However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on June 2, 2023. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items in Sections A through I, or failure to provide the additional information on or before the above requested date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2). Proiect Narrative: 1. It is unclear how excess water will be managed during the operation of this facility. In the previous application, it was the Division's stance that this water was a supernatant wastewater that would not be covered under this permit as a residual, but instead a wastewater which would require a Division -approved disposal method. The DGS Management System section and the Process Flow Chart section mention that should evaporation rates not keep up with wastewater generation, water will be pumped from the evaporation basin to another tanker truck which will transport the water to areas where it can be land applied. Wastewater irrigation systems are permitted under 15A NCAC 02T .0500, and operation in this manner would require a separate permit. It is our understanding that in the previous containment basin project, pumping and hauling to a wastewater treatment plant was explored as a way to dispose of the water in a Division -approved manner. However, there were issues getting wastewater treatment plants to accept the water, so remixing the water for land application as a residual under Permit WQ0035749 was explored. How will excess water be managed for this operation? 2. The Process Flow Chart section and Appendix 1 of the Operation and Maintenance Plan lists dust suppression as a disposal option for the surplus water generated from the diamond grinding process. The land application of this material as dust suppression is a beneficial reuse would need to meet reclaimed water standards as regulated by 15A NCAC 02U. Please remove this section unless a permit application meeting the requirements of 15A NCAC 02U is submitted. B. Application Fee: 1. No comments C. Distribution of Class A Residuals (FORM: DCAR 06-16) Application: 1. No comments. D. Property Ownership Documentation: 1. No comments. E. Site Map: The site plan provided for the "Proposed Layout of DGS Management Systems" has a low resolution and is not easily interpretable or reproducible. Please provide a higher quality version of this map. 2. In accordance with 15A NCAC 02T .1104(a)(1), a site plan shall be provided depicting the location, orientation, and relationship of facility components to include: a. a scaled map of the site, with topographic contour intervals not exceeding 10 feet or 25 percent of total site relief and showing all facility -related structures and fences within the treatment and storage areas; Mr. Chris Peoples May 3, 2023 Page 3 of 4 b. the location of each of the following that are located within 500 feet of a waste treatment, or storage site, including a delineation of their review and compliance boundaries: (i) wells, including usage and construction details if available; (ii) ephemeral, intermittent, and perennial streams; (iii) springs; (iv) lakes; (v) ponds; and (vi) other surface drainage features; c. setbacks as required by Rule .1108 of this Section; and d. site property boundaries within 500 feet of all treatment and storage facilities An updated site plan shall be submitted meeting these requirements. In particular, these plans shall include the contours of the proposed basin system and any water conveyance located near these units. 3. A basin is shown north of the project site on the Proposed Layout plan sheet, but it was unclear what this structure was. Please provide a clarification for what this basin is used for, and if there is any potential for hydraulic exchange between the containment basin and this basin. F. Engineering Plans: 1. The section views provided in Section A -A indicated a 3" pump line from the main containment basin to the evaporation basin #1, but the pump itself and any associated appurtenances are not included in the section drawing. These units shall be shown on an updated plan sheet. 2. Please provide detail drawings for the pump mentioned in Section A -A as well as the pond evaporation fountains being proposed in other areas of the application. 3. The section views shown shall be updated also include the graded elevations for each basin and spillway. G. Specifications: Per Application Instruction E and 15A NCAC 02T .1104(a)(2)(B), a North Carolina licensed Professional Engineer shall sign, seal, and date the specifications. Please provide updated specifications that have been sealed by a licensed Professional Engineer. 2. Specifications and data sheet information shall be provided for the pump and pond evaporation fountains being proposed. H. Engineering Calculations: 1. In accordance with 15A NCAC 02T . 1 104(a)(2)(C), engineering calculations shall include a total dynamic head and system curve analysis for each pump. Please provide calculations for the sizing of this pump. Mr. Chris Peoples May 3, 2023 Page 4 of 4 I. Operation & Maintenance Plan: 1. The Sampling and Monitoring Plan notes that sampling for pH will occur for each truckload to demonstrate that the material is non -hazardous under RCRA in accordance with EPA Test Method 9040C. Please clarify who has the Field Laboratory Certification (whether it be DOT or Lane Construction) for sampling this parameter and provide the lab identification number to satisfy NCDWR Laboratory Certification requirements. 2. The NCDEQ Representative in the Key Personnel section on Page 18 lists Corey Basinger as one of the contacts, but he is no longer with the Department. Please update this section to remove him.
