Dear Mr. Elnitsky:
A review has been made of the report entitled "Request for waiver of NCAC 2K .0205 (d)" for
Belews Creek Active Ash Basin Dam (STOKE-116). The report, authored by Mr. Douglas W.
Carr, PE of URS Corporation, is dated April 27, 2015 and was received by this office on April
28, 2015. The report presents a hydrologic and hydraulic (H&H) analysis as well as a
geotechnical analysis. The report concludes that even though the structure is not capable of
draining 80-percent of the design storm runoff volume within 15 days, it is capable of containing
two consecutive 72 hour PMP storm events while maintaining additional freeboard. This finding
provides evidence that no significant risk of overtopping under the current spillway configuration
exists. Therefore, the variance to requirements of 15A NCAC 2K .0205 (d) is granted in
accordance with 15A NCAC 2K .0205 (e).
In addition, we concur with the findings of the stability analysis presented in the geotechnical
portion of the report which indicates that the dam embankment meets the requirements of 15A
NCAC 2K .0208 (b).
