Location description: The proiect area is located on the south side of Country Lane, and the east side of US Highway 601
(Yadkinville Road), in Mocksville, Davie County, North Carolina.
Description of projects area and activity: This verification authorizes the permanent discharge of dredged or fill material into
0.029 acre (345 linear feet) of stream channel (0.0194 acre [230 linear feet] of which results in the permanent loss of waters)
and 0.047 acre of riparian non-riverine wetlands, and the temporary discharge of dredged or fill material into 0.010 acre (112
linear feet) of stream channel and 0.021 acre of riparian non-riverine wetlands, necessary for the construction of access and
infrastructure for the Nelson's Creek at Mocksville residential development.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
Conditions, your application signed and dated 1/20/2023, additional information received via email on 3/20/2023, and the
enclosed plans "Nelson's Creek at Mocksville Subdivision" Sheet Nos. 1-4 and "Nelson's Creek Phase 2 — Construction Plat"
Sheet No. C2.0. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a
stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general
permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided
it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization
expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon
the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the
date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior
to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State

SPECIAL CONDITIONS
1. Authorized temporary wetland and stream impacts must be restored to original grade and
contour and seeded with native riparian or wetland seed mix (per "Nelson's Creek Phase 2 —
Construction Plat" Sheet No. C2.0). Disturbed stream banks must be matted with biodegradable
matting as appropriate.
2. Please note that future impacts and/or phases of the Nelson's Creek at Mocksville residential
development, and related activities associated with Corps Action ID: SAW-2022-00168, may be
considered part of a single and complete project; these impacts may be considered cumulative
with impacts authorized during earlier phases with respect to compensatory mitigation and
Nationwide Permit thresholds. Current cumulative impacts to waters of the US for the Nelson's
Creek at Mocksville single and complete project include 0.0194 acre [230 linear feet] of stream
channel and 0.047 acre of riparian non-riverine wetlands, or a total loss of 0.066 acre of waters of
the US.

Stream Crossing Construction Sequence
(Frontiersman Drive)
Place silt fence around stream side and downstream side of by-pass channel.
Construct by-pass channel with lining as shown with the stream banks still in place at upper and
lower ends. This channel is to be stabilized immediately after construction.
In one work day remove lower "dam" extending lining as necessary. Remove upper "dam"
extending lining. Build a temporary sandbag dam across the stream to force flow into the by-
pass channel. Wrap the upstream side of the dam with plastic to reduce seepage through the
dam.
4. Construct culverts with headwalls as shown except that wing walls on the south side of the
culvert pipe will be delayed. Place fill (properly compacted) between pipes, on each side of
pipes and to at least one foot above the top of each pipe. If during construction of the pipes
and headwalls pounded water collects, it shall be pumped out through a silt sack.
5. Divert stream flow to pipes. Fill by-pass ditch with compacted soil.
6. Construct south side end walls.
7. Complete grading of road including water line, sewer line (if applicable), and low point storm
drain.
S. If a rain event during the construction of the culverts causes any ponded water within the
disturbed area, it is to be pumped out through a silt sack.
9. All grading activity will follow the stabilization schedule set on Sheet CD3.

INCLUDES THE REMOVAL OF THE WELL HOUSE SUPPLY LINES AND ALL MATERIALS FT 1N THE
ABANDONMENTLE H BOREHOLE/WELL. THE TOP FIVE FEET SHALL
BE BACKFILLED WITH MATERIAL APPROPRIATE FOR THE INTENDED LAND USE. THE WELL SHALL BE ABANDONED IN ACCORDANCE WITH THE NORTH CAROLINA

CONSTRUCTION COMMENCING. PRIOR TO CONSTRUCTION, THE REGISTERED PROFESSIONAL ENGINEER (PE) AND THE UTILITY CONTRACTOR SHALL
ATTEND A PRE -CONSTRUCTION MEETING WITH TOWN OF MOCKSVILLE. THE OWNER/DEVELOPER MAY ATTEND THIS MEETING IF DESIRED.
2) ONCE THE PROJECT IS APPROVED BY THE NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY (NCDEQ) THEN WILL MARK THE UTILITY
PLANS "RELEASED FOR CONSTRUCTION." THE UTILITY CONTRACTOR MUST WORK OFF THE UTILITY PLANS RELEASED. IF THE UTILITY CONTRACTOR
IS WORKING FROM OTHER PLANS THEN THE CONSTRUCTION MUST STOP UNTIL THE UTILITY PLANS MARKED "RELEASED FOR CONSTRUCTION" ARE
ISSUED BY TOWN OF MOCKSVILLE.
RECORD WILL REVIEW ALL SHOP DRAWINGS FOR CONFORMANCE WITH TOWN OF
3) THE DEVELOPERS ENGINEER OF REC MOCKSVILLE SPECIFICATIONS
PRIOR TO SUBMITTAL TO TOWN OF MOCKSVILLE. THE SHOP DRAWING SUBMITTAL TO TOWN OF MOCKSVILLE SHALL INCLUDE A COVER LETTER BY
THE DEVELOPERS ENGINEER OF RECORD CERTIFYING CONFORMANCE WITH TOWN OF MOCKSVILLE SPECIFICATIONS AND SUMMARIZING ANY

