You asked me to email you some of the topics that we will want to
discuss during the meeting regarding Heritage Pines on Junel4th. Please
see the below listed items.
1) 401 Certification
2) Discuss the possibility of developing an upfront settlement
agreement.
3) If we can agree to try to development an agreement, the
following items will minimally need to be addressed in the agreement:
a) Upfront penalty and costs
b) Stormwater Management (retrofit or off site solutions)
c) Restoration (restore impacted wetlands, stream, buffers)
d) Develop solutions to unauthorized impacts and violations of the
1999 401 Cert. (wetlands, streams, buffers, diffuse flow etc)
e) Mitigation
f) Preservation/conservation easements (on site vs off site)
g) Monitoring (restoration monitoring)
h) Implementation Schedule (dates and time lines)
i) Stipulated penalties for missed dates.
