mg/L total ammonia as N at pH 8.
Should the permit be issued, we offer the following recommendations to minimize impacts to
aquatic resources and in particular to listed species.
Daily maximum ammonia -nitrogen limits (NH3 as N) of no more than 6.0 mg/L (April 1-October
31) and 12.0 mg/L (November 1-March 31).
2. More frequent monitoring of ammonia -nitrogen (e.g., two times per week). We are concerned
that monitoring.twice per month is not sufficient for documenting compliance or for identifying
malfunctions in the facility's equipment.
3. If not already in place, we suggest the installation of a stand-by power system.
4. Connect the facility to a municipal wastewater system if one is available. If a municipal
wastewater system is not available, then upgrade the facility to improve reliability to ensure that it
remains in compliance with all permit limits.

Subject: Proposed NPDES Permitting Actions for 2011 Permit Renewals
Cape Fear River Basin
In January 2011, BIMS was queried to ascertain those permitted facilities in the Cape Fear Basin
exceeding a subjective compliance threshold (>_5 civil penalty assessments or >_10 NOVs issued within
the last 3+ years). Thisresulted in the identification of 26 facilities for possible permitting actions. A list
of the facilities was routed to the 5 regional offices in the Cape Fear Basin for staff recommendations. A
summary of the recommendations are included below. Assigned permit writers should incorporate
recommended actions or conduct follow-ups with the regions and/or the appropriate ROC as necessary.

to eliminate discharge via connection to the new North Harnett regional plant in a couple of
years.

3. NC0058548, Star WWTP (permit assigned to Jim M.) — No action recommended. Problems
caused by a lack of flow to the plant (loss of industry).

action recommended. This is an older plant that does not have a clarifier. The operators would
like a small clarifier added to the treatment plant, but the owners will not make the purchase.
Region feels this would be a good candidate for an Administrative Order (Special Order without
Consent).

Major 1/1 work has been done at the plant. It is scheduled to close and tie in to the North
Harnett regional plant in the next few years. Region feels this would be a good candidate for an

This is a well operated, 100% domestic plant. Good compliance during the past year.

Compliance problems relate to plant design flaws and construction issues. For the most part,
issues have been resolved or a work -around established. Permit writer may want to follow-up
with the region.
3. NC0020702, Wallace WWTP (permit assigned to Ron B.) — No action recommended. Past
compliance issues attributed to poor 0&M by the old ORC. Facility is now operating under an
SOC and a new plant is under construction. Plant has 1/1 issues that should be resolved with the
new plant.
4. NC0056863, Rose Hill WWTP (permit assigned to Jackie N.) — Special condition requesting a
solids depth survey and submittal of a plan for solids removal; follow-up with the region. Lack
of proper 0&M (ex., solids volume maintenance and proper oversight of treatment
volume/detention in the oxidation ditch) is attributed to compliance issues. Because the facility
is classified as a major, need to consider increasing monitoring frequency and adding daily limit
requirements. Currently, influent monitoring is controlled by the effluent meter. Need a
special condition inserted in renewed permit that upon expansion or significant upgrade that
this issue is addressed.
FACT SHEET FOR EXPEDITED PERMIT RENEWALS
This form must be completed by Permit Writers for all expedited permits which do not require
full Fact Sheets. Expedited permits are generally simple 100% domestics (e.g., schools, mobile
home parks, etc) that can be administratively renewed with minor changes, but can include
facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing,
instream monitoring, compliance concerns).
