On May 12, 2005, the Division of Water Quality (DWQ) rece ved your after-the-fact application dated May 2, 2005 to impact 2.407 acres of wetlands, 337 feet of sir6ams, and 1.858 acres of open waters to construct the proposed adult residential subdivision. The DWIP\has determined that your application was incomplete and/or clarification is necessary to properly review Your application as discussed below. The DWQ will require additional information in order to process yout:application to impact protected. wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: It is requested that you present information addressing the current status of the conditions described in the original 401 Water Quality Certification dated August 8, 1999: 1. Please detail whether wetland impacts in areas 11, 7, and 8, as required in August 8, 1999 401 Water Quality Certification were avoided. If these areas were not avoided as required in the certification, please explain why they where impacted and whether any portion of these areas may be restored. 2. Please detail whether the 0.22 acres of wetlands shown on the August 2, 1999 map by Gilleece and Associates between lots 8 and 10 were restored or created. If these areas were not properly restored as required in the certification, please explain why, and whether any portion of these areas may be restored. 3. A condition of the 401 Certification was that stormwater shall be directed to sheetflow at non- erosive velocities through the protected stream buffer. Please detail whether stormwater has been direct to sheetflow, or if it has been conveyed into drop inlets and piped to surface waters. Please clearly explain the diffuse flow status of this site and how you propose to resolve and/or retrofit controls to address this issue. 4.
