Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The site is an existing 0.32-acre single family residential lot platted in 1981 with an existing home built in 1990. The lot borders homeowner association land with an existing maintained sanitary sewer line which borders "Greystone Lake" (aka Ammons Lake). The hillside between the house and the sanitary sewer easement has been landscaped and maintained with low growing ornamental plants and shrubs. The general land use in the vicinity of the project are other single family residential lots. 3b. Proposed Activity Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used: The owner had their existing home renovated last year (2022). All renovations were done outside of the Neuse Buffer with the exception of a retaining wall that was added just inside Zone 2 of the Neuse Buffer. The City of Raleigh has asked the owner to obtain authorization from the NCDWR for this retaining wall (after -the -fact). The purpose of the retaining wall was to stabilize the hillslope and provide a level ground close to the home to assist the aging homeowners. All other surfaces within the Neuse Buffer being the "Steps", etc. were pre-existing. The only work done within Zone 1 was planting new and maintenance of existing ornamental landscape plants (existing use/activity). The provided GoogleEarth aerial image provides evidence of the pre-existing landscaping conditions. Note that most of Zone 1 falls within the 30' City of Raleigh maintained sanitary sewer easement and only a couple feet extend up the toe of landscaped hillside. We believe that the 70 s.f. of new retaining wall which was added to Zone 2 is classified as "allowable upon authorization" either as 15A NCAC 02B .0714(11)(V)(i) or possibly (11)(s). D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project. All renovations made to the house were done outside of the 50' Neuse Buffer with the exception of 70 s.f. of retaining wall which was placed only within Zone 2 to minimize disturbance to the buffer. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The contractor who constructed the wall used best management practices and erosion control measures (ground cover, etc.) to ensure to protect the buffer and offsite Greystone Lake. E. The assumption had been since they had been maintaining and landscaping the hillside for years that any such improvements were exempt as existing uses. It wasn't until the City of Raleigh was provided the asbuilt survey and notified the applicant that they were made aware of the need to possibly obtain DWR authorization. G.
