The Division of Energy, Mineral and Land Resources(DEMLR)has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form,received on April 28,
2023. The Division is unable to concur with your certification of no exposure.
Based on previous correspondence from the Raleigh Regional office,the Division cannot grant your
requested exemption from permit coverage when industrial activities or materials are exposed or have the
potential to be exposed.A previous inspection by the Raleigh Regional Office on January 101,2023,
found that fueling operations and exposed oil& grease drums disqualify this facility from a No Exposure
Exclusion. Please apply for coverage under an NPDES General Permit.Information can be found at
deo.nc.tov/SW-industrial.Within 60 days of this letter
