Dear Mr. Brower:
On September 18, 2007, the Division of Water Quality (DWQ) received your application dated
March 20, 2007, to fill or otherwise impact 5301inear feet of intermittent stream (temporary
impact) and 54,400 square feet of Zone 1 Neuse River basin protected riparian buffers and
15,400 square feet of Zone 2 Neuse River basin protected riparian buffers to replace
approximately 4,850 feet of aging 8" sanitary sewer with a new 12" sanitary sewer and to
rehabilitate or replace existing manholes. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional
information requested below, we will have to move toward denial of your application as required
by 15A NCAC 2H .0506 and will place this project on hold ~s incomplete until we receive this
additional information. Please provide the following information so that we may continue to
review your project.
Additional Information Requested:
1. Please indicate all riparian buffer impacts on the site plan and clearly label impacts
(Buffer Impact 1, etc.). Additionally, please provide plan and profile for aerial stream
impacts (only four are shown on the plans, i.e., Plan Sheet C-7). Please identify where
the other four crossings are shown on the PCN.
2. Please explain why your stream impact table lists intermittent streams that are as wide as
47 feet which would likely indicate a perennial stream.

3. Stream crossing between MH32 and MH31 appears to be outside of the 75° to 105°
threshold. Please provide additional information on this crossing as well as where the
bankfull/floodplain is located. Severe bank destabilization can be caused by a non-
perpendicular aerial crossing that is located too low on the floodplain.
4. Please provide a buffer impacts mitigation plan since mitigation is required for:
- parallel impacts in Zone 1
- perpendicular crossings of streams that disturb > 1501inear feet of buffer.
- perpendicular crossings of streams that disturb greater than 401inear feet of buffer
but equal to or -less than 1501inear feet of buffer with a maintenance corridor greater
than 10 feet in width.
Please submit this information within 30 calendar days of the date of this letter. If we do not
receive this requested information within 30 calendar days of the date of this letter, your project
will be withdrawn and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian
