Dear Ms. Majstoravich:

The Pretreatment, Emergency Response, and Collection Systems (PERCS) Unit of the Division of Water Quality has reviewed the recent revisions made to the City of New Bern Sewer Use Ordinance
(SUO). The draft SUO was received by the Division on July 23, 2012.

The review indicates, with the observation below, that the SUO revisions are adequate and the minimum requirements of 15A NCAC 2H .0900 and 40 CFR 403 are met. Please forward a copy
of the final SUO to the PERCS upon adoption, including the applicable documentation of adoption along with copy of attorney statement.

Sec. 74-156, Civil Penalties: On page 13, we noticed there is a typo. It would be “civil penalty of up to twenty-five thousand dollars ($25,000) per day…” as opposed to $10,000.
Adjudicatory Hearings: Please remove Adjudicatory Hearings sections (74-220 through 74-223) from “Division 5. Wastewater Discharge Permits” and make a separate Division for these sections.
