Dear Mr. Finnegan,
This is with reference to the request received by Bryan Hall, Field Representative, to refine State Permit No.
73-22, which was issued to Joel Hartzler on July 7, 2022, that includes a three (3) slip docking facility and
dredging at 108 Teakwood Drive, adjacent to the Carolina Beach Yacht Basin, in Carolina Beach, New
Hanover County. A Letter of Refinement was issued October 11, 2022 to modify the location of the gazebo.
State Permit No. 73-22 is due to expire on December 31, 2025.
The action proposed in your request consists of a change in spoil location due to a change in contractor as
explained in the request (dated as received by DCM 2/21 /23). The authorized spoil location at 7617 Carolina
Beach Road is unavailable. Mr. Finnegan proposes to modify the spoil location to use the upland portion of
the Shore Acres Island that is regularly used for spoil placement in New Hanover County. Attached with his
request is the "Purchase Order" granting permission for the placement of spoil on the Shore Acres Island
(dated as received by DCM 2/21123),
Upon reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No.
73-22 as described in your request dated received February 21, 2023. Please note this refinement does not
alleviate the need to obtain any other local, state or federal permits.

Good morning Bryan,
First, I would like to thank you for your assistance around this matter. Per our conversation, I
would like to modify the state major permits #73-22 and #74-22 at the neighboring properties of
106 Teakwood and 108 Teakwood in Carolina Beach, NC. The property owners to which the
permits have been issued are Joel Hartzler of 108 Teakwood and Kris Swiger of 106 Teakwood
Modification of this permit is solely to request a new spoil location of Shore Acres Island in
Wilmington, NC. The original contractor had provided their own spoil location that was not given
as an option to North End Marine Construction therefore we are looking to change the spoil
location to complete this dredge project. The spoils will be deposited on Shore Acres at their
designated location.
