Hi Zach, and thank you for your le?er. Upon review of the project PCN, our request for addi?onal informa?on to the
applicant dated 2/14, our field review of the project delinea?on where addi?onal poten?al waters of the US were
located, and the associated revised project plans and impact proposals yet to be received from the applicant, the Corps
has determined that all nine (9) components listed in Sec?on 121.5(b) have not been received. As such the Reasonable
Period of Time (RPOT) per the 2020 Clean Water Act Sec?on 401 Cer?fica?on Rule has not begun since. It is our
expecta?on that the RPOT for this project will begin once the above referenced informa?on is received; we will no?fy
you accordingly per the 9/16/2022, Programma?c Agreement (PA) between the USACE and the NCDWR. Please let me
know if you have any ques?ons.
