Town of Boone Water System Improvements
Dear Mr. Ward:
On March 30, 2015, the Division of Water Resources — Water Quality Programs (Division)
received your application dated March 12, 2015, requesting a 401 Water Quality Certification
from the Division for your project Additional information was received by the Division on May
13, 2015. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until all of the following information is received:
1. The additional information received on May 13, 2015 included a recorded Deed
providing access rights to the new intake structure. The deed indicates that the access
is granted provided that the Town construct a "Subdivision Road" and to allow for
future private use of the road and to connect driveways or other roads or install or
connect utilities.
The purpose of this project as described in the PCN document indicates that the road is
for access to the Water Intake Structure. In addition, the applicant was previously asked
to clarify that the width of the access road was minimized for the proposed purpose.
Please provide clarification or more information to reconcile this information and
provide documentation of the project limits and the purpose and need as determined
by the USACE so that the Division may evaluate compliance with 15A NCAC 02H
.0506(f).

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three,
copies of all of the above requested information to the Wetlands, Buffers, Stormwater —
Compliance and Permitting (Webscape) Unit, 1617 Mail Service Center, Raleigh, NC 27699-
1650.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
