Department of Transportation, 113 Airpoi•t Drive, �denton, NC' 27932 Perniit Number 22-15 Authorizing development in Hertford County at Ahoskie Creek, Bridge No. 33 on NC 42 , as requested in the permittee's application dated 9/17/14, including the attached workplan drawings (41: 2 dated 9/11/14, 1 dated 9/12/14, and 1 dated as received on 9/29/14. This permit, issued on 2/16/15 , is subject to compliance with the application (where consistent f �vith tlie permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ; be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. • z � 1) 2) Bridge Replacement In accordance with commitments made by the permittee in the perinit application, turbidity curtains shall be installed along the creek Uanks at the bridge abutments. The authorized activities shall not result in any permanent or teinporary impacts to wetlands or waters of the State, without permit modification, except for the installation and removal of bridge piles. 3) The bridge shall be constructed using top down construction methodologies �vith an offsite detour. Any other construction method may require additional authorization from the N.C. Division of Coastal Management (DCNI). (See attached sheets for Additional Conditions) This permit action may be appealed by tlie permittee or other c�ualified persons within twenty (20) days of the issuing date. Tllis permit must be accessible on-site to Department personne] when the project is inspected for compliance. Any maintenance work or project modifcation not covered hereunder requires further Division approval. All work must cease when the pernlit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastai Management Program. Department of Transportation Permit #22-1� Page 2 of 3 � ADl)ITIONAL CONDITIONS 4) All reasonable efforts shall be made to contain all debris and eYCess materials associated with the autharized activities with the intent that materials and debris do not enter wetlands or waters of the State, even temporarily. �) The installation and removal of the bridge piles shall be accomplished by pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of installation, such as jetting or drilled shaft construction, additional authorization from DCM shall be required. 6) Pilings in open water from the existing bridge, as ��vell as any remnant pilings from previous bridges, shall be removed in their entirety, except that in the event that a bridge piling breaks during removal and cannot be removed in its entirety, the bridge piling may be cut off flush with the bed of the water body, and DCM shall be notified of each occurrence within one working day. 7) The placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material shall be clean and free from loose dirt or any pollutant except in trace quantities. 8) Any waste materials and debris associated with construction, demolition, or other activities shall be disposed of at an approved upland site or shall be recycled in an environmentally appropriate manner provided appropriate authorizations axe obtained from any relevant state, federal, or local authorities. 9) All excavated materials shall be confined above normal water level and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 10) Live concrete shall not be allowed to contact waters of the State or water that will enter �vaters of the State. 11) All construction access shall be through the use of the existing bridge, the partially constructed new bridge, and/or existing high ground areas. Utility Relocations NOTE: The construction of the new bridge �vill also require the relocation of water and po�ver lines. No impacts to wetlands or waters of the State will result from the utility relocations. 12) Any utility work associated with this project that is not specifically depicted on the attached workplan drawings, or described within the attached permit application, shall require approval from DCM, either under the authority of this permit, or by the utility company obtaining separate authorization. � NOTE: Plans and specifications for the relocation and/or replacement of potable water supply lines must be submitted to the N.C. Division of Water Resources, Public Water Supply Plan Review Section for approval prior to construction. Final approval must be issued befo �e water mains are placed into service. N.C'. Department of Transportation ADDI'g'IONAI, CON�ITIONS Sedimentation and Erosion Control Permit #22-1� �age 3 of 3 13) This project shall conform to all requirements of the N.C. Sedimentation Pollution Control Act and the N.C. Department of Transportation's (NCllOT's) Nlemorandum of Agreement with the N.C. Division of Energy, Mineral, and Land Resources. 14) 15) 16) Gei�eral No attempt shall be made_by the pennittee to prevent the �full and free use by the public of all navigable waters at or adjacent to the authorized work following completion of construction. During bridge construction, the permittee shall make every attempt to maintain the same navigation that is currently possible in Ahoskie Creek, upstreain and downstream of the existing bridge. The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. . 17) If it is deterinined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. 18) 19) Development authorized by this permit shall only be conducted on lands o��ned by NCDOT and/or its right-of ways and/or easements. " The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in Elizabeth City at (252) 264-3901 to request a preconstruction conference prior to project initiation. NOT�: The N.C. Division of Water Resources detennined that there is no 401 Water Quality Certification required for this project. However, compliance with the conditions of General Permit - NCGO 1000 is required to ensure compliance with state water quality standards and the National Pollutant Discharge Elimination System (NPDES) requirements of the Clean Water Act. NOTE: NOTE: The U.S. Army Corps of Engineers issued a determination of No Authorization Required on 1/12/15 (COE Action ID No. SAW-2015-00077). This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required.
