Enclosed are two copies of a completed preconstruction notification (PCN) application package
for Nationwide Pemlit No. 29, Residential Development, for the proposed development of the
subject property as a residential subdivision, located in east Glayton, in Johnston County. By
copy of this letter, we also submit seven copies of this PCN to the North Carolina Department of
Natural Resources (NCDENR) Division of Water Quality (DWQ) for review and written
concurrence under Water Quality Certification No. 3631.
On December 6, 2004, Mike Horan of -DWQ documented a wetland, stream and buffer
determination on the subject property. The DWQ response letter and maps are enclosed for
NBRRO #04-0300 and DWQ Project No. 04-917. The wetland delineation was done by S&ME,
but while DWQ concurred on the wetland boundaries, no wetland data forms or documentation
has been found. tf necessary, field review of the wetland delineation and further documentation
can be provided at your convenience. A USACE jurisdictional determination form has been
completed for the proposed impacts and is included with this application package.
Project Description:
The proposed subdivision, Eas# Village of Clayton, is located in Johnston County, east of
Clayton, immediately west of the junction ofi eastbound NC 42 with US 70. The proposed

subdivision drains to an unnamed tributary to the Neuse River. The subject site is currently
mostly wooded with existing unpaved access roads and some disturbed areas. The propased
project construction will include 282 residential lots, three stormwater basins, and approximately
20,433 linear feet of paved roads. Mechanical clearing, grading and cut and fill will be used to
construct the roads, stormwater management basins, sewer lines and buildings.
The subject project area consists of 112.24 acres of wooded and partially cleared, undeveloped
land, and is located on the northwest quadrant of the intersection NC 42 east with US 70. The
general project vicinity map is shown on Figure 2. The subject property is shown on the USGS
Topographic Quadrangle map, Clayton, N.C. on Figure 1, and on an excerpt from the USDA
MRCS Johnston County Soil Survey map (Sheet 1), on Figure 3. An aerial photograph also
shows the site on Figure 4. Figures 5, 6 and 6A show the proposed road crossings and existing
wetlands. The reference reach for the proposed project is shown on Figure 7. The proposed
site plan is enclosed on paper and on compact disk, which shows the locations of the proposed
roads with culvert locations, stormwater detention basins, wetland and stream- impacts and the
proposed subdivision lot layout. The Natural Heritage Program (NHP) database maps and
documentation for the subject site are also enclosed.
Proposed Project Environmental Impacts:
The subject property consists of three tracts of land, totaling approximately 112.24 acres. There
are approximately 25 acres of wetlands on the subject property, and approximately 4000 linear
feet of jurisdictional stream channels. Only 0.1227 acres of wetlands will be impacted for road
construction, and 801inear feet of jurisdictional stream will be impacted #or a road crossing. No
riparian buffer impacts are proposed. Figure 5 shows a proposed road crossing with an 80-foot
long 60 inch diameter reinforced concrete pipe (RCP) in a non jurisdictional channel which
drains the proposed stormwater basins. in Figure 6, 0.101 acre of wetland impacts are shown
due to unavoidable impacts from the proposed main access road, along with 0.0217 acre of
linear wetland impacts due to the same road, where a 156 foot long 1$ inch diameter RCP will
be installed to maintain effective drainage.
No federal or state listed species will be adversely impacted by the development of the subject
property. A search of the Natural Heritage- Program (NHP) database was performed on August
10, 2007 and only one countywide element occurrence for the loggerhead shrike was found for
the subject site. The NHP database did not show any observations of federally or state listed
plant or animal species or their critical habitats within 1 mi{e of the subject property.
impact Just cation:
Wetland, stream and stream buffer impacts have been avoided and minimized to the maximum
extent practicable by the proposed subdivision road and lot layout. The main entrance road was
shifted to minimize buffer, stream and wetland impacts to the greatest extent practicable. In
order to avoid Neuse River Basin riparian buffer impacts and to avoid work in the 100 foot
riparian buffer required by the Clayton Watershed Protection Overlay District, the minor impacts

to the wetland areas considered unavoidable. The wetlands on the northeast part of the
property as shown on Figure 6A were avoided completely. The existing wetlands are disturbed
wet flats and marginally meet the parameters set in the 1987 USACE Wetland Delineation
Manual. The streams on the property are mostly relatively permanent waters with ordinary high
water marks, but currently have no water flowing due to the drought. A sign cant nexus is
assumed, due to the proposed stormwater basins and proposed impervious surface in the
development.

III. Project Information
Attach a vicinity map cleazly showing the location of the property with respect to local
landmazks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundazies and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the properly
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be cleazly identifiable on an accompanying site

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Subdivision layout and road crossing locations were designed to minimize and avoid
wetland, stream and riparian buffer zones to the greatest extent practicable. Location of wetland
areas allowed almost total avoidance except for main road into subdivision.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment aze minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or .preserving similaz
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USAGE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Cazolina, available at
http:i/h2o.enr.state.nc. us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/lineaz feet)

This section summarizes information regarding characteristics of the tributary and its adjacent wetlands, if any, and it helps
determine whether or not the standards for jurisdiction established under Rapanos have been met.
The agencies will assert jurisdiction over non-navigable tributaries of TNWs where the tributaries are "relatively permanent
waters^ (RPWs), i.e. tributaries that typically flow year-round or have continuous flow at least seasonally (e.g., typically 3
months). A wetland that directly abuts an RPW is also jurisdictional. If the aquatic resource is not a TNW, but has year-round
(perennial) flow, skip to Section III.D.2. If the aquatic resource is a wetland directly abutting a tributary with perennial flow,
skip to Section III.D.4.
A wetland that is adjacent to but that does not directly abut an RPW requires a significant nexus evaluation. Corps districts and
EPA regions will include in the record any available information that documents the existence of a significant nexus between a
relatively permanent tributary that is not perennial (and its adjacent wetlands if any) and a traditional navigable water, even
though a significant nexus finding is not required as a matter of law.
If the waterbody4 is not an RPW, or a wetland directly abutting an RPW, a JD will require additional data to determine if the
waterbody has a significant nexus with a TNW. [f the tributary has adjacent wetlands, the significant nexus evaluation must
consider the tributary in combination with all of its adjacent wetlands. This significant oe:us evaluation that combines, for
analytical purposes, the tributary and all of its adjacent wetlands is used whether the review area identified in the JD request is

C. SIGNIFICANT NEXUS DETERMINATION
A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed
by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity
of a TNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of its adjacent
wetlands, has more than a speculative or insubstantial effect on the chemical, physical and/or biologieal integrity of a TNW.
Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow
of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent
wetlands. It is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a
tributary and its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland lies within or
outside of a floodplsin is not solely determinative of significant nexus.
