DCM Federal Consistency CD17-018
The purpose of this letter is to request modification of the Clean Water Act (CWA) Section 404
Individual Permit (IP) and Section 401 Water Quality Certification for R-3300B to authorize impacts to
facilitate construction of a driveway at Permit Site 19. The gated driveway is needed to provide access to
NCDOT owned Parcels 82 and 87. There parcels were originally going to be accessible via SR8, which
was eliminated from the project after NCDOT purchased the property. Alternatives to avoid and minimize
additional impacts associated with the driveway have been considered and are outlined below.
Impacts to Jurisdictional Resources
Impacts to jurisdictional wetlands and surface waters for R-3300B are summarized below in Tables 1 - 3.
Revisions in impacts for this permit modification request are shown in red (new impacts) and green
(revised) . No additional surface water impacts are proposed and there are no changes in utility impacts.

Permanent Impacts: The proposed driveway impacts will include an additional 0.129 acres of permanent
roadway fill, 0.012 acres of mechanical clearing converted to roadway fill, and 0.035 acres of
mechanized land clearing to non-riparian wetlands. Proposed permanent impacts for R-3300B include fill,
excavation, and mechanized clearing in wetlands. This includes impacts to 16.743 acres of riparian
wetlands and 53.907 acres of non-riparian wetlands. Proposed permanent impacts to streams are 6,170
linear feet.
Temporary Impacts: No changes to temporary impacts are proposed with this modification. There is 0.758
acre of temporary impacts to riparian wetlands for R-3300B. Proposed temporary impacts to surface
waters are 530 linear feet.
Hand Clearing: No changes to hand clearing impacts are proposed with this modification. The hand
clearing totals due to the project construction are 0.318 acres.

Avoidance and Minimization
Final designs were adjusted to avoid and/or minimize impacts to jurisdictional areas. NCDOT employs
many strategies to avoid and minimize impacts to jurisdictional areas in all its designs. Many of these
strategies have been incorporated into BMP documents that have been reviewed and approved by the
resource agencies and which will be followed throughout construction. All wetland areas not affected by
the project will be protected from unnecessary encroachment. Individual avoidance and minimization
items are as follows:
Permit Site 19
Driveway – Sta. 11+04 to 12+31 -DRW3-
Driveway was sized and placed to minimize impacts to wetlands. An equalizer pipe is being placed to
connect the two sides of the existing wetland.

Driveway – Sta. 14+61 to 15+54 -DRW3-
Driveway entrance area was strategically placed to limit wetland impacts. An equalizer pipe is being
placed across the driveway to connect the two sides of the existing wetland. A portion (0.012 acres) of the
mechanical land clearing associated with Site 19 impacts (769+74 to 854+07 -L1-) has been converted to
permanent fill.
Additional Impacts: Roadway Fill 0.021 acres
(0.012 acres currently permitted as MC; net additional impact is 0.009
acres)
Mechanical Clearing 0.010 acres
Total Additional Impacts
Roadway Fill 0.129 acres
Mechanical Clearing 0.035 acres
Summary of Mitigation
The additional 0.164 acres of non-riparian permanent wetland impacts associated with this modification
request will be offset with the credits acquired for the 2.02 acres of non-riparian permanent wetland
impacts that were eliminated from the project with the removal of SR8 in the modification request dated
October 21, 2021. With this modification, the overall reduction in wetlands impacts for this project is
now 1.856 acres.
Regulatory Approvals
Section 404: We are, therefore, requesting the modification of the USACE Individual 404 Permit signed
August 10, 2017 (SAW-2007-1386), for the above-described activities.
Section 401: We are hereby requesting a modification to the 401 Water Quality Certification from the
NCDWQ issued June 5, 2017 (20161268). In compliance with Section 143-215.3D(e) of the NCAC, we
will provide $570.00 to act as payment for processing the Section 401 permit modification.
CAMA: A copy of this application is being provided to the NC Division of Coastal Management for
review in accordance with their Federal Consistency determination
