In our earlier phone conversations, you asked if you could get the Beaverdam Road property, or part of the property,
approved under the low- density conditions of the WQ Certification and later add more development density even above
the 24% specification. It is my opinion that that option would be available to the present or future land owner. Changing
to a high density development would require additional stormwater treatment and approval from the Division of Water
Resources, but I see nothing in the existing 401 Certification conditions (WQC No. 3890) that would prevent that
option. Please note that I am not an attorney and this is not a legal determination. This is just my interpretation of the
stormwater treatment provisions of the 401 certification process.
