Please see the below listed items. 1) 401 Certification 2) Discuss the possibility of developing an upfront settlement agreement. 3) If we can agree to try to development an agreement, the following items will minimally need to be addressed in the agreement: a) Upfront penalty and costs b) Stormwater Management (retrofit or off site solutions) c) Restoration (restore impacted wetlands, stream, buffers) d) Develop solutions to unauthorized impacts and violations of the 1999 401 Cert.
