Town 1 Mixed Use Center is a combination of the Hambright Road and Mt. Holly Huntersville Road Projects. Atlas Environmental completed a stream and wetland delineation on August 11 and 18, 2023 and November 14, 2022. Preliminary jurisdictional determinations for Hambright Road and Mt. Holly Huntersville Road were submitted on May 02, 2023. There is a total of one perennial stream, two intermittent streams, and four wetlands within the review area. The project purpose is for the construction of a mixed-use development consisting of multi-family units, townhomes, commercial buildings, office buildings, and storage space. The development will require six permanent unavoidable impacts to potential Waters of the United States. Impact S1 consists of 600 linear feet(0.039 acre) of permanent fill to intermittent stream CH 100 and Impact S2 consists of 35 linear feet (0.002 acre)of permanent fill to intermittent stream CH 2O0. Wetland impacts include W1 as permanent fill to WL 1100 (0.030 acre), W2 as permanent fill to WL 2000 (0.023 acre), W3 as permanent fill to WL 1000H (0.027 acre), and W4 as permanent fill to WL 1000M (0.037 acre). All stream and wetland impacts are for the construction of the multi-family residential units, parking, and grading. In total there are proposed to be 635 linear feet (0.041 acre)of permanent stream impacts and 0.117 acre of permanent wetland impacts. Mitigation for wetlands impacts will be provided for this project as wetland impacts exceed 0.10 acre of wetlands. Mitigation for stream impacts will be provided as impacts exceed 0.02 acre of stream. A mitigation ratio of 1:1 for stream impacts is being proposed due to the impacted features being intermittent and having a low NC SAM rating. Wetland mitigation is being proposed at a 2:1 ratio. The project has been designed and engineered to avoid and minimize impacts to the greatest extent possible. No perennial channels are proposed to be impacted and approximately 868 linear feet of intermittent streams are being avoided. A retaining wall of approximately 383 linear feet is proposed to be constructed Northwest of channel CH 100 to avoid additional impacts to this channel. A vegetative buffer surrounding the unimpacted stream sections is to remain undisturbed. Additionally, 19,216 square feet of riparian buffer is proposed to be restored and 21,051 square feet of riparian buffer is proposed to be preserved as part of the project.
