Thanks for your PCN and attached plans, dated 5/1/2015 and received 5/4/2015, for the above referenced project. I
have reviewed the information with respect to verification of a Nationwide Permit 29 and offer the below comments to
be addressed before your application can be considered complete. Please submit the requested information (via e -mail
is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide
Permit or consider your application withdrawn and close the file:
1) The boundaries of Wetland WA /WAA were expanded during Wednesday's JD verification site visit. Please flag the
new wetland boundaries in the field and send the updated wetland field sketch to my attention. Further, upon GIS
review (see attached) at the office it appears that the southwest section of the property (not reviewed on Wednesday) is
in a geomorphic position that commonly includes wetlands; please confirm whether or not this area was reviewed
during any of your site visits and, if so, describe /document the conditions with respect to the 3 wetland parameters.
Also, please update the PCN, plans, and other necessary documents as necessary and send to my attention.
[RE: MTB] Please find the attached revised PCN and plans addressing revision of wetland WA /WAA boundary during
recently conducted USACE site verification. Additionally, please find the attached data form, collected from the lowest
lying area within the drainage swale located on the southwestern portion of the site. Pictures from the data point
location are also attached for your review. Likewise, since the initial submittal, the City of Greensboro has provided
documentation in regards to potential surface water riparian buffers. This documentation is also attached to the
updated PCN.
2) Section D1a (pertaining only to the lot layout) on your PCN does not entirely address avoidance and minimization of
adverse effects to Waters of the US as required by Nationwide Permit Conditions # 23 a and b. As briefly discussed
during our field meeting on 5/13/2015, more information is required to address the practicability of completely avoiding
impacts to the wetlands in question while still accomplishing your project purpose of constructing a residential
subdivision. For example, could Lots 69 and 70 be combined into one lot in order to avoid wetland impacts? Is the
purpose of wetland fill in lots 63, 64, and 68 related to the dwelling and or access to the lot, or simply for lot (backyard)
fill? If the latter, would the lot still be usable without filling those wetland fringe areas, as they occur along the back of
the lots? One way to show practicability would be to overlay a typical building envelope for both the dwelling and
access (driveway) on these lots, in addition to other considerations such as setbacks, to show whether or not the
proposed fill is related to the dwelling /access or simply backyard fill.
[RE: MTB] Please find the attached revised PCN and plans that further detail avoidance and minimization.
3) With respect to PCN section F7b, and given that the HPOWEB shows a two potential historic properties close to the
project area, have you contacted SHPO to request their comments about the proposed project?
[RE:MTB] As indicated on the attached PCN, the NC SHPO has not been contacted in regards to the proposed project.
Based on a review of the HPOweb, one surveyed property (GF 1414 - Jefferson Academy) is identified within the
proposed project area. The HPOweb does not identify this property as being listed on the National Register of Historic
Places. Furthermore, based on our field observations, the residence has not been maintained for a significant amount of
time and has deteriorated to dilapidated conditions. Photographs of the dilapidated residence are included with the
attached revised PCN. Other residential properties identified by HPOweb as surveyed are located on adjacent property
east of the site, across Birch Creek Road (GF- -house and GF0458 Charles D. Cobb house) and on adjacent property west
of the site (GF -- house). Based on our field observations and residential nature of the proposed project, it is our opinion
that the proposed project will not negatively affect or significantly impact the potential for the off -site properties to be
listed on the National Register of Historic Places, should they in fact be determined to be eligible for listing on the
National Register of Historic Places at a later time

The purpose of the proposed project is to provide access /utility infrastructure and to facilitate development of the site as a
residential sub - divison.

The overall project consists of developing the site with a 91 lot residential sub - division. In order to provide safe line -of-
site access to the residential sub - division, an access road from Birch Creek Road is necessary. Additionally, utilities will
be provided with the access road right -of -way. To facilitate the construction of the access road and development of the
site, clearing and grading the site is necessary. Graders, haulers, excavators and other heavy equipment will be used
during grading and construction of the site.

