Thank you for your PCN, dated 4/3/2023, for the above referenced project. I have reviewed the information and need
clarification before proceeding with verifying the use of Nationwide Permit (NWP) 12 (https://saw-
reg.usace.army.mil/NWP2021/NWP12.pdf). Please submit the requested information below (via e-mail is fine) within 30
days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider
your application withdrawn and close the file:
1) Upon review of your submitted information it is not clear that the project design demonstrates avoidance and
minimization to the maximum extent practicable as required by NWP General Conditions 23(a) and (b). For
example, it appears that the butane truck terminal portion of the project could be designed in upland areas
between Wetland W4 and Stream 11, thereby avoiding impacts to Wetland W4. Please re -design the project
accordingly, or provide documentation that such avoidance and minimization measures are not practicable (i.e.
available and capable of being done after taking into consideration cost, existing technology, and logistics in light
of overall project purposes);
2) The plans provided, though detailed, do not clearly show the extent of wetland impacts proposed for this
project. Please provide a plan view clearly showing the proposed wetland impact footprints and differing
wetland impact types (permanent fill, permanent conversion, and temporary) using differing shading, hatching,
or other methods.
3) The proposed project appears to impact the entirety of Wetland W4, including the small portion of this wetland
area along Chimney Rock Road via a sanitary sewer line, re-routing of hydrology, or both. Unless otherwise
justified, the Corps would consider this additional 0.003 acre of wetlands as a permanent impact subject to
compensatory mitigation requirements.
4) Section 4.18 of your PCN narrative submittal references a "survey of the project area" for Schweinitz's
sunflower. Please provide additional information regarding this survey, including when it was conducted and the
general qualifications of staff conducting the survey in regards to this species.
5) Please note that all of the wetland areas proposed for impact would be considered Headwater Forest wetlands
according to the NC Wetland Assessment Method (NCWAM), which therefore corresponds to a riparian non-
riverine wetland type for compensatory mitigation purposes. Note also that, unless otherwise justified,
compensatory mitigation is required at a 2:1 credit to impact ratio for permanent wetland fill impacts and a 1:1
credit to impact ratio for permanent conversion wetland impacts.