4) ALL WATER MAINS, VALVES, FITTINGS AND APPURTENANCES SHALL BE HYDROSTATICALLY TESTED AS PER TOWN OF MOCKSVILLE SPECIFICATIONS.
5) ALL WATER SAMPLES FOR BACTERIA TESTING WILL BE COLLECTED BY THE CONTRACTOR AND WITNESSED BY A REPRESENTATIVE OF TOWN OF
MOCKSVILLE.
6) THE CONTRACTOR WILL COORDINATE WITH THE TOWN OF MOCKSVILLE, UTILITY CONSTRUCTION INSPECTOR TOWN OF MOCKSVILLE FOR REGULAR
INSPECTION VISITATIONS AND ACCEPTANCE OF THE SYSTEM.
7) THE DEVELOPER SHALL, AT HIS EXPENSE, RETAIN THE SERVICES OF THE ENGINEER OF RECORD FOR THE PURPOSES OF PROVIDING NECESSARY
INSPECTIONS AND SUPERVISION OF THE CONSTRUCTION WORK, RECORD DRAWINGS AND ENGINEER CERTIFICATIONS. THE ENGINEER IS
RESPONSIBLE TO INSURE THAT CONSTRUCTION IS, AT ALL TIMES, IN COMPLIANCE WITH ACCEPTED SANITARY ENGINEERING PRACTICES AND THE

VALVE MARKERS, WATER METER SETTERS, FIRE HYDRANTS, BLOW OFF ASSEMBLIES, MANHOLES, SEWER CLEAN OUTS, AIR RELEASE VALVES, AND
SEWER LIFT STATIONS AS INSTALLED BY THE CONTRACTOR.
10) A DIGITAL COPY OF THE "RECORD DRAWINGS" MUST BE SUBMITTED TO TOWN OF MOCKSVILLE. PREFERABLY, THE DIGITAL COPY OF THE
"RECORD DRAWINGS" SHOULD BE PRODUCED IN AUTOCAD (.DWG) OR (.DXF) FORMAT.
11) THE "RECORD DRAWINGS" THAT INCLUDE GRAVITY SEWER LINE EXTENSIONS, SEWER LIFT STATION(S) AND/OR SEWER FORCE MAINS WILL
CONTAIN THE FOLLOWING DETAILED INFORMATION:
A. LOT NUMBERS THAT WILL BE SERVED BY THE SEWER SYSTEM WILL BE CLEARLY IDENTIFIED ON EACH PAGE OF THE "AS -BUILT" OR
"RECORD" DRAWINGS,
9 B. THE DISTANCE FOR EACH SEWER SERVICE LATERAL SHALL BE MEASURED FROM THE DOWN GRADE MANHOLE ALONG THE SEWER
MAIN TO THE CONNECTING WYE AND ASSOCIATED SEWER CLEANOUT FOR EACH LOT,
9 C. THE DIRECTION FOR EACH SEWER SERVICE LATERAL SHALL BE MARKED AS LEFT OR RIGHT FACING UP GRADE FROM THE NEAREST
DOWN GRADE MANHOLE.
B. DIRECTIONAL ARROWS SHALL BE PLACED ON EACH SEWER LINE (GRAVITY AND FORCE MAIN) ON THE OVERALL LAYOUT SHEET FOR EACH
PHASE OR SECTION OF THE SEWER SYSTEM.
12) THE ENGINEER WILL SUBMIT IN WRITING THAT ITEMS 1 THROUGH 11 ARE COMPLETE AND THAT WARRANTY WILL BEGIN ON THE DATE WHEN
THE SYSTEM HAS BEEN ACCEPTED BY NCDEQ AND TERMINATE 12 MONTHS THEREAFTER.
13) THE CONTRACTOR WILL NOTIFY TOWN OF MOCKSVILLE WHEN THEY ARE READY TO BEGIN FILLING IN LINES AND COORDINATE THIS WITH THE
TOWN OF MOCKSVILLE, UTILITY CONSTRUCTION INSPECTOR TOWN OF MOCKSVILLE.
14) PRIOR TO ACCEPTANCE, ALL SERVICES WILL BE INSPECTED TO INSURE THAT THEY ARE INSTALLED AT THE PROPER DEPTH. ALL METER BOXES
MUST BE FLUSHED WITH THE GROUND LEVEL AND THE SETTERS ARE TO BE A MINIMUM OF 8" BELOW THE BOX LID,
INDICATING THE TOTAL COST OF THE WATER AND/OR SEWER SYSTEMS
15) THE ENGINEER WILL PROVIDE A STATEMENT IN OS / (. )
16) WATER SERVICE WILL BEGIN ONLY UPON SUBMISSION OF FINAL CERTIFICATION AND WARRANTY ACCEPTANCE BY THE DISTRICT.
17) UPON RECEIPT OF FINAL CERTIFICATIONS, A COPY WILL BE FORWARDED TO TOWN OF MOCKSVILLE, UTILITY CONSTRUCTION INSPECTOR TOWN

