As per my voice message that I left with Danny yesterday, Mark Miller of K.
Hovnanian Homes has authorized S&EC, PA to inform you that they wish to
proceed with the Upfront Settlement Agreement (USA) as discussed during our
meeting on June 14, 2005. We understand that DWQ will be drafting the
initial document for our review. Please confirm via a response to this
email that you have received this request and let us know when we should
expect to receive the draft USA. As you know, we have a site meeting
scheduled for July 6th at 9 am. Do you anticipate that we will be receiving
the draft USA prior to or after this meeting? We appreciate the DWQ working
with our client to resolve the compliance issues at Heritage Pines and want
to stress K. Hovnanian's and Mr. Miller's eagerness to comply with all DWQ
and USACE regulations. Please contact me if you require any additional
information regarding this matter.
