This correspondence is in reference to the Yadkin 01 Umbrella Mitigation Bank, Brushy
Mountain Mitigation Site Year 4 Annual Monitoring Report received November 24, 2022 and
updated March 16, 2023, submitted in support of your request for the MY4 credit release. The
Brushy Mountain Site is located on Macemore Road, three miles south of Elkin, in Yadkin
County, North Carolina, within the Yadkin River Basin Cataloging Unit (03040101). This 23.29
acre project involves stream and wetland restoration, enhancement and/or preservation of
approximately 5,593 linear feet of stream and 5.31 acres of wetland, with the goal of generating
5,130 Stream Mitigation Units (SMU's) and 4.75 Riparian Wetland Mitigation Units (WMU's).
The purpose of this letter is to provide comments on the reports and to confirm the release of
credits from the Bank pursuant to the completion of required tasks, as described in Section VII,
of the Mitigation Banking Instrument (MBI) for this project.
Although the IRT did not visit this site in 2022, we have reviewed the Year 4 Monitoring
Report and did not identify any outstanding concerns associated with overall performance of the
bank. We did note some items and recommend that these areas be monitored for future
evaluation and noted in future reports.
1. Submittal of your updated/corrected cover letter, wetland credit schedule and
performance bond was received.
2. Continue to update in future monitoring reports the success of supplemental live stakes
planted along approximately 1,300 linear feet of UT-1 and UT-2 on December 9, 2019.
3. Given the duration of inundation at a few of the wetland gauges, make sure to include at
least one random vegetation plot in this area for MY5.
4. Continue to report any instability in the area of UT XS 8 and UT2 XS 1.
5. In future Current Conditions Plan View, please indicate which monitoring wells and
potential veg plots (or any other problem areas such as encroachments) that do not meet
performance criteria.
6. In future monitoring reports please include a monthly precipitation summary with WETS
comparison for quick analysis of below, at or above average precipitation site conditions.
7. We would like to visit Brushy Mountain after MY5 report submittal before potential
credit release. Please coordinate a site visit when an anticipated MY5 report submittal
date is known.
With regard to the annual credit release, the Mitigation Banking Instrument (UMBI)
entitled, Yadkin 01 UMB-Brushy Mountain Mitigation Site, approved January 25, 2019,
stipulates that five percent (5%) of the Bank's total credits for streams and wetlands shall be
available for sale after submittal of the fourth -year monitoring report, provided the channel is
stable and all other success measures are met. Another five percent (5%) of bank stream credit is
available if the project meets the bankfull event criteria laid out in the final mitigation plan. By
copy of this correspondence, we confirm that you have satisfied the above requirements for these
credit releases and 513 SMU's and 0.238 WMU's are now available for sale.