18) THE DEVELOPER/CONTRACTOR WILL BE JOINTLY RESPONSIBLE FOR ANY REPAIRS MADE DURING THE WARRANTY PERIOD. TOWN OF
MOCKSVILLE WILL PROVIDE MAINTENANCE WHEN REQUESTED AND BILL THE DEVELOPER/CONTRACTOR.
19) TOWN OF MOCKSVILLE REQUIRES THAT THE CURRENT WATER AND SEWER SYSTEM DEVELOPMENT FEES BE PAID IN ACCORDANCE WITH THE
LATEST TOWN OF MOCKSVILLE WATER AND SEWER USE ORDINANCE.
20) FIRE HYDRANTS ARE INSTALLED AT CERTAIN ELEVATIONS. ANY GRADE CHANGE IN THE VICINITY OF ANY FIRE HYDRANT WHICH IMPEDES ITS
OPERATION SHALL BECOME THE RESPONSIBILITY OF THE DEVELOPER FOR CORRECTION. CORRECTIONS WILL BE MONITORED BY THE TOWN OF
MOCKSVILLE UTILITY CONSTRUCTION INSPECTOR AND THE TOWN OF MOCKSVILLE FIRE MARSHAL.
21) ALL FIRE HYDRANTS INSTALLATIONS IN TOWN OF MOCKSVILLE MUST MEET ALL REQUIREMENTS ESTABLISHED BY THE TOWN OF MOCKSVILLE
FIRE MARSHAL'S OFFICE. ALL FIRE HYDRANTS INSTALLATIONS MUST BE INSPECTED BY TOWN OF MOCKSVILLE DEPUTY FIRE MARSHAL. THE
CONTRACTOR SHALL NOTIFY AT THE FIRE MARSHAL ONCE THE CONSTRUCTION IS COMPLETE TO REQUEST A SITE INSPECTION OF ALL FIRE
HYDRANTS INSTALLATIONS.
MAINTENANCE OF EROSION CONTROL MEASURES
SILT FENCE MAINTENANCE - INSPECT SEDIMENT FENCES AT LEAST ONCE A WEEK AND AFTER EACH RAINFALL. MAKE ANY REQUIRED REPAIRS IMMEDIATELY.
SHOULD THE FABRIC OF A SEDIMENT FENCE COLLAPSE, TEAR, DECOMPOSE OR BECOME INEFFECTIVE, REPLACE IT PROMPTLY.
REMOVE SEDIMENT DEPOSITS AS NECESSARY TO PROVIDE ADEQUATE STORAGE VOLUME FOR THE NEXT RAIN AND TO REDUCE PRESSURE ON THE FENCE. TAKE
CARE TO AVOID UNDERMINING THE FENCE DURING CLEANOUT.
REMOVE ALL FENCING MATERIALS AND UNSTABLE SEDIMENT DEPOSITS AND BRING THE AREA TO GRADE AND STABILIZE IT AFTER THE CONTRIBUTING
DRAINAGE AREA HAS BEEN PROPERLY STABILIZED.
SILT FENCE OUTLETS - SHALL BE INSPECTED AT LEAST WEEKLY AND AFTER EVERY SIGNIFICANT RAINFALL. IF DAMAGED, THEY SHALL HAVE FABRIC, POSTS OR
WIRE BACKING REPLACED TO RESTORE TO ORIGINAL CONDITION.
TREE PROTECTION FENCE MAINTENANCE - CONTINUE TO CARE FOR THE SITE UNTIL THE NEW OWNER TAKES POSSESSION. TAKE THESE STEPS AFTER ALL
MATERIALS AND EQUIPMENT HAVE BEEN REMOVED FROM THE SITE:
-REMOVE TREE PROTECTION ZONE FENCES.
-PRUNE ANY DAMAGED TREES. IN SPITE OF PRECAUTIONS, SOME DAMAGE TO PROTECTED TREES MAY OCCUR. IN SUCH CASES, REPAIR
ANY DAMAGE TO THE CROWN, TRUNK, OR ROOT SYSTEM IMMEDIATELY.
-REPAIR ROOTS BY CUTTING OFF THE DAMAGED AREAS AND PAINTING THEM WITH TREE PAINT SPREAD PEAT MOSS OR MOISTTOPSOIL
OVER EXPOSED ROOTS.
-REPAIR DAMAGE TO BARK BY TRIMMING AROUND THE DAMAGED AREA AS SHOWN IN
FIGURE 6.05D, TAPER THE CUT TO PROVIDE DRAINAGE, AND PAINT WITH TREE PAINT.
-CUT OFF ALL DAMAGED TREE LIMBS ABOVE THE TREE COLLAR AT THE TRUNK OR MAIN BRANCH. USE THREE SEPARATE CUTS AS SHOWN
IN FIGURE 6.05D TO AVOID PEELING BARK FROM HEALTHY AREAS OF THE TREE.
CONTINUE MAINTENANCE CARE. PAY SPECIAL ATTENTION TO ANY STRESSED, DISEASED, OR INSECT -INFESTED TREES. REDUCE TREE
STRESS CAUSED BY UNINTENDED CONSTRUCTION DAMAGE BY OPTIMIZING PLANT CARE WITH WATER, MULCH, AND FERTILIZER WHERE APPROPRIATE.
CONSULT YOUR TREE EXPERT IF NEEDED.
INFORM THE PROPERTY OWNER ABOUT THE MEASURES EMPLOYED DURING CONSTRUCTION,
WHY THOSE MEASURES WERE TAKEN, AND HOW THE EFFORT CAN BE CONTINUED.

