Dear Mr. Yates:
On April 28, 2015, the Division of Water Resources — Water Quality Programs (Division)
received your application dated April 27, 2015, requesting a 401 Water Quality Certification
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following
information is received:
1. Please provide clear documentation and the calculation used to provide the answer of
12% for Question #E 2a on Page 8 of the PCN Form. Please provide a plan sheet that
shows the entire area used for this calculation and identifies all built -upon area. The
area used for the project density calculation should be determined by the purpose and
need of the project. The project density should be calculated as the total built -upon
area divide by the total project area. A project with existing development may calculate
project density as the difference of total built -upon area minus existing built -upon area
divided by the difference of total project area minus existing built -upon area. Projects
under a common plan of development shall be considered as a single project for
purposes of density calculation. [15A NCAC 02H .0506(b)(5) and (c)(5)]
Pursuant to Title 15A NCAC 02H .0502(e) the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.

Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
