Dear Mr. Tugwell:
On behalf of the owner, K. Hovnanian Homes of North Carolina, Inc., we are providing you notice of the
owner's intent to stop additional work on a portion of the subdivision until the Individual Permit is
approved by your office. The owner intends to stop work on all proposed residential lots within Phase 5
that are located in areas that previously contained jurisdictional wetlands or waters. The attached drawing
shows the approved wetland delineation overlaid on the proposed Phase 5 lot layout. No additional work
(except possible erosion and sediment control measures required to stabilize the site) will occur in the
location of lots 176, 177, 180, 181, 182, 183, 184, 185 and 186. Also, no additional work will occur on
the section of the proposed street that fronts lots 181 to 185. Work will continue on the remainder of Phase
5 in locations that did not previously contain wetlands or waters. We are currently working on the draft
application for the Individual Permit and expect to have it ready for your review soon. It is the owner's
intention to ensure full compliance with wetland regulations.
