J. Setback Waivers:
1. During review of the permit application, it was found that the designated location for the 0.35 acre
spray field was within approximately 25 feet of the property line shared with Parcel 0870-11-27-
3330. Per [15A NCAC 02H .02190)(5)], spray irrigation shall not take place within 150 feet of a
property line unless both parcels are owned by the same entity. Please provide a notarized setback
waiver that has been filed with the Durham County Register of Deeds.
