Dear Hunter Wines, I have reviewed the PCN for the above referenced project and have the following questions/comments that need to be addressed. 1. Based on the information provided in the PCN, the applicant is requesting the use NWP 39 to conduct the proposed activities, which would result in a loss of 0.07 acre of stream bed. Per Regional Condition B. 5., NWPs may not be used for activities that result in the loss of more than 0.05 acres of stream bed, except of NWP 32. As such it appears that the project as proposed does not qualify for authorization under NWP 39 as requested. a. You may apply for the proposed project via the Standard Permit process, or, as an alternative, you may further avoid or minimize impacts to meet the conditions of NWP 39. 2. Per General Condition 2, no activity may substantially disrupt the necessary life cycle movements of those species of aquatic life indigenous to the waterbody, including those species that normally migrate through the area, unless the activity's primary purpose is to impound water. All permanent and temporary crossings of waterbodies shall be suitably culverted, bridged, or otherwise designed and constructed to maintain low flows to sustain the movement of those aquatic species. In order to verify compliance with GC 2 please provide profile sketches depicting the proposed culverts. Please submit the above information within 30 days of receipt of this Notification or we may consider your application withdrawn and close the file.
