HomeMy WebLinkAboutCorps R-3300B Mod 04-17-2023DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 May 9, 2023 Regulatory Division Action ID No. SAW-2007-1386 North Carolina Department of Transportation Division 3 Attn: Mr. Mason Herndon 5501 Barbados Blvd Castle Hayne NC 28429 Dear Mr. Herndon: Reference the Department of the Army (DA) Individual Permit signed and dated August 10, 2017 (SAW-2007-1386) for U-4751 & R-3300B issued to the North Carolina Department of Transportation (NCDOT) for impacts associated with the construction of the Hampstead Bypass in Pender County, North Carolina. (TIP Project U-4751 & R- 3300B). Also reference your permit modification request letter and attachments received on April 17, 2023, in which NCDOT requested to modify impacts to jurisdictional waters and wetlands at Site 19 (PD-29) to facilitate construction of a gated driveway needed to provide access to Parcels 82 and 87 owned by NCDOT. These parcels were originally going to be accessible via SR8, which was eliminated from the project after NCDOT purchased the property. Specifically, the proposed driveway impacts will include an additional 0.129 acres of permanent roadway fill, 0.012 acres of mechanical clearing converted to roadway fill, and 0.035 acres of mechanized land clearing to non-riparian wetlands. No changes to temporary impacts are proposed with this modification. No additional surface water impacts are proposed and there are no changes in utility impacts. Following the evaluation of information submitted in the modification request, the Corps has determined that the request is appropriate and reasonable, is not contrary to the public interest, and no Public Notice is required. Therefore, the permit is modified as requested with the following requirements: a) that work associated with this modification must be constructed as shown on the updated plans submitted in association with the modification request sent on April 17, 2023; b) NCDOT shall obtain all required Local, State, and Federal permits for this modification prior to conducting the requested work; and c) the following special condition regarding additional compensatory mitigation is hereby incorporated into the permit 17April 2023 Mod - The -2- additional 0.164 acres of non-riparian permanent wetland impacts associated with this modification request will be offset with the credits acquired for the 2.02 acres of non- riparian permanent wetland impacts that were eliminated from the project with the removal of SR8 in the modification request dated October 21, 2021. With this modification, the overall reduction in wetlands impacts for this project is now 1.856 acres. All other conditions of the permit, including the permit expiration date remain in effect as written.
