HomeMy WebLinkAbout20150316 Ver 1_More Info Letter_20150414A&� NCDENR North Carolina Department of Environment and Natural Resources Pat McCrory Governor April 14, 2015 CERTIFIED MAIL: 7014 2120 0000 8057 7743 RETURN RECEIPT REQUESTED North Carolina Coastal Federation Attn: Lexia Weaver 3609 Hwy 24 Newport, NC 28584 Subject: REQUEST FOR ADDITIONAL INFORMATION Cape Carteret Stormwater Ponds retrofit Dear Mrs. Weaver: Donald R. van der Vaart Secretary DWR # 150316 Carteret County On March 26, 2015, the Division of Water Resources (Division) received your application dated March 24, 2015, requesting a 401 certification to retrofit existing stormwater ponds to restore them back to marsh (fresh and salt) as well as restoring a stream segment for Deer Creek. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. This Office believes that the upper pond does not need to be disturbed, as it has naturalized and the marsh and stream seem to be stable. Please provide justification as to why this area needs to be graded and disturbed instead of just enhancing the existing wetland and stream that has naturalized there. (15A NCAC 02H .0506(f) & (g)) 2. This Office is concerned about the water hyacinth found in the lower pond. There is no mention of what protocols will be used to eradicate this invasive species. Please provide documentation pertaining to what will be done to prevent the spreading of this invasive species to other areas. (15A NCAC 02H.0506(b)) Pursuant to Title 15A NCAC 02H .0502(e) the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. Please be aware that you have no authorization under the Isolated Wetlands and Isolated Waters Rules for this activity and any work done within waters of the-state may be a violation of North Carolina General Statutes and Administrative Code.