down - gradient of the pond on the site. Therefore, riparian buffers are not proposed to be impacted by the proposed project
D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Due to the use of the site for residential development, a road must be constructed to provide access to the site. The road has
been designed in a location that allows for safe line -of -sight along Birch Creek Road, while also providing interconnectivity to
an existing residential sub - division located west of the site. The location of the road crossing has been designed to cross the
narrowest portion of the pond. Additionally, the location of the proposed sewer line is located beneath the proposed road right
of way, thus avoiding other potential impacts to jurisdictional features located on the site.
The location of the site and climate of the marketplace for residential properties within the vicinity of the site dictates that the
proposed development of the site as a residential sub - division must be conducted in an affordable nature for consumers. As
proposed, the project caters to these demands of the market by offering reasonably affordable housing. As a result of the
affordable nature of residences and lots, the margin of profitability based on the number of lots is less than within areas of
higher end residential properties. Therefore, the site has been designed to maximize the number of residential lots while also
having a primary focus on avoidance and minimization to jurisdictional features. Initial designs of the site allowed for a total of
128 residential lots. However, this would have resulted in greater impacts to the pond and wetlands located on the site and
thus, was not considered to be a viable alternative.
A second design, as submitted within the initial permit application reduced the number of lots to a total 91 lots. This design
was based on maximizing the number of lots, while also meeting the City of Greensboro zoning requirements (minimum 7,000
square feet and appropriate setbacks. Additionally, the lot layout was designed to satisfy developer setback requirements for
pad location. Within the second design, proposed lots between 70 and 71 were eliminated due to the presence of wetlands.
Proposed impacts to lots 66, 72 and 73 were avoided due to reduction of lot site. Likewise, lots 68 to 70 were re- designed
with a different orientation, thus, reducing the amount of impact to the head of the wetland.
A third design, as submitted within this reply for additional information, has further reduced the amount of impacts to wetlands
located on the site by reducing impacts associated with lot fill and grading activities. In doing so, an additional 0.003 acres of
wetlands are being avoided. The impacts to wetlands associated with lots, as proposed in the latest design, is necessary for
the grading and construction of the residential building pads.
The site contains a 0.45 acre pond and 0.48 acres of wetlands. The remaining 0.392 acres of pond and 0.399 acres of
wetland have been avoided.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence will be used. Disturbance limits will be surveyed, staked and marked with high
visibility fencing. The pond will be pumped to lower the water elevation such that work will be conducted in the dry. Following
construction, disturbed slopes will be stabilized with permanent seeding, matting and temporary slope linings. Best

management practices will be implemented during construction activities to avoid sediment discharge into downgradient water
bodies.

Dear Mr. Brame:
The City of Greensboro has been involved with the review and permitting of the proposed
development and permit application of Mr. Jon Ford of Taylors Landing, LLC. We can confirm that
Mr. Ford's application was approved by the Watershed Protection Stormwater Water Staff of the
Greensboro Technical Review Committee, and that we consider this application "approved" based on
the information submitted and reviewed for this development.
Greensboro's TRC process is designed to allow City Staff and the developer to interact and address all
necessary issues prior to commencement of the design of the project. This matter was first discussed at
a sketch plan on June 26, 2014. Mr. Ford's design engineer Borum Wade and Associates, P.A. met
with the Technical Review Committee and received comments regarding the proposed development
shown on the preliminary sketch plan. Following the meeting, site specific evidence dated July 14,
2014 determined that an ephemeral channel was present onsite. Ephemeral channels in the Jordan
Watershed do not require stream buffers and therefore a stream buffer was not deemed required for
the development of the site.
The Technical Review process continued with a submittal on January 27, 2015 and subsequently the
Watershed Protection Stormwater Review point of Greensboro Technical Review Committee
approved the plan on March 12, 2015. While revisions to the existing plan were resubmitted on April
22, 2015, after further review, it is the City's opinion that the City's buffer requirements are
adequately fulfilled based on the ephemeral call previously mentioned.

During the site visit David indicated a point where a tributary started (I can't remember if it was the channel coming
from the pond or at the bottom of the dam slope. Since the maps in the permit file will be the final approved version
would you please show that point. I can't tell from the plans if it'll be within this property or just below it. David also
found another small wetland that day and the plans /permit submittal need to be updated to reflect that (and any
changes to the lot layout ?)
I'll also need documentation from the City regarding whether the pond has buffers. I know Virginia is working on
that. And can you tell me if the stormwater plan is already approved through the City? I'll need a copy and it's much
easier to get a copy now verses after the permit is issued.