CHECK THE STRUCTURE FOR DAMAGE FROM EROSION OR PIPING. PERIODICALLY CHECK THE DEPTH OF THE SPILLWAY TO ENSURE IT IS A MINIMUM OF 1.5
FEET BELOW THE LOW POINT OF THE EMBANKMENT. IMMEDIATELY FILL ANY SETTLEMENT OF THE EMBANKMENT TO SLIGHTLY ABOVE DESIGN GRADE. ANY
RIPRAP DISPLACED FROM THE SPILLWAY MUST BE REPLACED IMMEDIATELY.
AFTER ALL SEDIMENT -PRODUCING AREAS HAVE BEEN PERMANENTLY STABILIZED, REMOVE THE STRUCTURE AND ALL UNSTABLE SEDIMENT. SMOOTH THE

SEDIMENT BASINS - INSPECT TEMPORARY SEDIMENT BASINS AT LEAST WEEKLY AND AFTER EACH SIGNIFICANT (1/2 INCH OR GREATER) RAINFALL EVENT AND
REPAIR IMMEDIATELY. REMOVE SEDIMENT AND RESTORE THE BASIN TO ITS ORIGINAL DIMENSIONS WHEN IT ACCUMULATES TO ONE-HALF THE DESIGN DEPTH.
PLACE REMOVED SEDIMENT IN AN AREA WITH SEDIMENT CONTROLS.

AND DISLODGE THE DEBRIS AND RESTORE FLOW. IF THIS DOES NOT WORK, PULL THE SKIMMER OVER TO THE SIDE OF THE BASIN AND REMOVE THE
DEBRIS.ALSO CHECK THE ORIFICE INSIDE THE SKIMMER TO SEE IF IT IS CLOGGED; IFSO REMOVE THE DEBRIS.
IF THE SKIMMER AND/ OR BARREL PIPE IS CLOGGED, THE ORIFICE CAN BE REMOVED AND THE OBSTRUCTION CLEARED WITH A PLUMBER'S SNAKE OR BY
FLUSHING WITH WATER. BE SURE AND REPLACE THE ORIFICE BEFORE REPOSITIONING THE SKIMMER.
CHECK THE FABRIC LINED SPILLWAY FOR DAMAGE AND MAKE ANY REQUIRED REPAIRS WITH FABRIC THAT SPANS THE FULL WIDTH OF THE SPILLWAY. CHECK

Water Act (CWA) (33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403).
This preliminary determination is not an appealable action under the Regulatory Program Administrative
Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an
appealable action, by contacting the Corps district for further instruction. Please note, if work is authorized by
either a general or nationwide permit, and you wish to request an appeal of an approved JD, the appeal must be
received by the Corps and the appeal process concluded prior to the commencement of any work in waters of
the United States and prior to any work that could alter the hydrology of waters of the United States.
